Enforcement Board, in and for the County of Collier, having
conducted business herein, met on this date at 9:00 a.m., in
REGULAR SESSION in Building "F" of the Government Complex,

like to call the Code Enforcement Board to order, beginning with a
quick notice reading.
Notice: Respondents may be limited to 20 minutes for case
presentation unless additional time is granted by the Board. Persons
wishing to speak on any agenda item will receive up to five minutes
unless the time is adjusted by the Chairman.
All parties participating in the public hearing are asked to
observe Roberts Rules of Order and speak one at a time so the court
reporter can record all statements being made.
Any person who decides to appeal a decision of this will need a
record of the proceedings pertaining thereto and, therefore, may need
to ensure that a verbatim record of the proceedings is made, which

MR. WOODWARD: So it's Cameron Woodward on behalf of
the respondent.
So this was a steel-frame structure that was damaged in a fire.
On September 26th of last year, County staff determined that tensile

strength testing would need to be conducted on the steel frame of the
structure to determine whether or not those were substantially
damaged in the fire and needed to be replaced. Those tests were
conducted, and a report was provided on November 11th of last year.
On the 19th of that, the engineer determined that although those
steel beams were fine, roof -- light gauge roof purlins, roof decking,
roof vent framing, front wall framing, and the front steel wall framing
in the area that was affected by the fire would all need to be replaced.
So where we stand now is the engineering and the contracting
are working on incorporating those -- that work that needs to be done
into the permit, and once that's completed, this should close out the
case. We are requesting at this time a 120-day extension.

MR. GOEPFERT: Brian Goepfert, Collier County Code
Enforcement.
Yeah, the testing they had to do was quite extensive. They had
to remove it and ship it offsite for the actual tensile strength testing.
They are -- their engineer has been in contact with me. They have
three engineers working on this issue. So what he's said was true.
I'm not opposed to an extension, but I'd like to keep -- be
informed of regular, you know, progressive steps to compliance.
CHAIRMAN FUENTES: Okay.
MR. WOODWARD: And our firm has no issue with providing
updates on a routine basis to the Code Enforcement officer.
And as far as the testing you mentioned, how extensive it was, it
did -- we did have to -- well, the engineer's not us. But the engineers
had to brace the entire structure in order to remove portions of the
steel that needed to be tensile strength. So there were photographs
that were provided in the report, and it just looks like a spider web of
steel bracing everywhere while these pieces were being removed.

objection to it, so, you know, it's only requested that you keep them
informed. As you know, you've been here several times. We like
compliance, so if you could at least do that for us.

MR. WOODWARD: So on this case, this is a case of
unpermitted work. The issues, there are many. There was pavers
installed on the outside of the structure, which was not on the site
plan. There was canopies installed over the exterior of the doorways,
the entryways into the structure. There was a dock with a wooden
stairway going down to it. This is a waterfront piece of property.
And then on the interior of the structure, there was a stairway,
bathrooms, mezzanine for public use, separate offices, and electric
and plumbing work that was completed without a permit.
To date, the canopies installed over the doorways have been
removed. The dock itself has been removed as well, although the
pavers and the wooden stairway going down to where the dock
formerly was occupied remain on the property.
CHAIRMAN FUENTES: Do we have a demo permit for these?
MR. WOODWARD: It was a floating dock. It was just moved
away.
CHAIRMAN FUENTES: Understood.
MR. WOODWARD: So -- and it was moved to a property that
it was actually permitted at initially.
We had -- on March 3rd, our firm and a contractor that was
retained by the respondent, who's Ralph Liy via First Choice
Developers, had a meeting with County staff. We've had follow-up
meetings, and we've determined that an insignificant change to the
site plan could be done, which would incorporate the pavers on the
outside of the structure, and we would be looking to include the
wooden stairway leading to where the dock would be, and that would

resolve those issues.
As far as the interior of the structure goes, the contractor, I
spoke with him last night, and he anticipates by the end of next week,
and if not that, by early next week having a permit application
submitted for those interior portions.
Once that's been submitted, because this is an after-the-fact
permit, the inspections are going to be a little bit different.
Ordinarily, the walls would be open. They'd come in, see the
plumbing, see electrical, sign off. In this case, the walls would need
to be opened up since this has been done.
So that's where we stand. And we're asking for a 120-day
extension where we can get this moving forward.

Good morning, Stephanie.

