CHAIRMAN FUENTES: All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. MS. BUCHILLON: ***All right. First case up, under motions, motion for extension of compliance deadline, No. 5, CESD20220010598, HGG Management, LLC. THE COURT REPORTER: Do you swear or affirm the testimony you will give will be the truth, the whole truth, and nothing but the truth? MR. WOODWARD: I do. MR. GOEPFERT: I do. CHAIRMAN FUENTES: Good morning. MR. GOEPFERT: Good morning. MR. WOODWARD: Good morning. CHAIRMAN FUENTES: Good morning. Okay, sir. MR. WOODWARD: So it's Cameron Woodward on behalf of the respondent. So this was a steel-frame structure that was damaged in a fire. On September 26th of last year, County staff determined that tensile March 26, 2026 Page 6 strength testing would need to be conducted on the steel frame of the structure to determine whether or not those were substantially damaged in the fire and needed to be replaced. Those tests were conducted, and a report was provided on November 11th of last year. On the 19th of that, the engineer determined that although those steel beams were fine, roof -- light gauge roof purlins, roof decking, roof vent framing, front wall framing, and the front steel wall framing in the area that was affected by the fire would all need to be replaced. So where we stand now is the engineering and the contracting are working on incorporating those -- that work that needs to be done into the permit, and once that's completed, this should close out the case. We are requesting at this time a 120-day extension. CHAIRMAN FUENTES: Okay. MR. GOEPFERT: Brian Goepfert, Collier County Code Enforcement. Yeah, the testing they had to do was quite extensive. They had to remove it and ship it offsite for the actual tensile strength testing. They are -- their engineer has been in contact with me. They have three engineers working on this issue. So what he's said was true. I'm not opposed to an extension, but I'd like to keep -- be informed of regular, you know, progressive steps to compliance. CHAIRMAN FUENTES: Okay. MR. WOODWARD: And our firm has no issue with providing updates on a routine basis to the Code Enforcement officer. And as far as the testing you mentioned, how extensive it was, it did -- we did have to -- well, the engineer's not us. But the engineers had to brace the entire structure in order to remove portions of the steel that needed to be tensile strength. So there were photographs that were provided in the report, and it just looks like a spider web of steel bracing everywhere while these pieces were being removed. CHAIRMAN FUENTES: Well, the County doesn't have any March 26, 2026 Page 7 objection to it, so, you know, it's only requested that you keep them informed. As you know, you've been here several times. We like compliance, so if you could at least do that for us. Does the Board want to grant the 120? BOARD MEMBER AYASUN: Yeah. Well, I -- BOARD MEMBER ELROD: Make a motion to grant the extension. CHAIRMAN FUENTES: I have a motion to grant the extension for 120 days. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: A second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: (No verbal response.) COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. MR. WOODWARD: Thank you. MR. IANDIMARINO: That was 180 days, correct? CHAIRMAN FUENTES: It was 120 days. MR. IANDIMARINO: One hundred and twenty days, okay. Thank you. Just wanted to get the notes right; 120. MS. BUCHILLON: ***Next case, we are still under extension of compliance deadline, No. 6, CESD20240010501, Bayshore Tomorrow, LLC. CHAIRMAN FUENTES: Welcome back. Good morning, Dee. MS. PULSE: Good morning. THE COURT REPORTER: Do you swear or affirm the March 26, 2026 Page 8 testimony you will give will be the truth, the whole truth, and nothing but the truth? MS. PULSE: I do. MR. WOODWARD: I do. CHAIRMAN FUENTES: Take it away. MR. WOODWARD: So on this case, this is a case of unpermitted work. The issues, there are many. There was pavers installed on the outside of the structure, which was not on the site plan. There was canopies installed over the exterior of the doorways, the entryways into the structure. There was a dock with a wooden stairway going down to it. This is a waterfront piece of property. And then on the interior of the structure, there was a stairway, bathrooms, mezzanine for public use, separate offices, and electric and plumbing work that was completed without a permit. To date, the canopies installed over the doorways have been removed. The dock itself has been removed as well, although the pavers and the wooden stairway going down to where the dock formerly was occupied remain on the property. CHAIRMAN FUENTES: Do we have a demo permit for these? MR. WOODWARD: It was a floating dock. It was just moved away. CHAIRMAN FUENTES: Understood. MR. WOODWARD: So -- and it was moved to a property that it was actually permitted at initially. We had -- on March 3rd, our firm and a contractor that was retained by the respondent, who's Ralph Liy via First Choice Developers, had a meeting with County staff. We've had follow-up meetings, and we've determined that an insignificant change to the site plan could be done, which would incorporate the pavers on the outside of the structure, and we would be looking to include the wooden stairway leading to where the dock would be, and that would March 26, 2026 Page 9 resolve those issues. As far as the interior of the structure goes, the contractor, I spoke with him last night, and he anticipates by the end of next week, and if not that, by early next week having a permit application submitted for those interior portions. Once that's been submitted, because this is an after-the-fact permit, the inspections are going to be a little bit different. Ordinarily, the walls would be open. They'd come in, see the plumbing, see electrical, sign off. In this case, the walls would need to be opened up since this has been done. So that's where we stand. And we're asking for a 120-day extension where we can get this moving forward. CHAIRMAN FUENTES: Ms. Dee. MS. PULSE: For the record, Dee Pulse. The County has no objection. CHAIRMAN FUENTES: Okay. BOARD MEMBER ELROD: Make a motion to give a 120 extension. BOARD MEMBER AYASUN: Second. BOARD MEMBER PEREZ: Second. CHAIRMAN FUENTES: All right. I've got a motion and second to grant the 120-day extension. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. MR. WOODWARD: Thank you. March 26, 2026 Page 10 CHAIRMAN FUENTES: Thank you. MS. PULSE: Thank you. MR. IANDIMARINO: Mr. Woodward, I think you're back up again. CHAIRMAN FUENTES: You can slide the chair forward if you want. MS. BUCHILLON: ***Next case, under hearings, No. 12, CEOCC20260001099, Garrett Farlander, On the Pontoon Boat, LLC. THE COURT REPORTER: Do you swear or affirm the testimony you will give will be the truth, the whole truth, and nothing but the truth? MR. WOODWARD: I do. MS. GUTTUM: Yes. MR. FARLANDER: Yes. CHAIRMAN FUENTES: Good morning to the both of you. Good morning, Stephanie. MS. GUTTUM: Good morning. MR. FARLANDER: I own a boat rental operation here in Naples, and when I -- originally when I signed the lease with that property in question, the -- as such, the previous permit -- or the previous issue at the 3270 address, I was unaware at the time that there was open Code Enforcement issues. When I submitted for a commercial business tax receipt last April, I was told that, you know, you could not get a zoning certification, couldn't do anything until these other issues were resolved. Brought that to the property owner's attention, and over the course of the six to nine months recently, they ultimately determined at a hearing that, you know, now it needed -- you needed the docking to get permitted. MR. IANDIMARINO: If I may, Mr. Fuentes. This is a regular hearing. If we can follow our procedures for the hearing, and starting March 26, 2026 Page 11 with the -- CHAIRMAN FUENTES: I apologize. You're right. MR. IANDIMARINO: That's okay. Thank you. CHAIRMAN FUENTES: We're going to have to let the investigator go on this first. MR. FARLANDER: Oh, sorry. My apologies. CHAIRMAN FUENTES: Thank you. MS. GUTTUM: Thank you. CHAIRMAN FUENTES: Sorry, Stephanie. MS. GUTTUM: For the record, Stephanie Guttum, Collier County Code Enforcement. This is in reference to Case No. CEOCC20260001099 dealing with the violation of Collier County Code of Laws and Ordinances, Chapter 126, Article IV, Section 126-111(b), business operating without required Collier County approvals located at the property of 3200 Bayshore Drive, Folio 48171320008. Personal service was given on January 29th, 2026. I was on site on January 29th, 2026, and witnessed On the Pontoon Boat, LLC, operating without the required Collier County approvals. On the Pontoon Boat, LLC, has a business tax receipt but is not approved to operate out of this location. This is the third case within a year regarding this business operating without required approvals. The previous two cases were located across the canal at 3270 Bayshore Drive. The violation remains as of March 25th, 2026. I would now like to present case evidence in the following exhibits: Aerial of the property -- BOARD MEMBER AYASUN: We have to get a vote. CHAIRMAN FUENTES: Can I get a motion to accept the photos? Has the respondent seen the photos already? MS. GUTTUM: Oh, I'm sorry. Aerial of the photo -- of the March 26, 2026 Page 12 property; three photos taken by myself on January 29th, 2026; and one photo taken yesterday, March 25th, 2026. CHAIRMAN FUENTES: Have the respondents seen the photos? MS. GUTTUM: Yes, I just showed them. CHAIRMAN FUENTES: Do you guys have objections to the photos being presented? MR. WOODWARD: No. CHAIRMAN FUENTES: Okay. Can I get a motion? BOARD MEMBER ELROD: Make a motion to accept the photos. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: Thank you. I have a motion and a second. MS. GUTTUM: Okay. Here's the canal where the business has been located. Now it's over on this section. Previously it was over here for the two previous cases. Showing the boats in the canal. This shows the check-in station, and this was my reinspection yesterday. There's three boats in the canal, check-in station, and the crew on site. CHAIRMAN FUENTES: Okay. MR. FARLANDER: My apologies for earlier. CHAIRMAN FUENTES: No worries. March 26, 2026 Page 13 MR. FARLANDER: It was brought to my attention last March that I needed to obtain a proper business tax receipt. When I went to the Zoning department, I explained what I was wanting to do. It was a previous business that was operated at 2891 Bayview Drive, and they had an office space there. When I went and got my business tax receipt, they said, "Do you have an office space on site?" I said, "No, I do not. I conduct everything on my phone. We have a little check-in desk, but there's no office site. It's strictly just the marina use." Explained that it is a commercial-rated marina and that I'd be operating boat rentals, and I was issued a home business tax receipt. That's my personal address at home. Once it was brought to my attention, I went in -- after Ray was -- determined that I needed to get a commercial business tax receipt, I reached out to the planner that had assisted the previous owner in obtaining this commercial business tax receipt, which would also involve the SDPI for the 3270 address, and was denied through the Planning and Permitting departments due to the open other cases with the SDP with the pavers, the interior renovations at 3270. Back in January, when there was another hearing, it was determined that the dock needed to be completely removed. Originally, I thought my -- I was going to be at this 3200 address anyway. 3200 is a permitted dock that was built in 2007. There is two accessory uses. There's a hotel and a restaurant on site for boat rental activities. And I have a planner ready to submit the SDPI for the zoning certification letter, get fire compliance, as well as in writing from the Bayshore CRA to use their parking spaces across the street for the parking matrix. In addition to that, we are going to be doing a whole SDP for both the two properties in the -- sometime in the next 30 to 45 days, March 26, 2026 Page 14 using Greg Orick as the commercial marina contractor to properly reflect the boat rental business operation as well as make sure we're in compliance; however, the day -- that was moved on the January 26th, and on January 26th I submitted for a zoning certification letter. Lance Miller denied it because of the other open Code Enforcement issues. If it was just my Code Enforcement issue, I could keep proceeding to obtain my proper business tax license, but because of the other issues at 3200, the County and Permitting will not allow me to proceed any further until those are resolved, which they are currently taking care of. CHAIRMAN FUENTES: Okay. So what we're going to do here is we've got to make -- we've got to determine whether or not a violation exists. It is great to see that you're working to getting these things completed. Yes, Lee. BOARD MEMBER RUBENSTEIN: No. CHAIRMAN FUENTES: Do you have a question? BOARD MEMBER RUBENSTEIN: No. CHAIRMAN FUENTES: Okay. Do we want to make a motion that a violation exists or doesn't? BOARD MEMBER AYASUN: Yes, I do make a motion that a violation exists. CHAIRMAN FUENTES: Okay. Second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. March 26, 2026 Page 15 So you're taking the required steps to get it corrected. A violation still does exist, and I'm sure that the County here will assist us through that as well. MS. GUTTUM: That is correct, yes. Our recommendation is that the Code Enforcement Board orders the respondent to pay all operational costs in the amount of $59.28 incurred in the prosecution of this case within 30 days, and abate all violations by: Cease the operation of unapproved business and remove associated business items and advertisements within -- from the property within certain amount of days of this hearing, or a fine of a certain dollar amount per day will be imposed until the violation is abated; that the Code Enforcement Board imposes a civil penalty; that the respondent must notify the Code Enforcement Board investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the respondent fails to abate the violation, the County may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this order, and all costs of abatement shall be assessed to the property owner. CHAIRMAN FUENTES: Thank you, Stephanie. So we're going to fill in the blanks here. And, again, you're working on compliance, so we do appreciate that. It looks like you guys know what you're doing, and I'm sorry that the other case is hindering you guys a bit. MR. WOODWARD: And if I may, I don't represent the respondent in this matter. I actually represent his landlord, and so -- and limited -- MS. BUCHILLON: Can you speak into the microphone, Mr. Woodward, please. MR. WOODWARD: I'm sorry. Our firm's recommendation is March 26, 2026 Page 16 limited to the underlying Code Enforcement issue which is preventing him from getting his business tax license. As far as that goes, I did speak with the contractor, who's Ralph Liy, via First Choice Developers, who was also retained to handle this matter as well. This is a two-story structure. On the second floor, it's my understanding one of the units had some interior work done, and I believe, from speaking with him, his understanding is it was some sort of storage unit that was created inside. This will need be permitted. He anticipates having a permit application submitted the end of next week as well. Additionally, in the photographs -- if you could go back to the second one that showed the boat. MR. LETOURNEAU: Stephanie, could you go back to the photograph? MR. WOODWARD: This -- MS. GUTTUM: This one? MR. WOODWARD: The last one you were just on. This structure here with the swing inside of it is also a Code Enforcement issue as well, and that will be removed. So -- but once those two issues are resolved, that Code Enforcement action should be resolved, and the property will be in compliance, and that will allow him to move forward. And all of his ducks are in a row, is my understanding. BOARD MEMBER ELROD: What kind of time frame are you looking for? MR. WOODWARD: As far as the removal, that can be done very quickly because that's just four four-by-fours and a swing. The actual upstairs-unit issue, he anticipates having the permit application submitted either by the end of next week or early next -- the following week. March 26, 2026 Page 17 And then it's just a matter of getting the inspectors on site, having them confirm that everything is to code, and if it's not, getting that area corrected. It's a little bit more difficult with giving you a time frame with an after-the-fact permit because then you have to open up things and take a look at where you stand. So -- but we are moving forward on that as rapidly as possible. CHAIRMAN FUENTES: So he's basically at the hands and the mercy of the landlord. Anybody want to fill in that blank? Can we go back to the recommendation, Stephanie, I'm sorry. MS. GUTTUM: Yep. CHAIRMAN FUENTES: We have the operational costs today of 59.29. MS. BUCHILLON: Twenty-eight. BOARD MEMBER AYASUN: Twenty-eight. CHAIRMAN FUENTES: Twenty-eight. BOARD MEMBER ELROD: What? CHAIRMAN FUENTES: Do you want to make a motion? BOARD MEMBER ELROD: I'm trying to figure out how long that's going to take to get it resolved, and then he has to move forward. MR. FARLANDER: If I may, my process to obtain the commercial business tax receipt, once this is resolved, two to three weeks is what my -- Ellen Summers with Bowman is predicting. CHAIRMAN FUENTES: Yeah, but the problem is it's not based on what you're going to have completed. It's based on the landlord. MR. FARLANDER: Correct. CHAIRMAN FUENTES: So she's trying to figure out how long that would take. BOARD MEMBER ELROD: Three or six months? March 26, 2026 Page 18 MR. WOODWARD: Six months would be preferable. And I'd be happy to provide updates to the Code Enforcement Board officer as to our progress. MR. IANDIMARINO: The County will have no objection to 180 