AGREEMENT FOR FIRE DISTRICT ACCESSIBLE
RAW AND POTABLE WATER CONNECTIONS
BETWEEN GREATER NAPLES FIRE RESCUE
DISTRICT AND
COLLIER COUNTY WATER- SEWER DISTRICT
This AGREEMENT is made and entered into this. I34' day of 1a.. , 202/, by and
between the Greater Naples Fire Rescue District ("Fire District") and the Board of County
Commissioners of Collier County, Florida as the Governing Board of Collier County, and as Ex-
Officio the Governing Board of the Collier County Water-Sewer District("CCWSD"),collectively
("Parties").
WITNESSETH
WHEREAS, the Fire District is desirous of accessible CCWSD raw water connections
to access supplemental water sources for fighting fires; and
WHEREAS,the CCWSD has 15 wellheads already fitted with connections available; and
WHEREAS, the CCSWD has eight hydrants available on the raw water system; and
WHEREAS,the CCSWD has activated hydrants on water mains not in service for potable
customers along Everglades Blvd., 47th Avenue NE, and 16th Street NE; and
WHEREAS,the Parties wish to enter into an agreement to provide accessible raw water
and potable areas connections for use as supplemental water sources to fight fires; and
WHEREAS, the Parties agree that it is in the best interests of each Party to enter into
this Agreement to facilitate the availability of raw water connections as supplemental water
sources to fight fires; and
WHEREAS, it is in the best interest of the Parties, the residents of Collier County to
facilitate the availability of water connections as supplemental water sources to fight fires.
NOW THEREFORE, in consideration of the mutual understandings and considerations
contained herein, the sufficiency of which is hereby acknowledged,the Parties agree as follows:
1. The CCWSD will allow the Fire District to withdraw water for the purpose of fighting
fires from the following agreed upon CCWSD sources:

a. Raw Water Booster Station (RWBS) hydrant located at 841 7th Street SW,
Tamiami Well 18 hydrant located at 911 6th Street SW, Tamiami Well 23 located
at 1498 Tobias Street, Tamiami 25 located at 1596 Tobias Street, Tamiami 39
located at 10535 Vanderbilt Beach Road,Tamiami 40 located at 10425 Vanderbilt
Beach Road, 3190 White Blvd. and a hydrant located at the intersection of Weber
Blvd North and Vanderbilt Beach Road Extension.
b. Fifteen existing wellhead connections at Tamiami Wells: 1, 3, 4, 6, 11, 14, 17,
19, 23, 24, 30, 31, 32, 34, and 37.
2. Attached as Exhibit "A" is a map showing the locations of current existing identified
mutually agreeable connections. Should those connection sites change,the CCWSD will
provide updated maps to the Fire District or no less than annually.
3. Attached as Exhibit "B" is a map showing the location of the hydrants in the Northeast
service area that are active only for Fire District use.
4. There is no guarantee of water availability. At times no raw water is flowing through
portions of the wellfield(i.e.,during annual pigging of the raw water transmission mains,
during periodic planned or unplanned maintenance of wells or the raw water distribution
system,etc.). These raw water connections should be considered only as supplemental to
regularly utilized sources ofwater.
5. There is no guarantee of water quality or suitability for use in fighting fires. The water is
available "as is," and the CCWSD disclaims all warranties, whether express or implied,
as to the water's suitability for fighting fires. It is understood and accepted by the Fire
District that their use of the water is wholly at their discretion and risk.
6. The first raw water source should be from the fire hydrant located at the RWBS. This
location provides for ingress from 7th Street SW with egress to 9th_Street SW,facilitating
a smooth flow for vehicles in and out of the site. The protocol for obtaining water from
the RWBS is as follows:
a. The Fire District shall contact the South County Regional Water Treatment Plant
(SCRWTP) at(239) 252-6115 to inform Operations personnel that they are at the
gate to the RWBS and request permission to begin to fill their tanks. The SCRWTP
is staffed 24/7/365. In the event an alternate contact is needed,Fire District shall
contact:
• Pamela Libby,Distribution Well Field Manager,at 239-253-0215 or
• Joshua Bauer - Field Supervisor II at 239-784-3400 or
• Howard Brogdon—Water Director at 239-580-9459.
b. CCWSD will dispatch personnel to the site.

c. Fire District personnel may after receiving permission from the South County
Regional Water Treatment Plant Control Room operate the valve and begin to fill
their tanks or CCWSD personnel can operate the valve. A valve key is placed at each
location by the CCWD for Fire District use and is marked as such. See Exhibit C for
example of valve key set up.
d. Fire District personnel should record the amount of water taken along with times and
dates of use to submit after each fire event. The report should be sent to the CCWSD
via emailed to the Water Distribution Manager at
Pamela.Libby @colliercountyfl.gov.
7. Should the need arise for additional water resources,the Fire District may request use of other
connections at Tamiami Wells located throughout the Golden Gate Estates area. The Fire
District shall use the following protocol to gain access to those secondary raw water
resources:
a. The Fire District shall contact the South County Regional Water Treatment
Plant (SCRWTP) Operations personnel at(239) 252-6115 to inform Operations
personnel that they are at a well site and request permission to begin to fill their
tanks. The SCRWTP is staffed 24/7/365.
In the event an alternate contact is needed,Fire Districts shall contact:
• Pamela Libby,Distribution Manager at 239-253-0215 or
• Joshua Bauer-Field Supervisor II, at 239-784-3400 or
• Howard Brogdon- Water Director at 239-580-9459.
b. CCWSD personnel will be routed to the requested location immediately.
Response time may be up to 30 minutes depending on the location of responding
personnel.
c. Fire District personnel after receiving permission from the South County Regional
Water Treatment Plant Control Room may operate the valve and begin to fill their
tanks or CCWSD personnel can operate the valve. A valve key is placed at each
well location by the CCWSD for Fire District use.
d. Fire District personnel will provide apparatuses to be filled.
e. CCWSD personnel will record all water taken if CCWSD personnel arrives prior
to the Fire District personnel completing the filling of its tanks. If not, then Fire
District personnel should record the amount of water taken along with times and dates
of use to submit after each fire event. The report should be sent to the CCWSD via
emailed to the Water Distribution Manager at Pamela.Libby@colliercountyfl.gov.

f. CCWSD personnel will remain on site until usage is no longer needed.
8. The Fire District shall be liable for its own actions and negligence, and, to the extent
permitted by law, the Fire District shall indemnify, defend, and hold harmless Collier
County and the CCWSD against any and all actions, claims and/or damages arising out
of the Fire District's actions in the performance of this Agreement, including but not
limited to environmental risks and risk of application to structures. The foregoing
indemnification shall not constitute a waiver of sovereign immunity beyond the limits
set forth in Florida Statutes, Section 768.28, nor shall the same be construed to
constitute agreement by any party to indemnify the other party for such other party's
negligent, willful, or intentional acts or omissions. This indemnification obligation
shall not be construed to negate, abridge, or reduce any other rights or remedies which
may otherwise be available.
9. The Parties may terminate this Agreement without cause upon providing thirty (30)
days written notice to the other party.
10. All notices from either of the parties to the other shall be deemed duly served if mailed,
emailed at the following:
