CONSIDERATIONS: The MPO Bylaws (https://colliermpo.org/wp-content/uploads/MPO-Bylaws-2024.pdf) provide that the Board shall elect a Chair and Vice-Chair at the first regularly scheduled meeting of each calendar year and that the officers shall be voting members of the MPO. Any Board member may nominate or be nominated as Chair/Vice-Chair. Elections shall be decided by majority vote. The Chair and Vice-Chair shall serve a one-year term or until a successor is elected. Commissioner Dan Kowal is the current Chair; Council Member Tony Pernas is the current Vice-Chair. Commissioner McDaniel moved to approve the agenda and previous minutes, and Vice-Chair Pernas seconded. Passed unanimously. 5. PUBLIC COMMENTS FOR ITEMS NOT ON THE AGENDA Ms. Avola Brown wished everyone a Merry Christmas and a Happy New Year and announced that the Hands-free cell phone use bill is in drafting. There had been headway made with the representatives who refused to support the bill last agenda. More would be known in a few weeks. 6. AGENCY UPDATES 6.A. FDOT Mr. Gaither reported that FDOT had conducted its Draft Tentative Work Program public hearing from October 20-24, 2025, with a public meeting held on October 24th. He also mentioned that FDOT had received the Collier MPO’s letter and was preparing a response based on the comments from the previous meeting. In addition to drafting a formal reply, staff were actively working on several of the items raised in the letter. He stated that FDOT had already met with Collier County staff regarding the SR 29 Loop and expected additional discussions as they worked toward a solution acceptable to all parties. There was Page 7 of 125 3 ongoing coordination with Collier County staff on I‑75 improvements at Pine Ridge Road, as well as upcoming discussions related to Immokalee. 6.B. MPO EXECUTIVE DIRECTOR Ms. McLaughlin said the Center for Urban Transportation Research (CUTR) survey for the Collier and Lee MPO consolidation study was open for one more day. 7. CHAIR REPORTS 7.A. CITIZENS ADVISORY COMMITTEE (CAC) 7.A.1. Citizens Advisory Committee Chair Report The report was presented in writing. 7.B. TECHNICAL ADVISORY COMMITTEE (TAC) 7.B.1. Technical Advisory Committee Chair Report The report was presented in writing. 7.C. BICYCLE & PEDESTRIAN COMMITTEE (BPAC) 7.C.1. Bicycle & Pedestrian Advisory Committee Chair Report Ms. Sproviero said that Gene McPherson of Cape Coral attended the Bicycle & Pedestrian Advisory Committee (BPAC) meeting to present an off‑road trail he mapped from Florida City to Fort Myers. While BPAC members were familiar with portions of the route, Mr. McPherson had connected the full corridor. The BPAC Chair Report references the City of Naples, although the trail segment is in Lee County, so it wasn't included in the report. Mr. McPherson had been referred to the BPAC by The Florida Department of Environmental Protection (DEP) and the Office of Greenways and Trails (OGT) following the Florida Bicycle Meeting in November 2025. As BPAC is not a regulatory body for authorizing public access, committee members advised Mr. McPherson to work directly with the appropriate land management agencies, as many of the roads involved are gated, similar to several off‑road and gravel corridors in Collier County. Ms. Sproviero also reported that the committee is very supportive of the new bicycle and pedestrian safety ordinance related to e‑bikes adopted by the Collier County Board of Commissioners (BCC). She said that at the November meeting, BPAC voted to recommend expanding the ordinance to include Class 2 e‑bikes, commonly known as throttle bikes, due to safety concerns. These bikes do not require pedal assist, are frequently encountered by bicyclists, and can be easily modified through an app to exceed the 20‑mph limit, sometimes reaching speeds of up to 50 mph. Page 8 of 125 4 Chair Kowal said that as the author of the ordinance, Class 2 e‑bikes were considered during the original drafting, but that the elderly community in Collier County strongly supports their use. The BCC chose not to place additional restrictions on Class 2 e‑bikes for that reason. He added that Collier County’s approach remains consistent with state regulations. Commissioner LoCastro said the BCC understood the ordinance was not fully comprehensive when it was adopted, but it was important to put something in place that addressed most issues. He added that some elements of the ordinance cannot be revised as they fall under state authority, but that he had been collecting feedback worthy of consideration for fine tuning. 7.D. CONGESTION MANAGEMENT COMMITTEE (CMC) 7.D.1. Congestion Management Committee Chair Report The report was presented in writing. 