days. CHAIRMAN FUENTES: Okay. BOARD MEMBER ELROD: One hundred and eighty days, and $100 a day after is my motion, plus the ops -- BOARD MEMBER AYASUN: 59.28. BOARD MEMBER ELROD: -- paid in 30. CHAIRMAN FUENTES: So we have a motion for -- to grant you guys 180 days -- corrected -- a hundred -- I'm sorry, $100 per day, and that today's operational costs of 59.28 do need to be paid within 30 days. Do I have a second? BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. MR. FARLANDER: Thank you. CHAIRMAN FUENTES: Thank you. MS. BUCHILLON: ***Next case, under motion for imposition of fines and liens, No. 3, CELU20220010924, Fash Properties, LLC. CHAIRMAN FUENTES: Fash Properties, No. 3? MS. BUCHILLON: Yes, and also No. 4, CELU20210003385. CHAIRMAN FUENTES: Thank you. March 26, 2026 Page 19 THE COURT REPORTER: Do you swear or affirm the testimony you will give will be the truth, the whole truth, and nothing but the truth? MR. MARINOS: I do. MS. ENCALADA: I do. MR. STEWART: I do. MR. HERRERA: I do. MR. ZIEGLER: I do. THE COURT REPORTER: Could I get your names? MS. ENCALADA: Samantha Encalada. MR. STEWART: David Stewart. MR. HERRERA: Michael Herrera. MR. ZIEGLER: David Ziegler. CHAIRMAN FUENTES: Good morning, Charles. MR. MARINOS: Good morning. MS. ENCALADA: Good morning. CHAIRMAN FUENTES: Good morning. MR. MARINOS: We're waiting for it to get on the board. All right. For the record, Investigator Charles Marinos, Collier County Code Enforcement. Past orders: On February 23rd, 2023, the Code Enforcement Board issued a finding of fact, conclusion of law and order. The respondent was found in violation of the referenced ordinances and ordered to correct the violation. See the attached order of the Board, OR6225, Page 1812, for more information. On October 26th, 2023, and September 25th, 2025, the Code Enforcement Board granted a continuance. The violation has not been abated as of March 26th, 2026. Fines have accrued at a rate of $150 per day for the period from August 23rd, 2023, to March 26th, 2026, 947 days, for a total fine amount of $142,050. Fines continue to accrue. March 26, 2026 Page 20 Previously assessed operational costs of $59.35, $59.42, and $59.70 have been paid. The operational costs for today's hearing is $59.84. For a total amount of $142,109.84. CHAIRMAN FUENTES: Thank you. MS. ENCALADA: Good morning. And yes, we do realize we are here still needing to come into compliance. We have, in good faith, taken the steps in order to obtain what is required. First and foremost, just a brief touch upon. Originally this was an SDP that was requested. There was a pre-application meeting which ended up resolving and resulting in an SIP. So my client has continued down that road to obtain the SIP, has submitted. We've been receiving comments back; however, further, there is another unexpected request and comment that was an easement. So we have here today the owner's engineer, Mike Herrera, who can speak further on those items and what has been done in good faith to try and reach compliance. So I'll turn it over to him. MR. IANDIMARINO: Ma'am, it you could, could you state your name for the record. MS. ENCALADA: My apologies. Samantha Encalada. MR. IANDIMARINO: Thank you. MS. ENCALADA: Thank you. MR. HERRERA: Good morning. Michael Herrera, Blue Shore Engineering, licensed surveyor in the state of Florida. So our firm was retained in May of 2025. We attended the pre-application meeting, and it was determined that an SIP was warranted for this property. We had a little bit of a slow start mostly because of surveying. The past project surveyor was nonresponsive. It cost us about six weeks. We hired a new surveyor and immediately obtained the information that we needed for submittal, which had to do with the March 26, 2026 Page 21 property currently does not discharge to the eastern property, which is a South Florida Water Management District canal. At the SIP application, it was discussed but not confirmed that a South Florida Water Management District right-of-way permit would be required because the existing topography of the property was unknown at that time in terms of which way water sheet-flowed. We determined through discussions with Collier County that, in fact, we will be discharging into the South Florida Water Management District canal and, therefore, that brought in another regulatory agency that needs to be part of this application. We are required to obtain, for this property, a Collier County SIP, a South Florida Water Management District waterway permit, and we did submit for a fence waiver. The fence waiver has been approved. We expect -- the South Florida Water Management District and SIP are both currently under review. They were submitted on March 18th, both. We expect -- according to the online portal, Collier County online portal, the SDP permit currently has five reviews. One is approved; four is pending. We only -- the original application had 13 reviews; 11 approved, two rejected. So, really, there's only two possible rejections on this round of comments. We expect the approval, though, on April 9th. So less than a couple weeks away we should have the County permit, but we also need to obtain the South Florida Water Management District permit, which will be our third and final permit. We don't expect that -- unfortunately, the South Florida Water Management District takes 60 days for their final -- thirty days for review, 30 days to issue the permit. So the final review really takes 60 days for that permit to be issued. Once that permit is issued -- we've already been in discussions. We recommended two local contractors to the client to conduct the March 26, 2026 Page 22 work -- to bid the work. One they're visiting today or tomorrow, on site, and the second one will also be providing a bid. So once these permits are obtained, the property owner can start construction immediately, get the certificate of completion, and get the project closed out. CHAIRMAN FUENTES: Okay. MS. ENCALADA: So as you can see, that we have already taken that next step in trying to obtain the contractors who are going to perform the work to get that already set up. So then the green light can be given once the permit is issued. So at this time, we'd be asking for a continuance of 180 days in order to complete everything and come into compliance. CHAIRMAN FUENTES: So I guess my only concern is this case has been open since 2022. And I know we have another case that was opened in 2021. So we're looking at about five years in for two different cases. Me, personally, I'm not too fond of granting a continuance just because of the length of the case. What does the Board think? BOARD MEMBER AYASUN: Are we looking at both cases at the time -- at the same time or separate? CHAIRMAN FUENTES: Separate. MR. NOELL: Separate. BOARD MEMBER AYASUN: Separate. CHAIRMAN FUENTES: So we're currently on No. 3. The case was opened in 2022. First hearing was in -- well, the first issue of finding was in 2023 of February. What does the Board think? BOARD MEMBER ELROD: They've been moving forward, and they've -- there's light at the end of the tunnel. CHAIRMAN FUENTES: That's true. BOARD MEMBER ELROD: And there were a lot of hoops to jump through. March 26, 2026 Page 23 MR. HERRERA: Just a reminder, the SIP expected approval is less than two weeks away. That authorizes construction. CHAIRMAN FUENTES: Question. Why were you retained in 2025 when the case was -- finding of fact was done in 2023? MS. ENCALADA: There was a prior engineer, and my client can speak to the further details on that if you'd like. But they actually did ghost my client, and they were not able to move forward with that engineer, which is why -- Mike Herrera coming in, he has been swiftly moving as fast as he possibly can to make back and forth on these submittals and comments. So he's taken all the good steps and very attentive on this matter. MR. HERRERA: The previous engineer did do substantial work. I have no idea why they didn't finish it. CHAIRMAN FUENTES: I believe Lee here had a question for you guys. BOARD MEMBER AYASUN: Do you have a question? BOARD MEMBER RUBENSTEIN: I've got a -- I think our choices are limited at this point. We either impose the fine, or we give an extension; isn't that correct, Counsel? MR. NOELL: It would be a continuance. BOARD MEMBER RUBENSTEIN: Continuance. So we have a choice of two. BOARD MEMBER ELROD: I'll make a motion to pay the operational costs for today's hearing and give them 180 days. BOARD MEMBER PEREZ: Second. CHAIRMAN FUENTES: All right. We have a second. We've got a motion. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. BOARD MEMBER PEREZ: Aye. March 26, 2026 Page 24 BOARD MEMBER FUENTES: All those opposed? Nay. Okay. Well, I lose. BOARD MEMBER AYASUN: We've got one nay. MS. BUCHILLON: Okay. Just to make clear, 180 days' continuance, plus the ops cost of 59.84 in 30 days for this case? CHAIRMAN FUENTES: To be paid in 30 days, correct. MR. HERRERA: Thank you. BOARD MEMBER AYASUN: One question: Is this business operating now, or is it going to operate after the fact? MR. STEWART: It is operating currently. BOARD MEMBER PEREZ: What size business is this? MR. STEWART: Small to medium. Our main office on the East Coast is larger, but we do small -- BOARD MEMBER PEREZ: Fifty million, 100 million dollar business or -- MR. STEWART: Under 50 million. BOARD MEMBER PEREZ: Under 50 million. MR. STEWART: And not -- and not anywhere near that here in Collier County. MS. ENCALADA: Thank you. CHAIRMAN FUENTES: Thank you. MS. BUCHILLON: ***Now we're on to the next case, CELU20210003385. BOARD MEMBER ELROD: You guys aren't done. That was one case. We have to do them separate. MS. ENCALADA: Apologies. CHAIRMAN FUENTES: I already lost the first one, so I guess we'll make them similar. BOARD MEMBER ELROD: I'll make a motion to do the same thing. March 26, 2026 Page 25 CHAIRMAN FUENTES: Charles has to read this one in real quick. BOARD MEMBER ELROD: Okay, sorry. MR. MARINOS: For the record, Investigator Charles Marinos, Collier County Code Enforcement. Past orders: On February 23rd, 2023, the Code Enforcement Board issued a finding of fact, conclusion of law and order. The respondent was found in violation of the referenced ordinances and ordered to correct the violation. BOARD MEMBER RUBENSTEIN: It's going to set a precedent. MR. MARINOS: See the attached order of the Board, OR6225, Page 1816, for more information. Previously assessed operational costs of $59.35, $59.42, and $59.63 have been paid. The operational costs for today's hearing is $59.77. For a total amount of $142,109.77. CHAIRMAN FUENTES: Okay. Well, would you like Kathleen to make her motion real quick? It would probably be similar to the last one. MS. ENCALADA: That would be great, and all the same comments as the prior one. BOARD MEMBER ELROD: One hundred and eighty days, 59.77 within 30. CHAIRMAN FUENTES: All right. So we have a motion that -- 180 days and that 59.77 to be paid within 30 days. March 26, 2026 Page 26 BOARD MEMBER AYASUN: Second. BOARD MEMBER PEREZ: Second. CHAIRMAN FUENTES: Okay. I have a second as well for that motion. All those in favor? BOARD MEMBER ELROD: Aye. COMMISSIONER AYASUN: Aye. BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? It carries unanimously -- BOARD MEMBER RUBENSTEIN: Nay. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER AYASUN: One nay. CHAIRMAN FUENTES: One nay. 3-2, we still lose. I was just messing with you. No, we're good. The motion carries. You guys passed. Have a good day. MS. ENCALADA: Thank you, as well. MR. STEWART: Thank you. MS. BUCHILLON: ***Next case, we are still under motion for imposition of fines and liens, No. 5, CELU20220004457, Lowe's Home Centers Inc. THE COURT REPORTER: Do you swear or affirm the testimony you will give will be the truth, the whole truth, and nothing but the truth? MS. GUTTUM: I do. MS. THIBAUT: I do. CHAIRMAN FUENTES: Good morning. MS. GUTTUM: For the record, Stephanie Guttum, Collier County Code Enforcement. Past orders: On July 28th, 2022, the Code Enforcement Board issued a findings of fact, conclusions of law and order. The respondent was found in violation of the referenced ordinances and March 26, 2026 Page 27 ordered to correct the violation. See the attached order of the Board, OR6183, PG3971, for more information. BOARD MEMBER RUBENSTEIN: She appeared before the Magistrate. CHAIRMAN FUENTES: No, no. Lee, we can't do that. MS. GUTTUM: On February 23rd, 2023; October 26th, 2023; May 23rd, 2024; September 26th, 2024; May 22nd, 2025; and January 22nd, 2026, the Code Enforcement Board granted a continuance. The violation has not been abated as of March 26th, 2026. Fines and costs to date are as follows: Fines have accrued at a rate of $500 per pay from the period from August 28th, 2022, to March 26th, 2026, 1,307 days, for a total fine amount of $653,500. Fines continue to accrue. Previously assessed civil penalty of $5,000 have been paid. Previously assessed operational costs of $59.28, $59.91, $59.98, $60.26, and $60.47 have been paid. Operational costs for today's hearing is $60.68. Total amount, $653,560.68. CHAIRMAN FUENTES: Okay. MS. THIBAUT: Good morning, Board members. Good to see you. For the record, Amy Thibaut with Roetzel. I know we've come up here before and we've asked for continuances, you know, for several months. Here's where we are: We have the site plan approved. We have the fence permit not only issued but also closed out; the work has been done. The primary issue that we have at the moment is a large mulch delivery that is currently not located in one of these storage areas. I don't know exactly how long it's going to take to get it moved all into a storage area, but what I'm before you asking today is a continuance of one month. Ideally, I mean, we would have come before you today and this March 26, 2026 Page 28 would have been abated, but this large delivery has thrown a wrench in the plans. For context, I interface with corporate. Corporate then interfaces with the store. I don't interface with the store. I don't have contact with them. So I know that they're working with -- corporate is working with the local store to figure out just exactly how long it's going to take to get all of that moved, but my hunch is that it will take less than a month, and we can come back here in a month and get this wrapped up. That is my -- what I have been told. BOARD MEMBER RUBENSTEIN: Question. I have a question. I notice you recently appeared before the Magistrate. MS. THIBAUT: I did. BOARD MEMBER RUBENSTEIN: Was that in regards to this? MS. THIBAUT: It was not. It was in regards to an entirely different property use. BOARD MEMBER RUBENSTEIN: Was it the other Lowe's? MS. THIBAUT: It was an -- it's an agricultural property, so it's a different property owner and -- BOARD MEMBER RUBENSTEIN: Okay. MS. THIBAUT: Yeah, yeah. BOARD MEMBER RUBENSTEIN: Okay. Thank you. BOARD MEMBER ELROD: I'll make a motion to grant the 30 days and pay today's operational costs within 30 days. CHAIRMAN FUENTES: So you have a motion to grant the extra month. BOARD MEMBER RUBENSTEIN: Second. BOARD MEMBER PEREZ: Do we want to give them an extension? I mean, to me, it seems clear, deny the extension and have them pay the $653,000. CHAIRMAN FUENTES: I'm not a fan of granting the March 26, 2026 Page 29 extension only because we've been here so many times. BOARD MEMBER PEREZ: Yeah. CHAIRMAN FUENTES: And in the beginning with Lowe's, we didn't have a representative here. We actually had a few hurdles. BOARD MEMBER PEREZ: This is a management issue, clearly. CHAIRMAN FUENTES: We do have one motion. So we can deny this one if we want. We can rule against it, and let's just proceed. We did get a second. So all those in favor for the motion here? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. Second. BOARD MEMBER FUENTES: All those opposed? COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: Aye. BOARD MEMBER PEREZ: Aye. CHAIRMAN FUENTES: So that's 3-2 [sic]. It does not carry. You are more than welcome to make a motion. BOARD MEMBER PEREZ: Yeah. I make a motion to impose the fine, and they pay the fine for $653,500. That's it, end of story. They're done. CHAIRMAN FUENTES: We have a motion to impose the fines. All those in favor? THE COURT REPORTER: You don't have a second. BOARD MEMBER AYASUN: There's no second. CHAIRMAN FUENTES: I'm so sorry. I second it. I will second the motion. All those in favor? COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: Aye. BOARD MEMBER PEREZ: Aye. BOARD MEMBER RUBENSTEIN: Nay. March 26, 2026 Page 30 BOARD MEMBER ELROD: Nay. CHAIRMAN FUENTES: So -- and, Tarik, you said "aye"? BOARD MEMBER AYASUN: Aye. CHAIRMAN FUENTES: So it is 3-2. BOARD MEMBER PEREZ: That's it. MS. THIBAUT: Thank you, Board members. CHAIRMAN FUENTES: No problem. Take care, ma'am. MS. THIBAUT: You, too. MS. BUCHILLON: ***Next case, we are still under motion for imposition of fines and liens. The respondent was found in violation of referenced ordinance and ordered to correct the violation. See the attached order of the Board, OR6307, Page 3324, and for -- for more information. March 26, 2026 Page 31 On April 25th and January 22nd, 2026, the Code Enforcement Board granted a continuance. The violation has been abated as of March 20th of 2026. Fines and costs to date are as follows: The fines have accrued at the rate of $200 per day from the period of February 24th, 2024, to March 20th of 2026, 756 days, for the total fine amount of $151,200. Previous assessed operational costs of $59.28 and $59.42 and $59.63 have been paid. Operational costs for today's hearing are $59.77. The total amount, $151,259.77. The gravity of the violation is not health and safety. Any actions taken by the violator to correct: Acquired Permit PRCS20241248982 are CO'ed. Their completion issued on March 20th of 2026. A previous violation committed by the respondent in violator case CESD20230006054 injuncted [sic] on 8/22 of 2024 by the Code Enforcement Board. Any other relevant factors: Nothing. CHAIRMAN FUENTES: Thank you so much. Before you guys give me your side real quick, I have a question. Was this a property you guys inherited as a problem, or was this work done by the current respondents here in front of us? MR. CONA: Well, this was -- well, sort of a combination of both. Some work was done without a permit by the tenant. Some of the work was -- some of the issues were due to the fact that the property was an older property, and the County did not have any records of any improvements made to this property over the last, say, 20 to 30 years. So some of the -- so the initial code violation was as a result of the unpermitted work, and that sort of opened up the door to several other violations that were inherited by the tenant for prior work over the last 30 years. March 26, 2026 Page 32 CHAIRMAN FUENTES: So I wanted to thank you for coming into compliance. We always do seek that. Let me take a look here real quick. I would like to make a motion. BOARD MEMBER AYASUN: Go ahead. CHAIRMAN FUENTES: I would like to make a motion that today's operational costs of $59.77 do get paid within 30 days, and I will reduce the County's fines to $900. So instead of 151,000, blah, blah, blah, we'll come down to 900. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: We do have a second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: Aye. BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. Thank you. Again, that's 59.77 to be paid. That's separate from the 900, okay? MR. CONA: Okay. CHAIRMAN FUENTES: Okay. Thank you. MR. CONA: All right, thank you. MR. NGUYEN: Thank you. CHAIRMAN FUENTES: Good morning, Helen. MS. BUCHILLON: Hi. BOARD MEMBER AYASUN: Did Helen prosecute this case? The garage is already put back into a garage. I just didn't know I had to get a demolition permit, which they just granted it. So I just need an inspector to go out. I had a little bit of delay because I had a pacemaker put in this January, so... CHAIRMAN FUENTES: You okay with this, Dee? MS. PULSE: So she's requesting an extension of time. She was a couple of days behind the court-ordered compliance date to request that, but she had these medical issues in and out of the hospital for her heart, and so she's requesting an extension of time from the previous court-ordered date. CHAIRMAN FUENTES: Okay. Ms. Garcia -- MS. PULSE: And she does have a permit ready to be issued. CHAIRMAN FUENTES: Perfect. MS. PULSE: All she needs is four final inspections to get that March 26, 2026 Page 47 all completed. MS. GARCIA: Right. Just to get it closed. CHAIRMAN FUENTES: How much time do you think you need, Ms. Garcia? MS. GARCIA: I think it depends on how long it takes them to come out and just look at what's been done. So 60 days maybe. I say less than that, but just to be on the safe side. CHAIRMAN FUENTES: You think 60, maybe 90? What do you think? MS. PULSE: I think 60 should be fine. MS. GARCIA: Yeah. Because everything's done. It's just them coming out to look at it. CHAIRMAN FUENTES: Okay. Do we have an operational costs that you can give me, Helen? MS. BUCHILLON: 59.77. CHAIRMAN FUENTES: Okay. I'm going to make a motion. RODRIGUEZ: I have been working on certificates that I need. Got my agriculture exemption. Got my nursery certificate. I just submitted my zoning certificate, so it's going through the process. MR. OWEN: So, Chairman, he bought a property that, unfortunately, was used as a hurricane vegetative debris dump site. CHAIRMAN FUENTES: He bought it that way? MR. OWEN: Yes. CHAIRMAN FUENTES: Sounds fun. MR. OWEN: Unfortunately, he wasn't aware of County ordinances and the violation. So he has been working on it. He has a shredding machine on site. He got a failure with that. Parts are March 26, 2026 Page 49 coming. So he has been working on it. I've been out there. We've gone over, you know, what the expectations are. So clear expectations. He knows what he needs to do. He's working on it. So the County does not have any problem with giving him an extension. CHAIRMAN FUENTES: How much time do you think he needs? MR. OWEN: A good amount. CHAIRMAN FUENTES: What's that mean? Are we talking 90, 180? MR. OWEN: Hundred and eighty. CHAIRMAN FUENTES: Hundred and eighty. All right. CHAIRMAN FUENTES: Are you saying they're going to remove it? MR. LOUIS: Yes. MS. LAWRENCE: If I might clear it up a little bit. CHAIRMAN FUENTES: Yes. MS. LAWRENCE: I talked with Mr. Johnson yesterday. And he had a conversation with GMD, and they discussed his options as far as getting it permitted. And he decided that there were no options that he felt were going to be good for him, so they're going to have it removed, and he has a contractor scheduled to have it removed Monday. CHAIRMAN FUENTES: Paula, this was just done yesterday? MS. LAWRENCE: Yes. CHAIRMAN FUENTES: Just yesterday? MS. BOARD MEMBER AYASUN: Do they need the demolition permit? CHAIRMAN FUENTES: Yeah. Damn. A hundred and eighty days, too, is what we granted. It's a long one. MS. LAWRENCE: Right. We're just like -- they expect it to be completed and finaled on Monday. We're just asking -- we're just suggesting a 30-day extension just so that we can make sure everything is closed up properly. Folio 37169520009. Notice of violation was given on January 5th, 2026. This case was opened in November of 2025 for failure to submit the PUD monitoring report. Complainant was the County; i.e., we need these documents in order to monitor these things. March 26, 2026 Page 57 An email was sent to the previous company that had submitted the PUD for 2024. Several weeks had gone by without any response, so notice of violation was prepared and issued on January 5th. Reinspection in February found no PUD monitoring report had been submitted. The case was prepared for a hearing. As of March 25th, 2026, the property still has not submitted their PUD monitoring report. CHAIRMAN FUENTES: And no communication? MR. OWEN: No communication. CHAIRMAN FUENTES: Okay. Yeah, I mean, tell them I said okay. All right. So we've got a motion a violation exists. What are the recommendations? Let's get to that. We're going to make sure that they catch up very quickly here in a second. MR. If the respondent fails to abate the violation, the County may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this order, and all costs of abatement shall be assessed to the property owner. CHAIRMAN FUENTES: So I hate -- the fact that the regional manager or district manager reached out to you means that he's aware of it, and he has no Craig -- I'm sorry -- Brian. I hate that. The fact that the investigators have no communication. They haven't bothered March 26, 2026 Page 59 to reach out to him. I'm going to make the motion. I want to see something within 30 days. I have -- if not, I'm going to do a $1,000 per day that will be imposed on the property, and I'm going to make that motion. BOARD MEMBER PEREZ: Second. CHAIRMAN FUENTES: Wait. Operational costs, Helen? MS. BUCHILLON: 59.28. CHAIRMAN FUENTES: 59.28 to be paid within five days. I want that to be paid within five days. That's my motion. Do I have a second? Whatever it is, they're aware. MR. LETOURNEAU: For the record, Jeff Letourneau, Collier County Code Enforcement. I'm looking at Statute 162 right now, and it does say, "A fine imposed pursuant to this section shall not exceed $250 per day for the first violation and shall not exceed $500 per day for a repeat violation." THE COURT REPORTER: And your name? MR. ESPINOSA: Robert Espinosa. CHAIRMAN FUENTES: Good morning. Go ahead, Brian. MR. OWEN: All right. For the record, Brian Owen, Collier County Code Enforcement. This is in reference to Case No. CESD20 -- sorry -- 20250005359 dealing with violations of Collier County Land Development Code as amended, Section 10.02.06(B)(1)(a), Section 10.02.06(B)(1)(e), and 10 -- Section 10.02.06(B)(1)(e)(i), metal building built under Permit PRCP20250835308. Permit is in rejected status with no valid inspections or certification of completion. Location of violation is at 742 4th Street Northeast, Naples, Florida 34120. Folio 37286360003. Service was given on November 18th of 2025. Case CESD202500005359 was opened on May 2nd of 2025 for a complaint for an occupied trailer and metal building with no permit. Investigator Robertson attempted several contacts at the property. He finally met with the property owner in June of 2025. He observed travel trailer with no septic, water hooked up, and no signs of being occupied. The property owner, Robert, agreed to get the vehicle registered March 26, 2026 Page 62 in the next coming weeks. When asked about the metal building structure, he indicated it was permitted by the previous owner. Reinspection in July found Permit PRCP20250731130 had been applied for to permit the metal building/structure. Valid registration for the trailers were provided in August 2025. Permit PRCP20250835308 is under review as of August of 2025. In November, the permit remained in rejected status for over two months. Notice was prepared and served on November 18th of 2025. Additional checks of the permit found no change in status. Case was prepared for a hearing in February of 2026. During prehearing inspection on March 25th, 2026, the metal building remains on the property and Permit PRCP25 -- 20250835308 is in issued status with an expira- -- I'm sorry -- issued as of the 16th of March. I have the following exhibits: One photo taken by Investigator Robertson on June 17th of 2025. Photos are on a joint drive I have access to; one deed proving ownership; and two photos taken on March 25th, 2026, showing the building's still on the property. CHAIRMAN FUENTES: Okay. Has the respondent seen those photos? MR. OWEN: Yes, sir, he has. CHAIRMAN FUENTES: Do you have any objection to see those photos being presented? MR. ESPINOSA: No. CHAIRMAN FUENTES: All right. Can I get a motion to accept the photos? BOARD MEMBER ELROD: Motion to accept the photos. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: We've got a motion and second. All those in favor? March 26, 2026 Page 63 BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: Opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. MR. OWEN: This was Investigator Robertson's photo taken in June 2025 showing the metal building is, in fact, on location. Then I was able to observe it from legal vantage due to the property was fenced in with the gate closed, so that it is one side of the property, and there it is from the back side showing it is still, in fact, on the property. CHAIRMAN FUENTES: Okay. What was the reason for the permit to be pulled on March 16th? MR. ESPINOSA: Well, good morning. I bought the property with the shed in there. And I'm a contractor as well. I've been -- I'm so busy, and I hire a company to handle the permitting process for me, and they didn't run [sic]. And so I ended up going to the County and explaining -- giving me a reason to why the permit was rejected. And they want me to do a variance hearing for it, but the inspector, whoever came in first, they thought that I build the permit -- I mean, built the shed, so they wanted to do, like, a Code Enforcement -- a code case for my license. And so I ended up to talk to the building officer, "Hey, I didn't do it." So they look at the proof. So they look in the records, and they ended up the -- previous owner built it in 2021. So I filed the final requirements for them, and they approved the permit for last week. CHAIRMAN FUENTES: Unfortunately, sometimes when you March 26, 2026 Page 64 buy a property, if a violation does exist, it does fall on the new owner. MR. ESPINOSA: Yeah. CHAIRMAN FUENTES: I know that maybe you weren't aware. Is he going to need a variance? Is that what they're basically saying at this time? MR. OWEN: No. So with that permit issued, they would have made the decision if a variance was needed. They wouldn't have issued that permit if a variance was required. CHAIRMAN FUENTES: Good. Okay. MR. ESPINOSA: The permit has been issued, so -- CHAIRMAN FUENTES: Okay. MR. ESPINOSA: -- I have to just call the inspections. CHAIRMAN FUENTES: Okay. Well, a violation does exist. We'll make a motion on that here, and then we're going to get the recommendation from the County to see how many days we can give you. Again, we understand that you bought it this way, so we'll try to work with you, I'm sure. But we do like compliance. So if I can get a motion. BOARD MEMBER ELROD: A motion the violation does exist. Recommendation: That the Code March 26, 2026 Page 65 Enforcement Board orders the respondent to pay all operational costs in the amount of 59.28 incurred in the prosecution of this case within 30 days and abate all violations by: One, obtaining all required Collier County building permits or demolition permits, inspections, and certificate of completion/occupancy for the metal building within blank days of this hearing, or a fine of blank dollars per day will be imposed until the violation is abated; Two, shut off all unpermitted electrical power sources to the unpermitted building -- metal building, and it is to remain off until such work is addressed with a valid building or demolition permit and related inspection within blank days of this hearing, or a fine of blank dollars per day will be imposed until the violation is abated; Three, the respondent must notify the Code Enforcement investigator when the violation has been abated in order to conduct the final inspection to confirm abatement. If the respondent fails to abate the violation, the County may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this order, and all costs of abatement will be assessed to the property owner. CHAIRMAN FUENTES: All right. Thank you, Brian. BOARD MEMBER ELROD: So the permit's been issued, and you just need final inspections? CHAIRMAN FUENTES: Well, he's going to have to go through the whole process. It just got issued. MR. ESPINOSA: Well, I just need to call for inspections and maybe have to do some -- BOARD MEMBER ELROD: Revisions? MR. ESPINOSA: No, no. It's all approved, so it -- maybe they ask me to do some gutters, maybe, I'm not sure about yet. So I just March 26, 2026 Page 66 wait for inspections, and whatever they want me to do, I will do it. CHAIRMAN FUENTES: The only part of this one that's a bit serious for us that we consider health and safety is the fact that it has electrical that's unpermitted. MR. ESPINOSA: Okay. CHAIRMAN FUENTES: So that part, No. 2, we're probably going to end up having to give you a shorter amount of days with a higher day per amount [sic] just to make sure you comply with us regarding the power usage. And we understand that you're working on everything else. What are you guys thinking? This is you. BOARD MEMBER ELROD: Ninety days? MR. ESPINOSA: Yeah. BOARD MEMBER ELROD: Three months; you think you can get it done in three months? MR. ESPINOSA: Yeah. I already got the permit, so that's fine. CHAIRMAN FUENTES: Okay. MS. BUCHILLON: That's No. 1? CHAIRMAN FUENTES: Number 1, 90 days. BOARD MEMBER AYASUN: The electrical, less time. MS. BUCHILLON: And how -- fine. BOARD MEMBER ELROD: Hundred dollars a day. CHAIRMAN FUENTES: Hundred dollars a day for No. 1. BOARD MEMBER ELROD: And the second one, all you've got to do is flip a breaker, so seven days, and $200 a day. CHAIRMAN FUENTES: The motion would be for No. 1 that you are granted 90 days; if not, $100 per day would be imposed. For No. 2, they're going to give you seven days to turn off the power; if not, $200 per day would be imposed. You do need to pay today's operational costs of 59.28. MR. ESPINOSA: Okay. March 26, 2026 Page 67 BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: That's her motion. We have a second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. CHAIRMAN FUENTES: Good morning, sir. What's going on with this property? The case has been open since 2024. MR. SPINATTO: I'm sorry. My English is not the best, but I will try to do. CHAIRMAN FUENTES: Okay. MR. SPINATTO: I was working on that property. First of all, I'm doing, right now, in all things. I have inspection last week. Today I need to request the reinspection for the gazebo, for example. And I was working in all things, but I spent a lot of money resolving these problems. My economical situation is not the best, not the last years, not this years. I'm Realtor, and the sales are very bad. And it was for money, the reason. Please, I know I have to complete all this. And I need 120 more days to complete everything. I'm getting a bank loan to get the money for complete all this stuff. BOARD MEMBER AYASUN: Is anybody living in this unit? MR. SPINATTO: No, it's empty because I need to resolve everything first. And I'm paying a mortgage for that house, too. BOARD MEMBER RUBENSTEIN: Do you have an active March 26, 2026 Page 69 permit? MR. There's several structures that were unpermitted on this property. He has -- there was also living in units, and that's all been done away with. There's two active permits right now, and one permit is "ready to be issued" status. So he did get a passing inspection on one of the permits. I believe it was the gazebo with the screen room. MR. SPINATTO: Yes. MS. PULSE: Just had a passing inspection, so -- MR. SPINATTO: All the issues, I have the approval for all things. I'm doing -- I'm working now in inspection and prepare all the condition, but all issues has been approved for the County. CHAIRMAN FUENTES: Good communication? MS. PULSE: Yes, yes. I recently had the case put into my name, and he's been very communicative with me, yes. CHAIRMAN FUENTES: Would the County be opposed to 120? Is that too long? Should we look somewhere between 90? MR. LETOURNEAU: No, 120 sounds reasonable. The only reason that we kind of brought it back at this time was there was a stalling in the permit process, and I felt that this time we'd bring it back for imposition, but it seems like he had some financial issues and is working towards taking care of it at this point, so we're not March 26, 2026 Page 70 opposed to 120 days. CHAIRMAN FUENTES: Okay. It would probably be really good if you did get it done within the 120. MR. SPINATTO: Yes. CHAIRMAN FUENTES: Because I don't -- I don't think that we'd be able to give you another -- MR. SPINATTO: No, no, no. CHAIRMAN FUENTES: This would probably be it. MR. Why am I fined if you won't let me do it