Executive Summary
Recommendation to consider the release of two code enforcement liens with an accrued value of $150,750 upon receipt
of full payment, in the code enforcement actions titled Board of County Commissioners vs. K2 Housing Naples LLC, in
Special Magistrate Case Nos. CESD20230007975 and CESD20230008241, relating to the property located at 3880
Tollgate Blvd, Collier County, Florida. (This item is a companion to Item 17B)
OBJECTIVE: For the Board of County Commissioners to consider the release of two code enforcement liens with an
accrued value of $150,750 in Special Magistrate Case Nos. CESD20230007975 and CESD20230008241.
CONSIDERATIONS: In Case No. CESD20230007975, the Special Magistrate ordered the imposition of a lien against
K2 Housing Naples LLC (K2) for code violations at 3880 Tollgate Blvd. The violations consisted of installing exterior
LED lights around the entire building and a wired video security system prior to the issuance of Collier County Building
Permits and/or Approvals for improved, unoccupied commercial property.
The lien was recorded in the Official Records on May 2, 2025, at O.R. Book 6464, Pages 1530–1532 in the amount of
$51,835.40. Fines continued to accrue for a total of 365 days ($250 per day from September 11, 2024, through
September 10, 2025), for a total of $91,250. The owner brought the property into compliance on September 10, 2025.
In Case No. CESD20230008241, the Special Magistrate ordered the imposition of a lien against K2 Housing Naples
LLC, for code violations consisting of beginning work on the soffit/fascia area prior to issuance of Collier County
permits.
The lien was recorded in the Official Records on May 2, 2025, O.R. Book 6464, Pages 1527–1529, in the amount of
$51,835.25. Fines continued to accrue for a total of 238 days ($250 per day from September 11, 2024, through May 6,
2025), totaling $59,500. The owner brought the property into compliance on May 6, 2025.
The property meets all the elements of Resolution No. 2023-90, except that the code liens are fixed at $150,750, which
is 2.99% of the parcel's assessed value. Therefore, staff recommends that this amount be paid in full.
K2 Housing Naples LLC representative Dan Kessler is aware that the accrued lien balance of $150,750 is less than the
customary recommended payment of 10% of assessed value as established in Resolution 2023-90.
Although K2 Housing Naples LLC acknowledged the violations, was found in violation by the Special Magistrate, and
has since achieved full compliance, K2 Housing Naples LLC has requested elimination of all accrued fines (Attachment
A). There are no outstanding violations on the property at this time.
To correlate with what is outlined in Collier County Resolution 2023-90, Code Enforcement recommends accepting
payment of $150,750, 2.99% of the Collier County Property Appraiser's assessed value of $5,025,178, to release the
liens.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of a payment of $150,750 to settle the liens will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution

that is being converted into 1 '! 0 units of dignlried worKorce housing for essentiaI workers in
Cottier County. Both invotved a minor scope of work and arose either from pre-existing,
inherited conditions from the prior owner of the property or emergency safety measures
undertaken after ctosing. ln each instance, K2 acted immediately, tEnspar6ntly, and in
good faith to protect residents, preserve pubtic safety, and bring the property into fut[
compliance.
From the day of acquisition, K2's purpose has been to hetp address Cotlier County's
affordabte- and workforce-housing crisis by redevetoping aging todging assets into safe,
dignified housing that serves [oca[ workers. Onty fifteen (15) days after ctosing, Hurricane
lan struck, devastating much of the area. White nearty every other hotel in Naples was
forced to shut down, K2 kept the property operational and opened its doors to tirst
responders, emergency construction crews, senior-care providers, and disptaced
smat[-business emptoyees, providing them with criticat shetter when the community
needed it most. That same sense of civic responsibitity has guided every action sance.
Part I addresses minor, inherited viotations related to unpermitted security-camera
and soffit-lighting instattations compteted by the prior owner-issues that were
not reasonably discoverable during due ditigence and required several months of
coordination with County staft and licensed contractors to resotve.
Part ll addresses a separate emergency soffit-safety response fottowing an
unexpected cottapse of a very timited part of the property caused by long-term
water damage that pre-dated ownership, where K2 acted swiftty to secure the
property and prevent injury and then property permitted and rebuitt the limited
affected area.
These matters were non-structurat, retatively minor and very [imited in scope; they are
fulty resotved and were handted with continuous cooperation and documentation. We
respectfutly request that the Board recognize K2's record of good-faith comp]iance and
approve compl€te lien elimination as an equitab[e outcome consistent with Cotlier
County's pubtic-safety and housing goats.