7.E. LOCAL COORDINATING BOARD FOR THE TRANSPORTATION DISADVANTAGED (LCB) 7.E.1. Local Coordinating Board Chair Report Vice-Chair Pernas said the LCB approved the annual update to the LCB Grievance Policy/Procedures at the December 3, 2025 LCB meeting, adding language to the proposed update to specify that the number of days to take action excludes weekends and Collier County Government holidays, passing unanimously. The LCB also approved the Community Transportation Coordinator’s (CTC) Final Commission for the Transportation Disadvantaged (CTD), approved the FY 2024-25 Annual Operating Report and endorsed the submittal of Federal Transit Administration Sections 5310, 5311 and 5339 Grant Applications to Support the CTC. 8. REGULAR BOARD ACTION (ROLL CALL REQUIRED) 8.A. Approve the 2050 Long Range Transportation Plan (LRTP) Ms. Mclaughlin reported that the Technical Advisory Committee (TAC) unanimously endorsed the 2050 Long Range Transportation Plan (LRTP), and the Citizen Advisory Committee (CAC) endorsed it by a vote of 7–1. If the Board approves the plan, staff and the consultant, Jacobs Engineering, would complete a final review to address any scrivener’s errors or minor corrections before submitting it to FDOT, for a 90-day comment period. Since the Board last reviewed the 2050 LRTP, several updates were made during the committee review process. The public comment period on the interactive map remained open, and Jacobs Engineering updated the public involvement section to include the most recent feedback. Comments received were minor and came from FDOT’s Multimodal Division and County Transportation Planning, helping to clarify Page 9 of 125 5 and clean up the document. All revisions had been incorporated. Jacobs Engineering staff were present to answer questions. Ms. Thomas spoke on behalf of the Conservancy of Southwest Florida, stating that the Conservancy reviews road projects for environmental impacts during the LRTP process, and focuses on those posing the greatest ecological risk. She noted that many of the most concerning segments were not included in the Cost Feasible Plan. One such project is the proposed I‑75 interchange near Everglades Blvd. Although described as being “in the vicinity,” it may be intended to serve large developments awaiting federal permits. She emphasized that FDOT rejected an interchange at this location in 2012 because short‑distance local trips conflict with state and federal policies for interstate use and that the County should instead pursue realistic alternatives to improve traffic flow within Golden Gate Estates and between the Estates and western Collier County. There is also concern about Big Cypress Parkway, as it would destroy and fragment primary panther habitat and could isolate more than 4,000 acres of critical land. Its proximity to major public lands raises additional concerns about runoff and watershed impacts. Although the road is required for several planned villages, she noted that Collier County taxpayers would bear nearly all associated costs. She thanked the Board for its work on the LRTP and for considering the Conservancy’s comments. Commissioner McDaniel moved to approve the 2050 Long Range Transportation Plan (LRTP) and Council Member Schwan seconded. Roll Call Vote. REGULAR BOARD ACTION (NO ROLL CALL) 9.A. MPO Executive Director Interviews and Candidate Selection Ms. Lyberg explained that the Board selected 3 out of 11 candidates who applied for the Collier MPO Executive Director position to be invited to interview for the position. All 3 candidates accepted the invitation and were present: Vinod Sandanasamy, Carmen Monroy, and Nicholas Danu. The 3 applicants would give a presentation highlighting their knowledge, experience, and ability to perform the tasks associated with the position. Following the presentations, the candidates would answer interview questions posed by each Board member. Page 10 of 125 6 Ms. Monroy, Mr. Sandanasamy, and Mr. Danu provided presentations (which can be obtained by contacting Collier MPO), followed by a Q&A session and then closing statements. The Board members provided their ranking sheets to Ms. Lyberg and Mr. Rodriguez, who tallied the scores, and announced that Ms. Monroy was the top-ranking candidate. Commissioner McDaniel moved that Chair Kowal handle the contract negotiations and Commissioner Saunders seconded. Passed unanimously. Ms. Lyberg explained that Ms. Monroy would go through the regular Collier County Human Resources hiring process, with a contract to be approved at the February 13, 2026 MPO Board meeting and a scheduled start date for February 17, 2026. 10. MEMBER COMMENTS Commissioner Saunders congratulated the MPO staff and director on their good work, thanked the three Executive Director candidates for their time, and wished everyone Happy Holidays. Council Member Barton thanked all three highly qualified candidates and added that the City of Naples was drafting an ordinance in regard to e-bikes expected to be completed by January 2026. Council Member Schwan thanked the candidates and the MPO staff for their support and wished everyone a Merry Christmas and Happy Hannukah. OBJECTIVE: To obtain MPO Board approval for an administrative extension of the current General Planning Services (“GPS”) Agreement with Jacobs Engineering Group, Inc. (“Jacobs”) and Alfred Benesch & Company (“Benesch”) consulting firms for one hundred and eighty (180) days. CONSIDERATIONS: The MPO Board approved GPS Agreement No. 18-7432-MP (the “Agreement”) for the Professional Services Library (Agreement