MR. FARLANDER: I own a boat rental operation here in
Naples, and when I -- originally when I signed the lease with that
property in question, the -- as such, the previous permit -- or the
previous issue at the 3270 address, I was unaware at the time that
there was open Code Enforcement issues.
When I submitted for a commercial business tax receipt last
April, I was told that, you know, you could not get a zoning
certification, couldn't do anything until these other issues were
resolved. Brought that to the property owner's attention, and over the
course of the six to nine months recently, they ultimately determined
at a hearing that, you know, now it needed -- you needed the docking
to get permitted.
MR. IANDIMARINO: If I may, Mr. Fuentes. This is a regular
hearing. If we can follow our procedures for the hearing, and starting

County Code Enforcement.
This is in reference to Case No. CEOCC20260001099 dealing
with the violation of Collier County Code of Laws and Ordinances,
Chapter 126, Article IV, Section 126-111(b), business operating
without required Collier County approvals located at the property of
3200 Bayshore Drive, Folio 48171320008.
Personal service was given on January 29th, 2026. I was on site
on January 29th, 2026, and witnessed On the Pontoon Boat, LLC,
operating without the required Collier County approvals.
On the Pontoon Boat, LLC, has a business tax receipt but is not
approved to operate out of this location. This is the third case within
a year regarding this business operating without required approvals.
The previous two cases were located across the canal at 3270
Bayshore Drive.
The violation remains as of March 25th, 2026.

been located. Now it's over on this section. Previously it was over
here for the two previous cases.
Showing the boats in the canal. This shows the check-in station,
and this was my reinspection yesterday. There's three boats in the
canal, check-in station, and the crew on site.

MR. FARLANDER: It was brought to my attention last March
that I needed to obtain a proper business tax receipt. When I went to
the Zoning department, I explained what I was wanting to do. It was
a previous business that was operated at 2891 Bayview Drive, and
they had an office space there.
When I went and got my business tax receipt, they said, "Do you
have an office space on site?"
I said, "No, I do not. I conduct everything on my phone. We
have a little check-in desk, but there's no office site. It's strictly just
the marina use." Explained that it is a commercial-rated marina and
that I'd be operating boat rentals, and I was issued a home business
tax receipt. That's my personal address at home.
Once it was brought to my attention, I went in -- after Ray
was -- determined that I needed to get a commercial business tax
receipt, I reached out to the planner that had assisted the previous
owner in obtaining this commercial business tax receipt, which would
also involve the SDPI for the 3270 address, and was denied through
the Planning and Permitting departments due to the open other cases
with the SDP with the pavers, the interior renovations at 3270.
Back in January, when there was another hearing, it was
determined that the dock needed to be completely removed.
Originally, I thought my -- I was going to be at this 3200 address
anyway. 3200 is a permitted dock that was built in 2007. There is
two accessory uses. There's a hotel and a restaurant on site for boat
rental activities.
And I have a planner ready to submit the SDPI for the zoning
certification letter, get fire compliance, as well as in writing from the
Bayshore CRA to use their parking spaces across the street for the
parking matrix.
In addition to that, we are going to be doing a whole SDP for
both the two properties in the -- sometime in the next 30 to 45 days,

using Greg Orick as the commercial marina contractor to properly
reflect the boat rental business operation as well as make sure we're
in compliance; however, the day -- that was moved on the
January 26th, and on January 26th I submitted for a zoning
certification letter. Lance Miller denied it because of the other open
Code Enforcement issues. If it was just my Code Enforcement issue,
I could keep proceeding to obtain my proper business tax license, but
because of the other issues at 3200, the County and Permitting will
not allow me to proceed any further until those are resolved, which
they are currently taking care of.
CHAIRMAN FUENTES: Okay. So what we're going to do
here is we've got to make -- we've got to determine whether or not a
violation exists. It is great to see that you're working to getting these
things completed.