Fotlowing K2's acquisition of the Naptes property, Cottier County notified K2 Developers of
two minor, pre-existing items constituting a code violation related to unpermitted work
compteted by the prior owner:
lnstattation of a security-camera system without permits; and
lnstallation of exterior tighting without permits.
These were smatt-scate, non-structuraI improvements-a re[atively few extra LED tight
butbs (that reptaced original energy-inefficient, tow{ight hatogen butbs that K2 [earned
were originatly instalted in the 1980s) and a few extra security cameras-that coutd not
have been reasonably detected during pre-closing inspections or third-party ditigence. As
K2 discussed with the County's Chief Code Officiat, had this been a roof reptacement,
HVAC system, or any structura[ modification, K2 absotutetywoutd have discovered it. But
these minor items felt betow the tevet of typicat visibitity in a commerciaI acquisition. The
County officiat acknowtedged that point and understood that K2's team acted in good faith
upon discovery.
From the moment K2 was notified, its team worked ditigentty and transparentty with County
staff to correct the inherited conditions. lnitiatty, K2's Asset Manager, Atex Bendet, received
the viotation notice and attempted to resolve the probtem with its existing contractor
retationships and Code Enforcement Officer Jason Packard. Thereafter, K2's Project
Manager, Maft Lohry, coordinated with K2's owner's representative, Tony Schanna, and
Code Enforcement Officer Packard to clarify the scope of work necessary for comptiance
with new contractors. K2 engaged in muttipte meetings and emaiI exchanges beginning in
€arly Aprit 2024, inctuding a virtual meeting on Aprit 8, to conf irm the permitting
requirements.
Efforts to Correct and Detays Experienced
K2 immediatety began outreach to quatified and property ticensed contractors to resolve
the viotation. However, most locat professionals dectined to participate due to the tegat risk
of assuming responsibitity for minor, unpermitted work they had not performed. Despite
these chattenges, K2 continued engaging both the county and private contractors through
the spring, summer, and fatt of 2024.

November 2023 - March 2024 (initial discovery and scoping period): K2's initiat
correspondence with Code Enforcement Officer Packard seeking ctarity on
approach and scope of work. K2's Asset Manager Atex BendeI coordinated various
meetings with Mr. Packard and potential contractors to ctarify the probtem and
solutions.
Aprit-May 2024: Atex Bendet had further coordination with Herman Pardo, a prior
locaI security systems/network engineering contractor, and Oscar Fernandez, a
soffit contractor, who both uttimatety withdrew due to permit tiabitity concerns, on
such a minor scope of work. During this period, K2's team worked closety with Mr.
Packard to ctarify expectations and confirm which scopes woutd require after-the-
fact permits.
May-luay 2024: Continued correspondence with Mr. Packard and K2's ptanning
consultant, Jem Frantz of RVI Ptanning & Landscape Architecture to confirm
documentation requirements and ensure the viotation remained open but in
progress. By tate Juty (Juty 31), both Herman and Oscar had ceased invotvement,
and K2 began soticiting new bids from quatified firms.
August-Early September 2024: The County reiterated that at[ etectricaI work
retated to the tighting must be performed by a licensed electrician. K2 expanded
outreach to additionaI firms but was repeatedly turned away for the same tiabitity-,
and minor scope-of-work-related reasons.
Late September 2O24: During a fo[[ow-up catt with Mr. Packard, the County advised
that simp[y removing the cameras woutd be sufficient to resolve that viotation, the
first time this approach was offered as a sotution. Acting on that direction, Mr,
Perez promptly removed atl cameras and confirmed the removat in writing. The
County tater.qalffirmed that this satisficd the camera-related portion of the
ellalian-
January 2025: Atex Bendet notified Mr. Packard that he was also coordinating with
Heten Buchillon of Col[ier County to try to reso[ve the viotation. ln February, Mr.
Packard responded.

Mid-S6pt6mber 2024: After several months of outreach, K2 identified and engaged
Daniel Perez of So Fto Remodeting & So Flo Dumpsters, a licensed and insured
contractor wilting to assume responsibitity for after-the-fact permittlngand minor
corrective work. Mr. Perez immediatety coordinated with K2's team to organize
scope documents and begin the permit process.

May-Juty 2025: Mr. Perez submitted the after-the-fact permit apptication for the
soffit tighting instatlation. However, the County misread K2's submittal, issuing
review comments on pote-mounted tighting instead of the soffit-mounted tighting
f ixtures that were actua[[y at issue. This turther delayed the process because Mr.
Perez spent time making a location and light specification map that was then
not relevant to the viotation issue.
June-Juty 2025: K2's team and Mr. Perez engaged in numerous exchanges with the
County to ctarify that the scope pertained sotely to soffit tights. Because the
comments had been apptied to the wrong fixture type, the permit required
complete resubmitta[. K2 atso engaged Commissioners'offices during this time
to ensure the file received accurate and timely review.
August 2025: The corrected a,?ter-the_-Jact permit was issued, and Mr. Perez
completed minor remediaI work and passed two inspections-finalizing
comptiance with the soffit tighting citation.
August 2025: The camera and tighting violation was fulty correeted, closed, and
confirmed compliant by Cotlier County Code Enforcement.
Throughout this process, K2's communications with the County remained consistent and
cooperative. Mr. Packard repeatedty acknowtedged K2's responsiveness and recognized
that this was not a violation created by K2 but inherited conditions from prior ownership.
Despite the administrative burden, somewhat inconsistent guidance, and contractor
retuctance, K2 pursued comptiance without interruption and at K2's expense.
Financiat lmpact and Broader Context
White the viotation involved minor corrective work, the process to remedy them caused
severaI months of detay and significant cost escatation. K2's team incurred measurab[e
expenses across mu[tip[e fronts-engaging contractors, consultants, and attorneys to
interpret and rectify inherited conditions. The protonged comp[iance period extended K2's
carrying costs, deferred other rehabilitation work, and coincided with a period of rapid
construction inflation, tariff-driven material price increases, and sharpty higher interest

March-Aprit 2025: K2 learned that reptacing the (ights tike{or-tike is an acceptabte
approach. The chattenge became matching a modern hatogen butb with ones from
1988. K2 sought ctarity from Mr. Packard for an acceptab[e tight specification that
woutd resotve the issue. Mr. Packard was unabte to answer and tried to obtain an
answer f rom the buitding department. This back and forth lasted for months.

rates, which created higher financing costs. These costs have materialty impacted project
timing and economics and have created a serious fiscal burden and challenge for the
redevetopment of the property into dignifiod workforce housing directty atigned with
Cottier County's economic and housing objectives. ln the meantime, the automatic daity
accruaI of fines duringthis protonged process described above woutd seriousty exacerbate
this f iscaI burden.
Request for Retief
Given the futt factua[ record-that this was a minor, task-r6tated, pre-existing, and not
reasonabty discov€rable violations; that K2 acted immediately, persistently, and in
good faith; and that the property now serves a vital pubtic benefit-we respectfutty
request that the Board approve futt elimination of the outstanding tiens and fines
retated to these cured matters.
This resolution woutd appropriatety reftect that the viotation has been futty remedied, that
the detays were driven by the tengthy administrative process and attempts to secure a
property ticensed contractor wilting to perform the work, rather than negtect, and that
ownership has demonstrated the highest [eve[ of cooperation and responsibility expected
by Cottier County.
Part ll - Soffit Safety Viotation
However, when one section faited unexpected[y, K2 was compelled to take immediate
action. Because the ground-ftoor apartment entry doors are located directty beneath these
soffits, K2 selective[y removed, in a very minor scope of work, a very timited additional area
that showed visibte signs of degradation tike cracking, sagging, and water staining (at the
same time, attempting to safely relocate affected tenants). These areas posed a clear
hazard to tenants and K2 needed to act immediatety.
This was a limited, emergent, minor soffit removat, not unauthorized renovation work.
Unfortunatety, a Cottier County inspector observed the work in progress and mistakenly