No. 18-7432-MP) on March 12, 2021, with 5-year terms set to expire on March 12, 2026. MPO staff are working with the County Procurement Division to procure new contracts (Solicitation #25-8402), which is projected to take another four months to complete. The current GPS Agreement authorizes the MPO Manager to extend the Agreement under all of the original terms and conditions for up to one hundred and eighty (180) days with written notice and consent of the consultants. MPO staff obtained signed contract extension request forms from Benesch and Jacobs and have submitted them to the County Procurement Division for final approval prior to the March 12th expiration date. (see Attachments 1 and 2). This item is simply requesting that the Board ratify the MPO Manager’s direction to Procurement to administratively extend the Agreement so that work with the consultants will not lapse prior to the approval of the new contracts that are currently being solicited. Agency Reports • Florida Department of Transportation (FDOT) Tanya Merkle of FDOT announced that, given the small budget, the Department is prioritizing finishing current projects over new Project Development and Environment (PD&E) phases. Earmarks can change the status of the budget. A new Project Development Policy has been released, requiring project construction funding programmed within 8 years from the start of the PD&E. • MPO Sean Kingston, Principal Planner, introduced Carmen Monroy. Pending approval of her employment agreement on February 13th, Ms. Monroy’s first day of work as the new MPO Director will be February 17th. The MPO Board selected her during MPO Director interviews at their December meeting after approving and adopting the Long Range Transportation Plan. Committee Action • The Committee elected Anthony Matonti to continue as Chair and Michelle Sproviero as Vice Chair. • The Committee reviewed the 2026 meeting schedule and BPAC bylaws and considered options regarding the frequency of future BPAC meetings. • The Committee reviewed and commented on the 2026/2027 Call for Bicycle-Pedestrian Projects application process, schedule, and forms prior to its distribution to member agencies. • The Committee voted to cancel the February meeting due to a lack of action items for the agenda. CONSIDERATIONS: The Florida Department of Transportation (FDOT) has requested the Collier MPO to amend its FY 2026-2030 TIP for the following transit projects. The State Transportation Improvement Program (STIP) detail provided by FDOT shows the Type of Work for 448810-2 and 446904-1 as Operating for Fixed Route. Collier County Public Transit and Neighborhood Enhancement has confirmed that two of the projects are for paratransit as noted below and under the Project Description on the project sheets in the attachment. • 448810-1: Add a new transit project for capital to purchase vehicles/equipment • 448810-2: Add a new transit project for operating assistance for paratransit • 446904-1: Add a new transit project for operating assistance to Easter Seals for paratransit Attachment 1 contains Resolution 2026-01, including Exhibits 1 and 2. CONSIDERATIONS: Upon notice of the anticipated retirement in early 2026 from the current MPO Director, a national search for a new MPO Director was completed by the Collier County Human Resources Department. Following the national search, applicants were narrowed to three candidates to interview. Interviews of the three candidates took place at the Board’s December 11, 2025, meeting, and the Board selected Carmen Monroy as the candidate they wished to appoint as the new MPO Director. The County Attorney’s Office was directed to work with Ms. Monroy and the MPO Chairman to negotiate an acceptable employment agreement. Ms. Monroy’s Employment Agreement is included as Attachment 1. Collier MPO staff provided the proposed Agreement to FHWA and FDOT for review and concurrence. FDOT responded that it does not provide review or concurrence on employment at the MPO. FHWA responded that it does not provide concurrence for Executive Director appointments. MONROY AND THE COLLIER METROPOLITAN PLANNING ORGANIZATION THIS EMPLOYMENT AGREEMENT is entered into this l3th day of February 2026,by and between Carmen T. Monroy, the Executive Director of the Collier Metropolitan Planning Organization (hereafter, the "Employee"), &nd the Collier Metropolitan Planning Organization (hereafter, the "MPO") (collectively, the "Parties"). WITNESSETH WHEREAS, the MPO wishes to employ the services of Employee as its Executive Director; WHEREAS, it is the desire of the MPO to provide certain benefits, to establish certain conditions of employment and to set working conditions for this position; and WHEREAS, this Employment Agreement provides for the terms and conditions of the Employee's employment with the MPO, including but not limited to compensation, the term of employment, severance pay benefits, the employee benefit package and annual performance evaluation; and WHEREAS, Employee desires to accept employment as the Executive Director of the MPO under the offered terms and conditions presented herein. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the Parties agree as follows: Section 1. Role and Duties The MPO agrees to employ Employee as its Executive Director, and Employee agrees to perform the functions and duties thereof, as may now and in the future be assigned and directed by the MPO. Until so amended, the role and duties of the Executive Director shall include but not be limited to the following: a.The Employee shall act as the Chief Administrative Officer of the MPO, directly reporting and responsible to the MPO Board and responsible for the day to day implementation of MPO programs and activities including MPO staff selection and supervision. The Employee shall devote full time efforts to the MPO and its mission. The Employee shall also direct and supervise professional service providers engaged by the MPO. The Employee shall perform such other associated and legally required duties and functions, as may now and in the future be required by Interlocal Agreement, MPO Staff Services Agreement, Section 339.175, Florida Statutes, any other applicable Florida and federal laws, and such other legally permissible and proper duties and functions as the MPO shall from time to time assign or direct. Page I of8 Page 38 of 125 Formulate and prepare recommendations regarding policies, rules and regulations, directives, programs, agreements, and all other documents which require consideration, action, or approval of the MPO. Prepare annual budgets and the annual reports for approval of the MPO. The Employee agrees to perform all such functions and duties, faithfully, competently, professionally and promptly to the best of the Employee's ability. A copy of the Classification Specifications for the Executive Director position is attached hereto as Exhibit "A" and is incorporated by reference to provide further description of the duties expected from persons employed in this position. Employee agrees to remain in the exclusive employ of the MPO from the start date of employment on February 17, 2026 through and until February 16, 2028, and neither to accept other employment nor to become employed by any other employer until termination of employment pursuant to this Agreement, except as provided in Section 10, infra. Neither party has any right to renew or extend this Agreement. If the Employee desires to renew and extend this Agreement, the Employee shall submit a request in writing for the MPO's consideration at a regularly scheduled MPO meeting no later than 120 days prior to the expiration of the current term of employment. If the MPO accepts the Employee's request, the term of this Agreement may be extended for a period of two (2) years through a mutual written agreement executed by the MPO and the Employee. Although both parties retain the right not to extend this Agreement with or without reason or cause, it is contemplated that the MPO will base its decision on the question of whether or not to grant the extension of the term of this Agreement on (1) the Employee's performance and (2) the Employee's ability to successfully achieve goals mutually developed and agreed to by the Employee and the MPO. C. Elements of this Agreement may be changed at arry time when mutually agreed upon in writing by the MPO and the Employee. Section 3: Suspension The MPO may suspend the Employee with full pay and benefits at any time during the term of this Agreement, but only if: A majority of the MPO and Employee agree; or After a public hearing, a majority of the MPO votes to suspend Employee for just cause; provided, however, that Employee shall have been given written notice setting forth any charges at least ten (10) days prior to such hearing by the MPO's members bringing such charges. Just cause shall include only willful misconduct or willful failure or disregard of Employee's duties under this Employment Agreement. c. d. d. Section 2: Term A. B A. B. cAo Page 2 of8 Page 39 of 125 Section 4: Termination and Severance Pav Subject to the provisions of this Agreement, the Employee may be terminated, with or without cause, by a majority vote of the MPO. In the event this Employment Agreement is terminated by the MPO before expiration of the aforesaid term of employment and during such time that Employee is willing and able to perform the assigned duties under this Agreement, then, and only in that event, the MPO agrees to pay Employee, in addition to any amounts then due Employee, including any unused vacation leave, a lump sum cash payment within ten (10) working days after the effective date of termination, as follows: A. An amount equal to four (a) weeks of Employee's annual base salary at the rate effective on the date of termination, less any nonnally required deductions, as limited, and provided under Florida Statute $ 215.425. Sick leave is not a compensable expense and is expressly not included in such a payout. B. In the event Employee has been terminated for misconduct, as defined in Florida Statute $ 443.036(29), Employee shall not be entitled to any severance payment as allowed under Florida Statute S 215.425, and the MPO may terminate Employee's employment without notice. Section 