Tax Deed Surplus<\/h1>\n

A tax deed sale surplus occurs when a tax deed sale for a particular property results in the final selling price being higher than the opening bid amount. The excess money is classified as the tax deed sale surplus.<\/p>\n

In order to be considered for distribution of surplus funds, you must submit a notarized statement of claim to this office, which includes the following information:<\/p>\n

  • TDA#<\/strong><\/li>\n
  • DATE OF SALE<\/strong><\/li>\n
  • LEGAL DESCRIPTION OF PROPERTY OR BOOK AND PAGE OF RECORDED DEED OR LIEN<\/strong><\/li>\n
  • BASIS OF YOUR CLAIM (AS OWNER, MORTGAGOR, LIENOR)<\/strong><\/li>\n
  • AMOUNT OF SURPLUS<\/strong><\/li>\n
  • NAME & ADDRESS OF PERSON(S) TO RECEIVE SURPLUS<\/strong><\/li>\n
  • COPIES OF VALID DRIVERS LICENSE OR ID CARD<\/strong><\/li>\n
  • SIGNED IRS W-9 FORM<\/strong><\/li>\n<\/ul>\n

    In addition to the above-mentioned information, copies of documents supporting your claim are required. Also, any documents effecting name and\/or marital status changes (copy of marriage license, spouse\u2019s death certificate), and any other documentation to show you are the person entitled to the surplus funds. <\/p>\n

    If your claim is for an Estate also provide any probate documents, death certificates, orders, Summary Administration you may have. <\/p>\n

    A Surplus Claim form and IRS W-9 form must be completed and returned with any of the above documents that you have not previously submitted. <\/p>\n

    Further questions regarding surplus claims may be directed to Clerk of the Circuit Court, Tax Deed Clerk at (239) 252-2646, or mailed to the above address marked ATTENTION: Tax Deeds. <\/p>\n

    Claims by a Lien Holder must be filed within 120 days of the date the surplus notice was mailed or they are barred. <\/p>\n

    You may claim surplus funds from our office free of charge<\/ins><\/strong>. Paying a fee or percentage of the surplus for assistance from a third party is not<\/ins><\/strong> required to submit a claim.<\/p>\n