So you're taking the required steps to get it corrected. A
violation still does exist, and I'm sure that the County here will assist
us through that as well.
MS. GUTTUM: That is correct, yes.
Our recommendation is that the Code Enforcement Board orders
the respondent to pay all operational costs in the amount of $59.28
incurred in the prosecution of this case within 30 days, and abate all
violations by: Cease the operation of unapproved business and
remove associated business items and advertisements within -- from
the property within certain amount of days of this hearing, or a fine of
a certain dollar amount per day will be imposed until the violation is
abated; that the Code Enforcement Board imposes a civil penalty;
that the respondent must notify the Code Enforcement Board
investigator when the violation has been abated in order to conduct a
final inspection to confirm abatement.
If the respondent fails to abate the violation, the County may
abate the violation using any method to bring the violation into
compliance and may use the assistance of the Collier County Sheriff's
Office to enforce the provisions of this order, and all costs of
abatement shall be assessed to the property owner.
CHAIRMAN FUENTES: Thank you, Stephanie.
So we're going to fill in the blanks here. And, again, you're
working on compliance, so we do appreciate that. It looks like you
guys know what you're doing, and I'm sorry that the other case is
hindering you guys a bit.
MR. WOODWARD: And if I may, I don't represent the
respondent in this matter. I actually represent his landlord, and
so -- and limited --
MS. BUCHILLON: Can you speak into the microphone, Mr.

MR. WOODWARD: I'm sorry. Our firm's recommendation is

limited to the underlying Code Enforcement issue which is
preventing him from getting his business tax license.
As far as that goes, I did speak with the contractor, who's Ralph
Liy, via First Choice Developers, who was also retained to handle
this matter as well.
This is a two-story structure. On the second floor, it's my
understanding one of the units had some interior work done, and I
believe, from speaking with him, his understanding is it was some
sort of storage unit that was created inside.
This will need be permitted. He anticipates having a permit
application submitted the end of next week as well. Additionally, in
the photographs -- if you could go back to the second one that
showed the boat.
MR. LETOURNEAU: Stephanie, could you go back to the
photograph?
MR. WOODWARD: This --
MS. GUTTUM: This one?
MR. WOODWARD: The last one you were just on. This
structure here with the swing inside of it is also a Code Enforcement
issue as well, and that will be removed.
So -- but once those two issues are resolved, that Code
Enforcement action should be resolved, and the property will be in
compliance, and that will allow him to move forward. And all of his
ducks are in a row, is my understanding.
BOARD MEMBER ELROD: What kind of time frame are you
looking for?
MR. WOODWARD: As far as the removal, that can be done
very quickly because that's just four four-by-fours and a swing. The
actual upstairs-unit issue, he anticipates having the permit application
submitted either by the end of next week or early next -- the
following week.

And then it's just a matter of getting the inspectors on site,
having them confirm that everything is to code, and if it's not, getting
that area corrected.
It's a little bit more difficult with giving you a time frame with
an after-the-fact permit because then you have to open up things and
take a look at where you stand. So -- but we are moving forward on
that as rapidly as possible.
CHAIRMAN FUENTES: So he's basically at the hands and the
mercy of the landlord. Anybody want to fill in that blank?
Can we go back to the recommendation, Stephanie, I'm sorry.
MS. GUTTUM: Yep.
CHAIRMAN FUENTES: We have the operational costs today
of 59.29.
MS. BUCHILLON: Twenty-eight.

that's going to take to get it resolved, and then he has to move
forward.
MR. FARLANDER: If I may, my process to obtain the
commercial business tax receipt, once this is resolved, two to three
weeks is what my -- Ellen Summers with Bowman is predicting.
CHAIRMAN FUENTES: Yeah, but the problem is it's not
based on what you're going to have completed. It's based on the
landlord.
MR. FARLANDER: Correct.
CHAIRMAN FUENTES: So she's trying to figure out how long
that would take.
BOARD MEMBER ELROD: Three or six months?

MR. WOODWARD: Six months would be preferable. And I'd
be happy to provide updates to the Code Enforcement Board officer
as to our progress.
MR. IANDIMARINO: The County will have no objection to
180 days.

First and foremost, just a brief touch upon. Originally this was
an SDP that was requested. There was a pre-application meeting
which ended up resolving and resulting in an SIP. So my client has
continued down that road to obtain the SIP, has submitted. We've
been receiving comments back; however, further, there is another
unexpected request and comment that was an easement.
So we have here today the owner's engineer, Mike Herrera, who
can speak further on those items and what has been done in good
faith to try and reach compliance. So I'll turn it over to him.