5: Resignation In the event Employee voluntarily resigns this position with the MPO before the expiration of the term of employment, then Employee shall give the MPO thirty (30) days advance written notice. If Employee voluntarily resigns, providing the MPO with less than thirty (30) days notice, Employee shall forfeit any payment for accrued leave otherwise due and owing. Section 6: Disability If Employee is permanently disabled or is otherwise unable to perform the assigned duties under the Agreement, with or without an accommodation, because of sickness, accident, injury, mental incapacity or health for a period of four (4) successive weeks beyond any accrued leave, the MPO shall have the option to terminate this Agreement, subject to the severance pay requirements of Section 4. Section 7: Salary MPO agrees to pay Employee for the services rendered pursuant hereto an annual base salary of One Hundred Forty-Five Thousand ($145,000.00) payable in bi- weekly installments. Within one hundred and twenty (120) days after execution of this Agreement, the Employee shall submit for the MPO's consideration and approval at a future regular Board meeting, a performance-based merit plan that the MPO can utilize to evaluate the Employee's performance and consider whether the Employee may be eligible for A. Page 3 of8 Page 40 of 125 a merit adjustment upon the successful completion of measurable goals and objectives to be completed or attained by the Employee during each fiscal year of this Agreement. The percentage of any annual performance-based merit adjustment to the Employee's base pay or such one-time lump sum amount shall be set by the MPO Board but no such award is guaranteed and is also subject to available funding. The MPO Board may also choose to adopt any merit pay adjustment policy offered by Collier County Government to its employees. On the date that general wage adjustments (i.e., cost of living adjustments, special study pay adjustments, etc.) are granted generally to Collier County Government employees, the Employee's base salary shall likewise be modified to reflect such general wage adjustments. The timing of any such wage adjustments is for administrative purposes only as the Employee is not a County Employee but rather reports directly to the MPO and there is no guarantee that the Employee will receive such general wage adjustments. Section 8: Performance Evaluation The MPO shall review and evaluate the perforrnance of the Employee in accordance with the approved evaluatiorVperformance-based merit plan as provided in Section 7. Written evaluations based on said performance plan will be provided by each voting MPO Board member to Employee by no later than 48 hours prior to the scheduled September MPO meeting for each year of this Agreement; and are to be incorporated as part of the Employee's annual performance evaluation, which shall take place during the MPO's regular October meeting. A summary of all evaluations will be prepared by the MPO Board Chair and Employee including any recorlmended merit wage adjustment consistent with the procedure stated in Section 7. If the MPO Board approves a merit wage adjustment, it will become effective upon the date the MPO Board approves the merit wage adjustment amount and will be processed with the Employee's next regular scheduled paycheck. An updated performance evaluation plan for Employee will be developed in good faith between the MPO and Employee and adopted by the MPO no later than its first regular meeting in December of each year of the Agreement. Section 9: Hours of Work All duties required hereunder shall be performed by the Employee personally, or through the assistance of such MPO employees as may be made available from time-to-time, which the Employee shall assume full responsibility; provided, however, that nothing herein shall be deemed to absolve the Employee of personal responsibility for the duties set forth herein. The Employee shall be available to perform said duties while working a minimum of a forty (40) hour work week and shall be available to accomplish such duties, as needed, during said period of employment consistent with the duties of an "exempt" employee under the Fair Labor Standards Acq29 U.S.C. $$ 201, et seq., as amended. Except as otherwise directed by the MPO, the manner and means of performance of the duties herein shall be determined by the Employee. All acts performed by the Employee, explicitly or implicitly, on behalf of the MPO, within the scope of this employment, shall be deemed authorized by the MPO as its agent, except that any act which constitutes willful misconduct or which may be unlawful shall be deemed to be an individual act of the Employee without authority of the MPO or the County. C cAoPage 4 of8 Page 41 of 125 Section 10: Outside Activities The Employee agrees to remain in the exclusive employ of the MPO during the term of the Agreement unless the MPO authorizes limited outside employment not in conflict with the Employee's duty with the MPO. Section 11: Automobile and Cellular Phone The MPO shall provide a cellular phone and service for the Employee's