Circuit Civil

Civil court cases are disputes or disagreements between parties. A party can file a dispute against one person, a business or multiple persons and/or businesses to recover damages or to protect property.

Circuit civil cases are non-criminal cases in which individuals or businesses sue for damages exceeding $50,000.

The one who files a complaint is called the Plaintiff, and the Defendant is the one who responds to the complaint made against them.

When naming the Defendant(s) on all court documents, it’s important to name the parties correctly otherwise your claim could be rejected. If the Defendant is a business, you must name the correct legal entity.

Who Can File A Civil Case?

In order to be a party in a civil law case in Florida an individual must be 18 years of age or older. An attorney is recommended however you may file a case as a ProSe litigant. Deputy clerks are unable to provide legal advice.