MR. HERRERA: Good morning. Michael Herrera, Blue Shore
Engineering, licensed surveyor in the state of Florida.
So our firm was retained in May of 2025. We attended the
pre-application meeting, and it was determined that an SIP was
warranted for this property.
We had a little bit of a slow start mostly because of surveying.
The past project surveyor was nonresponsive. It cost us about six
weeks.
We hired a new surveyor and immediately obtained the
information that we needed for submittal, which had to do with the

property currently does not discharge to the eastern property, which
is a South Florida Water Management District canal.
At the SIP application, it was discussed but not confirmed that a
South Florida Water Management District right-of-way permit would
be required because the existing topography of the property was
unknown at that time in terms of which way water sheet-flowed.
We determined through discussions with Collier County that, in
fact, we will be discharging into the South Florida Water
Management District canal and, therefore, that brought in another
regulatory agency that needs to be part of this application.
We are required to obtain, for this property, a Collier County
SIP, a South Florida Water Management District waterway permit,
and we did submit for a fence waiver. The fence waiver has been
approved. We expect -- the South Florida Water Management
District and SIP are both currently under review. They were
submitted on March 18th, both. We expect -- according to the online
portal, Collier County online portal, the SDP permit currently has
five reviews. One is approved; four is pending. We only -- the
original application had 13 reviews; 11 approved, two rejected. So,
really, there's only two possible rejections on this round of
comments.
We expect the approval, though, on April 9th. So less than a
couple weeks away we should have the County permit, but we also
need to obtain the South Florida Water Management District permit,
which will be our third and final permit. We don't expect
that -- unfortunately, the South Florida Water Management District
takes 60 days for their final -- thirty days for review, 30 days to issue
the permit. So the final review really takes 60 days for that permit to
be issued.
Once that permit is issued -- we've already been in discussions.
We recommended two local contractors to the client to conduct the

work -- to bid the work. One they're visiting today or tomorrow, on
site, and the second one will also be providing a bid. So once these
permits are obtained, the property owner can start construction
immediately, get the certificate of completion, and get the project
closed out.
CHAIRMAN FUENTES: Okay.
MS. ENCALADA: So as you can see, that we have already
taken that next step in trying to obtain the contractors who are going
to perform the work to get that already set up. So then the green light
can be given once the permit is issued.
So at this time, we'd be asking for a continuance of 180 days in
order to complete everything and come into compliance.
CHAIRMAN FUENTES: So I guess my only concern is this
case has been open since 2022. And I know we have another case
that was opened in 2021. So we're looking at about five years in for
two different cases.
Me, personally, I'm not too fond of granting a continuance just
because of the length of the case. What does the Board think?

swiftly moving as fast as he possibly can to make back and forth on
these submittals and comments. So he's taken all the good steps and
very attentive on this matter.
MR. HERRERA: The previous engineer did do substantial
work. I have no idea why they didn't finish it.

property was an older property, and the County did not have any
records of any improvements made to this property over the last, say,

So some of the -- so the initial code violation was as a result of
the unpermitted work, and that sort of opened up the door to several
other violations that were inherited by the tenant for prior work over
the last 30 years.

Investigator Robertson attempted several contacts at the
property. He finally met with the property owner in June of 2025.
He observed travel trailer with no septic, water hooked up, and no
signs of being occupied.
The property owner, Robert, agreed to get the vehicle registered

structure, he indicated it was permitted by the previous owner.
Reinspection in July found Permit PRCP20250731130 had been
applied for to permit the metal building/structure. Valid registration
for the trailers were provided in August 2025.

2025.
In November, the permit remained in rejected status for over
two months. Notice was prepared and served on November 18th of
2025. Additional checks of the permit found no change in status.
Case was prepared for a hearing in February of 2026.
During prehearing inspection on March 25th, 2026, the metal
building remains on the property and Permit
PRCP25 -- 20250835308 is in issued status with an expira- -- I'm
sorry -- issued as of the 16th of March.

was able to observe it from legal vantage due to the property was
fenced in with the gate closed, so that it is one side of the property,
and there it is from the back side showing it is still, in fact, on the
property.
CHAIRMAN FUENTES: Okay. What was the reason for the
permit to be pulled on March 16th?
MR. ESPINOSA: Well, good morning. I bought the property
with the shed in there. And I'm a contractor as well. I've been -- I'm
so busy, and I hire a company to handle the permitting process for
me, and they didn't run [sic]. And so I ended up going to the County
and explaining -- giving me a reason to why the permit was rejected.
And they want me to do a variance hearing for it, but the inspector,
whoever came in first, they thought that I build the permit -- I mean,
built the shed, so they wanted to do, like, a Code Enforcement -- a
code case for my license.
And so I ended up to talk to the building officer, "Hey, I didn't
do it." So they look at the proof. So they look in the records, and
they ended up the -- previous owner built it in 2021. So I filed the
final requirements for them, and they approved the permit for last
week.
CHAIRMAN FUENTES: Unfortunately, sometimes when you

this. I moved out. And obviously, my fault. I totally forgot to check
his mails and everything, so it's my fault.
We already issued the permit, and we just need to set up an
appointment for an inspector. That's it. So I would like to request an
extension for 60 days.