business use and access to a Collier County motor pool automobile for travel to MPO related functions. Section 12: Comprehensive Benefit Package. The MPO agrees to provide the same comprehensive benefit package to the Employee that is currently provided to other Director level personnel of Collier County Government. The MPO also agrees to execute all necessary agreements provided by Nationwide Retirement System, MissionSquare Retirement, or such other qualified 457 defened employee retirement plan offered by Collier County should Employee elect to participate in such available retirement plans. Employee shall be eligible for up to a $1,500.00 cash match to any eligible 457 defened retirement plans. Section 13: Vacation. Holiday and Sick Leave Upon commencement of employment, the Employee shall be entitled to receive vacation leave as follows: 1. For years one and two of the Agreement, commencing on the execution of the Agreement and again on the anniversary date thereof, the Employee's leave bank shall be credited with 80 hours of vacation leave. The Employee shall also be entitled to accrue 80 hours more of vacation leave from the date of hire/anniversary date for each normally scheduled hour of work based upon the rate of .0385 per hour, 3.08 hours per pay period, for a total potential annual vacation leave balance during that period of 160 hours (4 weeks) of vacation leave. 2. If the term of the Agreement with the Employee is extended as provided in Section 2 above, for any renewal terms beginning with year three through the end of the year six, on the yearly anniversary date in the same manner as provided above, the Employee's leave bank shall be credited with 40 hours of vacation leave, and the Employee shall be entitled to accrue 120 hours more of vacation leave from the anniversary date for each normally scheduled hour of work based upon the rate of .0577 per hour, 4.62 hours per pay period, for a total potential annual vacation leave balance during years three through six of 160 hours (4 weeks) of vacation leave. 3. If the term of the Agreement with the Employee is extended beyond six years of employment, for each year thereafter through the end of the 20th year of employment, the Employee shall be entitled to accrue vacation leave for each CAOPage 5 of8 Page 42 of 125 normally scheduled hour of work based upon the rate of .0769 per hour, 6.152 hours per pay period, which amounts to 160 hours (4 weeks) of vacation leave. With the exception of the annual amount of leave that can be accrued, vacation leave shall otherwise be treated consistently with the vacation leave policy adopted by Collier County Government. Vacation leave shall be utilized in a manner that does not disrupt the orderly management of the MPO office and be requested consistent with MPO policy. Sick leave will accrue at the same frequency and in the same manner as currently provided to personnel of Collier County Government, and the Employee will be entitled to eleven (11) paid holidays annually, payable on the dates observed by the Board of County Commissioners Agency. The employee is also eligible for 16 personal leave hours with pay per calendar year, which are credited at the time of hire and at the beginning ofeach calendar year thereafter. Section l4: Profbssional Dues and Subscriptions The MPO agrees to pay for the reasonable and customary professional dues and subscriptions of Employee necessary for continued professional development, including pertinent national, regional, state, and local associations and or garizations. Section l5: Profbssional Development The MPO agrees to pay for the reasonable and customary travel expenses (as set forth in MPO policy and Florida law) for the Employee's necessary travel and attendance at any meetings and conferences approved by the MPO in advance of such travel. Section l6: Indemnification In addition to that required under State and local law, the MPO shall defend, save harmless, and indemnifr Employee against any tort, professional liability claim or demand or other legal action, including costs and attorneys' fees relating thereto whether groundless or otherwise, arising out of an alleged negligent act or omission occurring in the performance of Employee's duties as Executive Director, subject to the limits found in $768.28, Fla. Stat. Section l7: Other Terms and Conditions of Employment The MPO and the Employee shall fix any such other terms and conditions of employment as they may determine from time to time, relating to the performance of Employee, provided such terms and conditions are not inconsistent with or in conflict with the provisions of this Agreement or any other law. The parties shall attempt in good faith to resolve any dispute concerning this Agreement through negotiation between authorized representatives. If these efforts are not successful, either party may then file an action in the Circuit Court of Collier County, which shall be the exclusive venue with respect to any disputes arising out of this Agreement. CONSIDERATIONS: The administrative rule of the MPOAC provides that “by no later than December 31st of each year, each