OBJECTIVE: To appoint three voting members and one non-voting member to the Pelican Bay Services Division Board. CONSIDERATIONS: Collier County Ordinance No. 2002-27, as amended, created the Pelican Bay Municipal Service Taxing and Benefit Unit (Unit) and established the Pelican Bay Municipal Service Taxing and Benefit Unit Advisory Committee (known as the Pelican Bay Services Division Board). The Pelican Bay Services Division Board consists of nine members representing the residential interests within the Unit and two members representing the commercial and business interests within the Unit. The non-voting member shall be recommended for appointment by the Pelican Bay Foundation. The non-voting member should be an individual who is not related to and who is independent of the other Board members and County employees, with no apparent conflict of interest or appearance of impropriety. With the assistance of the County Manager, the Pelican Bay Services Division Board provides input to the Board of County Commissioners in carrying out the purposes of the Unit as set forth in the Ordinance. Terms are four years. A list of the current membership is included in the backup. Pursuant to Ordinance No. 2002-27, as amended, the Board of County Commissioners set the mail-in balloting date of March 6, 2026, for residents of the Unit to select two members to the Pelican Bay Services Division Board representing residential interests. The nominees receiving a plurality of the ballots are deemed the successful nominees and their names are forwarded to the Board of County Commissioners. The Board of County Commissioners, at a regularly scheduled meeting, then makes the necessary appointments to fill the vacant positions. The terms for Peter Griffith (resident), Richard Swider (Resident), Jacob Damouni (commercial/business), and Brad Hildebrandt (non-voting member), will expire on March 31, 2026. Of those returned, 48 ballots were found to be invalid and were thus not counted. The ballots were counted on March 9, 2026, in the Supervisor of Elections office. Trenton Waterhouse and Dave Cook received the highest number of votes. A summary of the results is provided in the backup documentation. The Pelican Bay MSTBU Ordinance provides that “if the number of nominees for the position which they have been nominated (i.e., for the "residential interests" or for the "commercial/business/other interests") does not exceed the number of open members for that position, then there shall be no balloting for such position. Instead, the list of nominees for the position shall simply be forwarded to the Board of County Commissioners, who, following public hearing on the matter, will make the necessary appointments to fill said positions.” Since the number of candidates/applicants for the commercial/business position does not exceed the number of vacancies, no election for this seat is necessary. FOUNDATION RECOMMENDATION: On January 26, 2026, the Pelican Bay Foundation recommended that Brian Stevens be appointed to the non-voting member seat for one year. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. - JAK RECOMMENDATION(S): That the Board of County Commissioners: 1. Reappoints Jacob Damouni to the Pelican Bay Services Division Board representing commercial/business interests, to a four-year term expiring on March 31, 2030; 2. Appoints Trenton Waterhouse and Dave Cook to the Pelican Bay Services Division Board representing residential interests, to four-year terms expiring on March 31, 2030; 3. Appoints Brian Stevens to the Pelican Bay Services Board as a non-voting member: to a one-year term expiring March 31, 2027; and 4. WHEREAS, Collier County Ordinance No. 2002-27, as amended, created the Pelican Bay Municipal Service Taxing and Benefit Unit (Unit) and established the Pelican Bay Services Division Board; and WHEREAS, Ordinance No. 2002-27, as amended, provides that the Pelican Bay Services Division Board shall consist of nine members representing the residential interests within the Unit and two members representing the commercial and business interests within the Unit; and in addition, there shall be one non-voting member nominated by the Pelican Bay Foundation in the manner set forth in the Ordinance; and WHEREAS, there are two residential seats, one business/commercial seat, and one non- voting member seat on the Pelican Bay Services Division Board which shall expire on March 31, 2026; and WHEREAS, the mail-in ballots for the expiring seats were counted on March 9, 2026, at the Supervisor of Elections office and the Clerk of the Circuit Court prepared a list of the election results. WHEREAS, one applicant has applied for the open business commercial position and, pursuant to Section 122-1662(f) of the Collier County Code of Laws and Ordinances, no balloting is required, but instead the nominees’ applications shall be forwarded to the Board of County Commissioners to make the necessary appointment; and WHEREAS, the Pelican Bay Foundation has provided the Board of County Commissioners with their recommendation for appointment for the non-voting seat. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that TRENTON WATERHOUSE and DAVE COOK, representing residential interests, and JACOB DAMOUNI, representing business/commercial interests, are each hereby appointed to the Pelican Bay Services Division Board to serve four-year terms expiring on March 31, 2030; and that BRIAN STEVENS, as a non- voting member, is hereby appointed to serve a one-year term expiring on March 31, 2027.