because of the other thing that he did also? He ripped the trees out also. So everything that had to do with this whole situation had to do with one person who robbed me, and I shouldn't be fined for it. So what's going on with this case here? Typically we don't really -- $100 per day seems like we were trying to work with you March 26, 2026 Page 85 guys. If not, we would have gone higher. What's going on with the case? MR. LOPES: So basically, I was helping my father with all of this. I moved out. And obviously, my fault. I totally forgot to check his mails and everything, so it's my fault. We already issued the permit, and we just need to set up an appointment for an inspector. That's it. So I would like to request an extension for 60 days. CHAIRMAN FUENTES: I think it would be a continuation, correct? Yeah, so. Charles, where is that permit at currently? I don't want to hear the case. I just want to -- MR. MARINOS: So -- yeah, just speak briefly. So it's a case about a right-of-way. They live on 15th Avenue. They had a second right-of-way open onto Green Boulevard. That second right-of-way, they put a permit in for it. It was denied. They have since put a new permit in to restore the right-of-way to its previous condition. It has been restored to its previous condition, but in conjunction they put the repair of their front culvert in with that same permit. So because the front culvert is not done, the permit is not closed. He did -- I did reinspect and find the swale's been returned to its previous condition. The gate is closed and locked. So they're no longer using the Green Boulevard right-of-way access. CHAIRMAN FUENTES: Okay. They're still working at it. Yeah, we can give some time. How much time do you guys think you need then? MR. LOPES: I will say 60 days just to be on the safe side. CHAIRMAN FUENTES: Those fines are going to continue to accrue at this point, so it's not an extension. It's going to be a continuance, okay? MR. LOPES: Yes. March 26, 2026 Page 86 CHAIRMAN FUENTES: I'll make a motion that we go ahead and grant you a continuance of 60 days; however, today's operational costs of 59.49 do get paid within 30 days, okay? MR. LOPES: Okay. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: I have a motion and a second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: Aye. BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. Thank you. MR. DeSILVA: Thank you. Thank you. Have a good day. BOARD MEMBER AYASUN: Good day. MS. BUCHILLON: ***Number 16, CESD20250006441, Olszewski Revocable Trust. THE COURT REPORTER: What is your name? MR. OLSZEWSKI: Edward Olszewski. THE COURT REPORTER: Do you swear or affirm the testimony you will give will be the truth, the whole truth, and nothing but the truth? MR. MARINOS: I do. MR. OLSZEWSKI: I do. MR. MARINOS: For the record, Investigator Charles Marinos, Collier County Code Enforcement. Past orders: On August 28th, 2025, Code Enforcement Board issued a finding of fact, conclusion of law and order. The respondent was found in violation of the referenced ordinances and ordered to March 26, 2026 Page 87 correct the violation. See the attached order of the Board, OR6509, Page 1101, for more information. The violation has not been abated as of March 26th, 2026. Part 1, fines have accrued at a rate of $200 per day for the period of December 27th, 2025, to March 26th, 2026, 90 days, for a total fine amount of $18,000. Fines continue to accrue. Part 2 was abated by September 4th, 2025, within the compliance deadline. Previously assessed operational costs of $59.28 have been paid. The operational costs for today's hearing is $59.56, for a total amount of $18,059.56. CHAIRMAN FUENTES: Thank you. MR. OLSZEWSKI: Good morning. It's taken a long time to get to this point. I finally got the Notice of Commencement on March 23rd, and I have the approval of construction documents and the building plan review and inspection. It's all set. It took a long time to get to this point. When I purchased the property, the Realtor was looking for a guesthouse for me, and it was a foreclosure at the time. And the listing shows guesthouse living area. We looked at it. We decided to buy it, and it was a foreclosure. The bank gave me a mortgage, and the owners that were there before ripped a lot of stuff out. They took the air-conditioners. And I was unaware that it wasn't permitted. And we had a towing company, A to Z Towing & Recovery, and we needed a place for the tow truck drivers to live because of some of them won't work down in Naples unless they have a place. So we purchased it. And from there on, they were living there until Rick passed away, and I told the tow truck driver he has to leave. Well, that caused a problem. I guess he got upset, and evidently March 26, 2026 Page 88 he went into Collier County listing and found out that it was never approved, which I never knew. So when I met with the Code Enforcement guy, I said, "Well, I'll bring up to date whatever I have to do." And the person left. And no one's living there. Everything is shut off. So we started the process. And it's hard to find some people to, you know, do this. And I'm working with a contractor. He's very nice, very good. And I found out later that Collier County won't approve it as a guesthouse because it was 900 square feet, and Collier County has a stipulation that it cannot be more than 40 percent of my current square footage, which would have made it 750 square feet. So I said, "Oh, what I am going to do?" And eventually, we talked with Collier County, and they said they will do it as a mother-in-law suite. They will allow me to enclose the breeze way, which is what I'm in the process of. So I had the architect -- when he initially did the drawing, it was for the guesthouse portion, which showed 900 square feet. Then I had to get them back to redo the breezeway design. They were on vacation and out of the country, so that was another delay. That was finally done, and it was submitted to Collier County. CHAIRMAN FUENTES: Let's do this. Not to interrupt you in a rude way or anything. MR. OLSZEWSKI: Yeah. But I finally got everything. CHAIRMAN FUENTES: Okay. MR. OLSZEWSKI: It's frustrating. CHAIRMAN FUENTES: How much time do you think you need? MR. OLSZEWSKI: If this continues -- and I'm worried about hurricanes. I'm saying, well, 180 days, but I -- you know, I'm afraid if I go over that, I'll be back here again. March 26, 2026 Page 89 CHAIRMAN FUENTES: So this whole case because a grown man was told that he had to relocate? MR. MARINOS: Essentially. That was the complaint. CHAIRMAN FUENTES: Okay. MR. OLSZEWSKI: Yeah, I know. CHAIRMAN FUENTES: I'm probably going to ask the County first to see how they feel about that much time. MR. LETOURNEAU: What do you think, Chuck? MR. MARINOS: So the permit is issued. The guesthouse is likely to -- well, the guesthouse. Excuse me, the mother-in-law suite at this point is likely to pass. It's fairly simple. The construction does not seem to be inappropriate, but they do have to enclose the breezeway, which is a new construction, essentially. We know how the permitting process can take -- can go from there, so it's up to you guys, obviously, ultimately. MR. OLSZEWSKI: I also have Earthworks. I have to redesign the septic. So they have $5,000 already. The design phase was approved. And I owe them 15,000 more. So that's all set to go. BOARD MEMBER ELROD: I'll make a motion to grant him the 180 days' continuance and pay the operational costs of 59.56 in 30 days. MR. OLSZEWSKI: Yes. BOARD MEMBER PEREZ: Second. MR. LETOURNEAU: We're okay with that. CHAIRMAN FUENTES: Okay. We have a motion, and we have a second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: Aye. BOARD MEMBER PEREZ: Aye. March 26, 2026 Page 90 BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. MR. OLSZEWSKI: Okay. The fines, do -- I owe them? CHAIRMAN FUENTES: Well, you've got to correct the violation first. There will be a time where we will come back and we will discuss those fines. As of right now, this is a continuance. It's not an extension. So those fines continue to accrue. MR. OLSZEWSKI: Okay. All right. CHAIRMAN FUENTES: You have to pay the operational costs for today within 30 days. MR. OLSZEWSKI: Yes, right. CHAIRMAN FUENTES: And hopefully, you know, you get this done -- hey, if you can finish it before the 180 and you can come before us and you can parade that and say, "Hey, I did it before the 180"... MR. OLSZEWSKI: That's my fear. CHAIRMAN FUENTES: Yeah, we love that if you can. If not, just, you know -- MR. OLSZEWSKI: I'm all set to go. CHAIRMAN FUENTES: -- talk to Charles, and let's see what we can do. MR. OLSZEWSKI: Okay. CHAIRMAN FUENTES: Thank you, sir. MR. OLSZEWSKI: Thank you. Okay. MS. BUCHILLON: ***Next, we are back up under hearings, No. 2, CESD20240009549, Jeannite Antoine. And the respondent's not present, so for the record, respondent was notified regular and certified mail March 11, 2026, and it was also posted at the property and courthouse March 12, 2026. THE COURT REPORTER: Do you swear or affirm the March 26, 2026 Page 