It has been restored to its previous condition, but in conjunction
they put the repair of their front culvert in with that same permit. So
because the front culvert is not done, the permit is not closed. He
did -- I did reinspect and find the swale's been returned to its previous
condition. The gate is closed and locked. So they're no longer using
the Green Boulevard right-of-way access.

to this point. I finally got the Notice of Commencement on
March 23rd, and I have the approval of construction documents and
the building plan review and inspection. It's all set. It took a long
time to get to this point.
When I purchased the property, the Realtor was looking for a
guesthouse for me, and it was a foreclosure at the time. And the
listing shows guesthouse living area. We looked at it. We decided to
buy it, and it was a foreclosure.
The bank gave me a mortgage, and the owners that were there
before ripped a lot of stuff out. They took the air-conditioners.
And I was unaware that it wasn't permitted. And we had a
towing company, A to Z Towing & Recovery, and we needed a place
for the tow truck drivers to live because of some of them won't work
down in Naples unless they have a place.
So we purchased it. And from there on, they were living there
until Rick passed away, and I told the tow truck driver he has to
leave.
Well, that caused a problem. I guess he got upset, and evidently

he went into Collier County listing and found out that it was never
approved, which I never knew.
So when I met with the Code Enforcement guy, I said, "Well, I'll
bring up to date whatever I have to do."
And the person left. And no one's living there. Everything is
shut off.
So we started the process. And it's hard to find some people to,
you know, do this. And I'm working with a contractor. He's very
nice, very good. And I found out later that Collier County won't
approve it as a guesthouse because it was 900 square feet, and Collier
County has a stipulation that it cannot be more than 40 percent of my
current square footage, which would have made it 750 square feet.
So I said, "Oh, what I am going to do?"
And eventually, we talked with Collier County, and they said
they will do it as a mother-in-law suite. They will allow me to
enclose the breeze way, which is what I'm in the process of.
So I had the architect -- when he initially did the drawing, it was
for the guesthouse portion, which showed 900 square feet. Then I
had to get them back to redo the breezeway design. They were on
vacation and out of the country, so that was another delay. That was
finally done, and it was submitted to Collier County.

This is in reference to Case No. CESD20240009549 dealing
with the violation of Collier County Land Development Code 04-1
[sic], as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e), and
10.02.06(B)(1)(e)(i).
The violation consists of repair work performed to fire-damaged
portions of the structure, including the roof and soffit, as well as the
replacement of a window without first obtaining the required Collier
County building permit and completion with necessary inspections
through issuance of a certificate of completion or occupancy located
at 118 Dixie Avenue West, Immokalee Road, Florida 34142. Folio
No. 8784005 -- sorry. Folio No. 87840005.
Service was given on November 5th, 2024, with a notice of
violation signed by the respondent, and the notice of violation also
certified and regular mail to the respondent's listed address.
This case originated from a property maintenance complaint
opened on November 21st, 2023, following fire damage to the
residence. The respondent subsequently retained MTC General
Contractor, LLC, to perform the reroofing work.
Permit No. PRFH20240310119 was applied for on March 18th,
2024. Permit was issued November 15th, 2024, and ultimately
expired on August 11th, 2025.
To date, no inspections have been conducted under this permit.
Additionally, there are outstanding inspection holds requiring the
addition of an electrical subcontractor and submission of a permit
revision.
I assumed responsibility of this case in February 4th, 2026, at

which time I conducted a comprehensive review of this case history
and confirmed that the permit remains expired with no change in
status.
Multiple attempts have been made to contact both the
respondent and the contractor; however, those efforts have been
unsuccessful.
Given that no recent actions have been taken to bring the
property into compliance, this case was prepared for hearing before
the Code Enforcement Board.
I would now like to present case evidence in the following
exhibits: Two photos taken by Senior Investigator Sherry Patterson
on the November 21st, 2023; six photos taken by former Property
Maintenance Investigator Steve Athey on February 6th, 2024, stored
on a shared drive that I have access to; one determination by Deputy
Building Official Doug Sposito, stating a permit's required, on
November 15th, 2024; one notice of violation signed by the
