Realty Trust, Inc., (Developer) for the design, permitting, and construction of the extension of Veteran’s Memorial Boulevard, and authorize the necessary Budget Amendments. OBJECTIVE: To approve and execute the attached Developer Agreement (Agreement) to design, permit and construct an extension of Veteran’s Memorial Boulevard from Aubrey Rodgers High School to the eastern property line of the Seminole Gulf Railroad right-of-way. CONSIDERATIONS: Veteran’s Memorial Boulevard was previously extended to Aubrey Rogers High School for the school to open in 2023. The intent is to extend the road to US 41 as another east-west connection within the County. The County is working through the process to gain right-of-way from the Seminole Gulf Railroad to US 41. The Developer of Imperial Lakes Planned Unit Development is willing to extend the road from its current terminus to the eastern boundary of the Seminole Gulf Railroad in order to provide necessary access to their PUD, which has remained landlocked since its rezoning in 1982. Construction of the roadway facilitates the Developer’s timely development of the PUD while providing the County with an expanded public roadway connection that improves access, supports future development opportunities, and enhances the overall transportation network in the area sooner than would otherwise occur. The roadway improvements also include the extension of a watermain for the Collier County Water Sewer District for the entire project limits. The Developer Agreement provides that the Developer will build a 4-lane urban cross-section consistent with the County’s adopted capital improvement plan. The County shall reimburse the Developer for the design, permitting, and mitigation costs for the roadway except for improvements that are solely for the benefit of the developer, such as driveway connections, walls, etc. The Project will go through the County’s public bidding process, and the reimbursement will be based on the low bid amount. The Developer will also extend a water main for the entire length of the project, in which the costs will be reimbursed by the Collier County Water/Sewer District. The Developer will extend the force main to their point of connection at their cost. The County will provide the Construction Engineering & Inspection Services (CEI) for the Project. This item supports the Infrastructure and Asset Management Strategic Focus Area of the Strategic Plan by planning and building public infrastructure to effectively and efficiently meet the needs of the community. FISCAL IMPACT: Design and permitting costs are estimated at $960,000. The County will be responsible for reimbursement of the design, permitting, and mitigation costs of the Project except for improvements that are solely for the benefit of the developer, such as driveway connections, walls, etc. The County will provide CEI for the Project. Funding for the roadway construction portion of the agreement is programmed within Veterans Memorial Road Project (60198). A budget amendment in the amount of $650,000 is required to reallocate funding from the Distribution System TSP Project (71010) to the Veterans Memorial Road Project (60198) within Water Capital Fund (4012) for the water main extension. GROWTH MANAGEMENT IMPACT: The proposed Agreement is consistent with the Growth Management Plan. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for approval. -SAA RECOMMENDATION(S): To approve and execute the Developer Agreement that will require the Developer to design, permit, and construct a portion of Veteran’s Memorial Boulevard and authorize the necessary Budget Amendments.
