DRAINAGE EASEMENT
THIS DRAINAGE EASEMENT ("BCCA Easement") is granted and conveyed
this Z7 day of /mod ,2026,by BAY COLONY COMMUNITY ASSOCIATION,INC.,
a Florida not-for-profit corporation (hereinafter referred to as "Grantor") to the BOARD
OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE
GOVERNING BODY OF COLLIER COUNTY, its successors and/or assigns, which has
a mailing address of 3299 East Tamiami Trail, Naples, FL 34112 (hereinafter referred to
as "Grantee" or "County"). Wherever used herein the terms "Grantor" and "Grantee"
include all the parties to this instrument and their respective, heirs, legal representatives,
successors or assigns.
WITNESSETH :
WHEREAS, Grantor is a private not-for-profit corporation formed pursuant to
applicable law that owns and operates certain community infrastructure and amenity
facilities located within the Bay Colony community; and
WHEREAS, Contessa Condominium Association, Inc. ("Contessa") is a private
not-for-profit corporation formed pursuant to applicable law that operates and manages
that certain condominium property located at 8111 Bay Colony Dr.,Naples,Florida 34108
pursuant to the Amended and Restated Declaration of Condominium of Contessa, a
Condominium,recorded in Official Records Book 2802 at Page 1715, et seq.,in the Public
Records of Collier County, Florida; and
WHEREAS, there is an existing drainage easement benefitting the County, as
successor to the Pelican Bay Improvement District, recorded in Official Records Book
1236, Pages 1726 through 1743, of the Public Records of Collier County, Florida, which
provides the County with access and drainage, including the construction, placement,
maintenance, repair and replacement of drainage swales, lakes, embankments, structures,
pipes, manholes, and related appurtenances over, under, on and through certain property
within Bay Colony community,including a portion of the Contessa condominium property
("Existing Easement"); and
WHEREAS, Grantor is the fee simple owner of that certain real property legally
described on Exhibit "A" attached hereto and made a part hereof, and referred to herein
as the BCCA Easement Area; and
WHEREAS, contemporaneously with the grant of this Easement, Contessa is
granting to the County a separate,but related,Drainage Easement("Contessa Easement")
over an additional portion of the Contessa property described therein ("Contessa
Easement Area"). This Easement,and the companion Contessa Easement,will effectively
extend the Existing Easement further south across the Contessa condominium property to
the southern property line shared with Contessa to allow for Grantor to obtain permit
approval for drainage improvements (e.g., flushing channels)within the BCCA Easement
Area ("BCCA Drainage Improvements"), and to construct the BCCA Drainage
Improvements; and
WHEREAS, the BCCA Drainage Improvements to be permitted and constructed
by Grantor in the BCCA Easement Area will connect to companion drainage improvements
in the Contessa Easement Area to be permitted and constructed by Contessa ("Contessa
Drainage Improvements"); and
WHEREAS, Contessa and Grantor, and PBSD (defined below) all desire for this
joint drainage system, once permitted and constructed, to direct runoff collected from the
Existing Easement across the Contessa Easement Area and the BCCA Easement Area and
ultimately discharge runoff to the existing Upper Clam Bay system; and
WHEREAS,the County established the Pelican Bay Municipal Service Taxing and
Benefit Unit (the "Unit") for purposes that include providing water management, beach
renourishment, and maintenance of conservation and preserve areas within its boundaries.
The County further established the Pelican Bay Services Division Board ("PBSD") to
provide input to the County in carrying out the purposes of the Unit; and
WHEREAS, the Contessa Easement Area and BCCA Easement Area are located
within the Unit; and
WHEREAS, the County agrees that it will accept perpetual operation and
maintenance responsibility for the Contessa Drainage Improvements and BCCA Drainage
Improvements (collectively referred to herein as the "Drainage Facilities and/or
System(s)"), which will be managed by the County through the Unit, after the Drainage
Facilities and/or System(s) are permitted and constructed by Contessa and BCCA,
respectively, and accepted by the County.
NOW, THEREFORE, Grantor for and in consideration of the sum of ten dollars
($10.00) and other valuable consideration paid by Grantee, the receipt and sufficiency of
which is hereby acknowledged by Grantor,hereby conveys,grants,bargains and sells unto
Grantee, its successors and assigns, a perpetual, non-exclusive easement for the Drainage
Facilities and/or System(s),access and perpetual operation and maintenance purposes only
on the following described lands located in Collier County, Florida, to wit:
Said lands are legally described in Exhibit"A" ("BCCA Easement Area"),
attached hereto and incorporated by reference herein.
Subject to easements, restrictions and reservations of record.
This is not homestead property.
Contemporaneously with the grant of this Easement, Contessa Condominium
Association, Inc. is granting to the County a separate,but related, Drainage Easement.
TO HAVE AND TO HOLD the same unto the Grantee, its successors and/or
assigns, together with the right and privilege to enter upon said land for the purpose of
maintaining the subject Drainage Facilities and/or System(s) or portion(s) thereof as the
perpetual operating entity,in,on,over and/or under the BCCA Easement Area in a manner
consistent with the approved South Florida Water Management District Environmental
Resource Permit No. 11-112801-P (Application No. 250123-49449) ("Approved
Permit"),the approved drainage and grading plans from the Approved Permit are attached
hereto as Exhibit"B"),and all other applicable laws. The BCCA Easement granted herein
shall constitute an easement running with the land and shall burden the lands described
above. Grantor and Grantee are used for singular or plural, as the context allows.