91 testimony you will give will be the truth, the whole truth, and nothing but the truth? MR. KITTS: Hi, I do. Good morning. For the record, Investigator Ryan Kitts, Collier County Code Enforcement. This is in reference to Case No. CESD20240009549 dealing with the violation of Collier County Land Development Code 04-1 [sic], as amended, Sections 10.02.06(B)(1)(a), 10.02.06(B)(1)(e), and 10.02.06(B)(1)(e)(i). The violation consists of repair work performed to fire-damaged portions of the structure, including the roof and soffit, as well as the replacement of a window without first obtaining the required Collier County building permit and completion with necessary inspections through issuance of a certificate of completion or occupancy located at 118 Dixie Avenue West, Immokalee Road, Florida 34142. Folio No. 8784005 -- sorry. Folio No. 87840005. Service was given on November 5th, 2024, with a notice of violation signed by the respondent, and the notice of violation also certified and regular mail to the respondent's listed address. This case originated from a property maintenance complaint opened on November 21st, 2023, following fire damage to the residence. The respondent subsequently retained MTC General Contractor, LLC, to perform the reroofing work. Permit No. PRFH20240310119 was applied for on March 18th, 2024. Permit was issued November 15th, 2024, and ultimately expired on August 11th, 2025. To date, no inspections have been conducted under this permit. Additionally, there are outstanding inspection holds requiring the addition of an electrical subcontractor and submission of a permit revision. I assumed responsibility of this case in February 4th, 2026, at March 26, 2026 Page 92 which time I conducted a comprehensive review of this case history and confirmed that the permit remains expired with no change in status. Multiple attempts have been made to contact both the respondent and the contractor; however, those efforts have been unsuccessful. Given that no recent actions have been taken to bring the property into compliance, this case was prepared for hearing before the Code Enforcement Board. I would now like to present case evidence in the following exhibits: Two photos taken by Senior Investigator Sherry Patterson on the November 21st, 2023; six photos taken by former Property Maintenance Investigator Steve Athey on February 6th, 2024, stored on a shared drive that I have access to; one determination by Deputy Building Official Doug Sposito, stating a permit's required, on November 15th, 2024; one notice of violation signed by the respondent on November 18th, 2024; and a screenshot from the Collier County public portal showing the current status of the permit taken during my pre-inspection yesterday, March 25th, 2026. CHAIRMAN FUENTES: I will make a motion to accept the photos. BOARD MEMBER ELROD: Second. CHAIRMAN FUENTES: We've got a second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) March 26, 2026 Page 93 CHAIRMAN FUENTES: It carries unanimously. All right. Let's see the photos. Before we make a motion -- Kevin, before we make a motion to -- whether a violation exists or not, can we just go straight into the recommendations by the County? MR. NOELL: I would keep it the same with finding the violation. CHAIRMAN FUENTES: Okay. MR. KITTS: These photos are just showing the damage from the fire. This is showing the work that was beginning to take place, and the window that was replaced, and the soffit work. This is the current status of the permit. It is showing that it was issued, and the expiration date was 8/11 -- sorry, August 11, 2025. CHAIRMAN FUENTES: And since then, nothing else has been done? MR. KITTS: Correct. CHAIRMAN FUENTES: Okay. MR. KITTS: And this was taken yesterday during my prehearing inspection, this screenshot. CHAIRMAN FUENTES: Perfect. I would like to make a motion a violation exists. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: All those in -- I've got a second, a motion. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: (No verbal response.) BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: Opposed? (No response.) March 26, 2026 Page 94 CHAIRMAN FUENTES: It carries unanimously. If you can give me your recommendation. MR. KITTS: Yes, sir. CHAIRMAN FUENTES: I can't believe they didn't come. MR. KITTS: I tried multiple times to get hold of anybody that I can. CHAIRMAN FUENTES: You come across as very professional. I'm sure you did. MR. KITTS: Our recommendation is that Code Enforcement Board orders the respondent to pay all operational costs in the amount of $59.28 incurred in the prosecution of this case within 30 days of this, and abate all violations by: Number 1, obtaining all required Collier County building permits or demolition permits, inspections, and certificate of completion/occupancy for unpermitted roof repair and window replacement within blank days of this hearing, or a fine of blank per -- dollars per day will be imposed until the violation is abated; Number 2, the respondent must notify the Collier County Code investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. If the respondent fails to abate the violation, the County may abate the violation using any method to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office to enforce the provisions of this order, and all costs of abatement shall be assessed to the property owner. CHAIRMAN FUENTES: Has there been a prior case for site development on this property -- or folio? If not, I'm going to be limited, I guess, Jeff, to, what, 250? Because you're going to cap me again. MR. LETOURNEAU: I'm not capping you, sir. It's the Florida Statute, yeah. CHAIRMAN FUENTES: Is there another case? March 26, 2026 Page 95 MR. KITTS: I don't believe there was. I think this was just the original -- I think this was the first time they've had an issue. It was a property maintenance case, which they apparently resolved that, but then they created work without obtaining a permit, and that's what generated this case. So it was a property maintenance case. CHAIRMAN FUENTES: Oh. MR. LETOURNEAU: Yeah, but no pre -- I don't think it's a repeat. MR. KITTS: No, prev- -- it's not a repeat, I don't believe. CHAIRMAN FUENTES: Whose side are you guys on? BOARD MEMBER ELROD: Mine. CHAIRMAN FUENTES: My gosh, okay. Well, what are -- the operational costs are 59.28. All right. We want the operational costs to be paid within 30 days. You probably won't get that. We're going to give them 30 days as well to come into compliance. If not, a fine for the maximum amount of $250 will be imposed per day. That is my motion. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: I have a second. All those in favor? BOARD MEMBER ELROD: Aye. BOARD MEMBER RUBENSTEIN: Aye. COMMISSIONER AYASUN: Aye. CHAIRMAN FUENTES: Aye. BOARD MEMBER PEREZ: Aye. BOARD MEMBER FUENTES: All those opposed? (No response.) CHAIRMAN FUENTES: It carries unanimously. MR. KITTS: Thank you. CHAIRMAN FUENTES: No, thank you. MS. BUCHILLON: ***Next case, No. 5, CEPF20250002409, Julio C. Rodriguez and Lissette P. Rodriguez. Folio 37011940009. Service was given on March 18th, 2025. This case originated as a referral. On 12 March 2025, Senior Investigator Brian Owen made contact with the property owner, Ms. Rodriguez, and informed her of two expired permits on site for a pool and pool barrier. She stated that she would contact the contractor and have them take care of the issue. On 18 March 2025, Senior Investigator Owen noted no changes March 26, 2026 Page 97 to the permit status and issued a notice of violation. On the 14th of August 2025, Permit PRAS20230518447 for the pool cage was finalized. Since that time, Permit PRSPL20230206888 has been through multiple status changes but expired again on 05 October 2025. That permit is contingent on VRPPL20230004918, which has seen no activity since 11 April 2023. As of 25 March 2026, the violation remains. CHAIRMAN FUENTES: Okay. MR. MARINOS: I would now like to present case evidence in the following exhibits: Three screenshots of current permit status items and one letter showing VRP deficiencies. All the inspections are done. They have one open condition. That condition is this: Environmental services CO hold pending issuance of vegetation removal permit and installation of any restoration plantings it required. March 26, 2026 Page 98 It appears that when this came to light, the work just stopped on getting the final permit completed. CHAIRMAN FUENTES: Okay. MR. MARINOS: This is the VRP. Date entered 3/14/2023. They got an incomplete submission letter, and then nothing was ever turned in after that point. These -- CHAIRMAN FUENTES: All right. Can I get a motion -- you have something else? Sorry. MR. MARINOS: Yes. This is -- this is the incomplete submittal letter speaking to the deficiencies of what needed to be done to get that VRP in good status. CHAIRMAN FUENTES: Okay. If I could get a motion that a violation exists. BOARD MEMBER ELROD: I'll make a motion a violation exists. BOARD MEMBER AYASUN: Second. CHAIRMAN FUENTES: All those in favor? BOARD MEMBER ELROD: Aye.