metropolitan planning organization shall appoint its representative to the MPOAC to serve for the succeeding calendar year.” The current Collier MPO primary representative is Commissioner William McDaniel, Jr., and the current alternate representative is Commissioner Burt Saunders. The MPO Executive Director has reached out to Commissioners McDaniel and Saunders, respectively, and confirmed that Commissioner McDaniel desires to continue as primary representative for 2026 and Commissioner Saunders is willing to continue as an alternate representative for 2026. The MPOAC typically meets quarterly on the fourth or fifth Thursday of the month in Orlando. CONSIDERATIONS: Four BPAC memberships are set to expire at the end of February. All BPAC memberships are at-large. Each member has been active with the Committee and all are applying for re-appointment. Staff is recommending that these members be reappointed for new 2-year terms. (The current membership roster is included as Attachment 1.) • Mr. Musico’s membership began in 2007. He has been a highly effective advocate for bicycle and pedestrian infrastructure for the City of Marco Island and Collier MPO for over twenty years. (Attachment 2) • Mr. Bonness’ membership began in 2005. He has over 20 years of bike and pedestrian advocacy and is a world champion triathlete with much education, training, work experience, and participation in bike and pedestrian related matters. (Attachment 3) • Mr. Dohm participates in organized groups of bike rides several days per week. He is also a retired United Airlines pilot who was the former Chair of the Board of Directors of Chicago Airport. His membership began in 2024. (Attachment 4) • Mr. Vigorito participates in the Pan-Florida Challenge cycling fundraising organization. He has participated in various boards and committees and community service and is a retired medical professional with experience in Blue Zones. His membership began in 2024. CONSIDERATIONS: Safety Targets are the only federal Transportation Performance Measure that must be adopted annually. FDOT establishes the State’s safety targets in the Highway Safety Improvement Plan. FDOT is maintaining its Target Zero safety performance targets for 2026: zero fatalities and zero serious injuries on Florida roadways. MPOs have the option to either adopt the Statewide safety targets or establish their own quantifiable safety targets. (The “hard” deadline for the MPO Board to adopt annual safety targets is February 2026.) Collier MPO has consistently elected to adopt the FDOT statewide targets. (This is not to be confused with the MPO having identified a performance target of reducing serious injuries and fatalities by 25% by 2050 as an interim measure to meet the requirements of the Safe Streets and Roads for All Grant Program.) By supporting FDOT’s Target Zero Statewide safety targets, the MPO is making a commitment to support FDOT’s investments in safety improvements and to making safety a priority in the development of the Long-Range Transportation Plan and the Transportation Improvement Program. Given FDOT’s firm belief that every life counts, the target set for all safety performance measures is ZERO. MPO TARGETS MPOs must set targets by February 27 of each year (within 180 days after FDOT sets targets). MPOs have the option of supporting the statewide targets or establishing their own targets for the MPO planning area. MPOs must include the most recent reported performance and targets with each TIP update. The TIP must describe how the investments contribute to achieving the performance tar- gets. The LRTP must include a System Performance Report that discusses the performance of the transportation system and progress achieved in meeting the targets over time. ASSESSMENT OF SIGNIFICANT PROGRESS FHWA considers a state to have met or made significant progress when at least four of the five safety targets are met or the actual outcome is better than baseline performance. Florida is making progress towards achieving the targets established for serious injuries but not yet for fatalities or non-motorized users. As requested by FHWA, FDOT annually develops an HSIP Implementation Plan to highlight strategies it will undertake in support of these targets. MPOs are encouraged to review this Plan each year to identify strategies appropriate for their planning area. FHWA will not assess MPO target achievement. However, FHWA will review MPO adherence to performance man- agement requirements as part of periodic transportation planning process reviews. Mr. Gelfand served as Chair or Vice Chair for most of those years and set the tone for civility and reasoned debate. Mr. Gelfand exemplifies leadership by encouraging fellow committee members to speak up, ask questions and respectfully challenge the accuracy of reports and presentations. He frequently elevates the discussion by asking thought provoking questions that have no easy answers. The community benefits greatly when exceptional leaders such as Mr. Gelfand play an active role in local govemment. Chairing boards and committees is heavy work that too often goes unrecognized.