K2 was notified by its operations team that a smatt section of the non-structuraI balcony
soffit had collapsed during a continuous wind-and-rain storm due to tong-term moisture
infittration and deterioration of the wood framing. This condition had not been addressed
by the prior owner. K2 had a[so faced numerous high-wind and heavy-rain events during
previous hurricanes, inctuding Hurricane lan, which had further contributed to the ongoing
weather-related stress on that area.

betieved it to be unpermitted construction and renovation, when in fact it was highty
setective emergencywork. A stop-work order was issued. Following that, K2 worked with its
architect to create the required detait drawings to permit the fut[ removal and rebuild scope
property. K2 initiatty contracted with Btue Lines to perform the work, but it uttimatety
dectined the job, afterwhich K2 contracted with Oscar Fernandez's company, which
uttimately completed the work.
At atttimes, K2 acted with immediate haste, in good faith and using pu btic-safety-retated
iudgment to perform minor but immediately necessary work to avoid a potentiaI serious
accident-it was not unauthorized, casua[, or [onger-term renovation work. K2 further
submits that, with knowtedge of the immediate safety condition, had K2 not so acted, an
otherwise avoidabte accident could have occurred and K2 coutd have faced liabitity for a
far more serious and consequential outcome. ln short, K2's emergent actions were
necessary to protect pub[ic safety, not endanger pubtic safety.
Financiat lmpact
The financial impact is virtuatty the same, inctuding the automatic daity accruat of fines
during this protonged process, as described f utty above regarding the camera/tighting
viotation.
Conclusion
Across both matters, and since acquisition, K2 Devetopers has demonstrated continuous,
community-oriented stewardship of this property. K2's mission f rom day one has been to
hetp Cottier County expand its suppty of affordabte and workforce housing, and K2 has
acted consistentty in that spirit-even under extraordinary circumstances such as
Hurricane lan, when K2 votuntarity housed dozens of f irst responders from NCH who tost
their homes and other essential workers who served this County in its hour of need.
The costs, both direct and indirect from this protonged process as discussed above, have
been substantiat and chattenging. The totat fines from the daily accruaI of those fines
during this process woutd intensify and compound the economic burdens.

The soffit-retated permit was issued in May of 2025, the violation was determined to be
abated, and an affidavit of comptiance was issued.
The camera and lighting issues were minor in scope, non-structurat, inherited, and not
reasonabty discoverable, and the soffit matter was an unforeseeable satety emergency
addressed immediately to secure the property and protect tenants. Both were corrected in
fu[[ coordination with County staff, at K2's expense, with transparent documentation.

At the same time, it is important to note that att of the remedial measures-the camera,
tighting, and soffit-witt be mooted and superseded bythe major renovation work that wi[[
accompany the conversion.

on 09/08 for case CESD20230006969. We
encountered Carlos, who was working on
clearing up the debris in the parking lot.
Through an interpreter (Investigator Musse)
we were advised that the area was not
demolished, but had fallen down. We also
observed other areas in severe disrepair and
beginning to fail, as well as new LED lights
installed above second level all around
building (CESD20230007975 opened), and
wired security camera system installed
throughout building (CESD20230007977).
Carlos also put us on the phone with Mr.
Smith (239-776-0250) who advised he was
the manager. He also advised that the area
had fallen down and that they were cleaning
up and intended to repair the area. I advised
him of the assistant building officials
determination that a permit would be required
for the repairs and that we were posting a
Stop Work Order and that no work can be
done without the proper Collier County
Permits or Approvals. More conversation with
Carlos advised that a vendor would be by
later to make the repairs. Investigator Musse
reiterated that no work can be performed
without a permit. Carlos also stated that there
were still people living on the second floor, but
the occupants on the first floor were
relocated. We were escorted into unit 149
where we observed some cracks on the
ceiling, as well as a removed fire alarm from
the wall (Property Maintenance Case
CEPM20230007974 opened)
Stop work order posted at site as well as front
door of office. I also sent a request for a
Dangerous Building Determination for the
structure to Code Manager Letourneau.
Determination came back as not dangerous.
Case closed for conversion of hotel to
apartments, and this case opened to address
the repairs on the North side of building. Will
issue NOV.

the NOV process and let them know that I
would be delaying the NOV issuance until
September 27th - and will post on site and

that the stop work order continues to be in
