Ordinance 2026-04 ORDINANCE NO. 2026-_04 AN ORDINANCE'OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AMENDING CHAPTER 74 OF THE COLLIER COUNTY CODE OF LAWS AND ORDINANCES( THE "COLLIER COUNTY CONSOLIDATED IMPACT FEE ORDINANCE"); INCORPORATING BY REFERENCE THE FOLLOWING IMPACT FEE UPDATE STUDIES: "COLLIER COUNTY ROAD IMPACT FEE UPDATE STUDY"; "COLLIER COUNTY PARKS AND RECREATION IMPACT FEE UPDATE STUDY"; "COLLIER COUNTY CORRECTIONAL FACILITIES IMPACT FEE UPDATE STUDY"; "COLLIER COUNTY SCHOOL IMPACT FEE UPDATE STUDY"; "COLLIER COUNTY EMERGENCY MEDICAL SERVICES (EMS) IMPACT FEE UPDATE STUDY"; "COLLIER COUNTY LIBRARIES IMPACT FEE UPDATE STUDY"; "COLLIER COUNTY GOVERNMENT BUILDINGS IMPACT FEE UPDATE STUDY"; AND "COLLIER COUNTY LAW ENFORCEMENT IMPACT FEE UPDATE STUDY"; AMENDING IMPACT FEE RATE SCHEDULES ONE, THREE, FOUR, SIX, SEVEN, EIGHT, NINE, AND TEN OF APPENDIX A TO REFLECT THE UPDATED RATES AND PHASE-IN PERIODS ESTABLISHED IN THE RESPECTIVE STUDIES; PROVIDING FOR UPDATED DEFINITIONS; PROVIDING ADDITIONAL ELIGIBILITY REQUIREMENTS FOR PARTICIPATION IN IMPACT FEE PROGRAMS; PROVIDING IMPACT FEE STUDY UPDATE REQUIREMENTS; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE COLLIER COUNTY CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE OF FEBRUARY 1, 2026, FOR ALL RATE DECREASES, AND PHASED EFFECTIVE DATES OF MAY 1, 2026 (PHASE TWO), MAY 1, 2027 (PHASE THREE), MAY 1, 2028 (PHASE FOUR), AND MAY 1, 2029 (PHASE FIVE), IN ACCORDANCE WITH THE 90-DAY NOTICE REQUIREMENT SET FORTH IN SECTION 163.31801(4)(d), FLORIDA STATUTES. WHEREAS, Collier County uses impact fees to supplement the funding of necessary capital improvements required to provide public facilities to serve new population and related development that is necessitated by growth in Collier County; and WHEREAS, Collier County has used impact fees as a funding source for growth-related capital improvements for various facilities since 1978; and WHEREAS, on March 13, 2001, the Board of County Commissioners adopted Ordinance No. 2001-13, the Collier County Consolidated Impact Fee Ordinance, repealing and superseding Underlined text is added;Struck through text is deleted Page 1 of 100 all of the County's then existing impact fee regulations,and consolidating all of the County's impact fee regulations into that one Ordinance, codified in Chapter 74 of the Collier County Code of Laws and Ordinances (Code); and WHEREAS, on December 10, 2019, the Board of County Commissioners adopted Ordinance No. 2019-48 for the adoption of the Road Impact Fee Update Study thereby updating the current Road Impact Fee rates; and WHEREAS, on November 10, 2015, the Board of County Commissioners adopted Ordinance No. 2015-59 for the adoption of the Collier County Parks and Recreation Impact Fee Update Study thereby updating the current Collier County Community and Regional Parks Impact Fee rates; and WHEREAS, on February 10, 2015 and corrected on December 10, 2015, the Board of County Commissioners Ordinance No. 2015-17 for the adoption of the Collier County Correctional Facilities Impact Fee Update Study thereby updating the current Collier County Correctional Facilities Impact Fee rates; and WHEREAS, on November 10, 2015, the Board of County Commissioners adopted Ordinance No. 2015-60 for the adoption of the Collier County School Impact Fee Update Study thereby updating the current Collier County School Impact Fee rates; and WHEREAS, on April 25, 2017, the Board of County Commissioners adopted Ordinance No. 2017-13 for the adoption of the Collier County Emergency Medical Services Impact Fee Update thereby updating the current Collier County Emergency Medical Services Impact Fee rates; and WHEREAS, on April 25, 2017, the Board of County Commissioners adopted Ordinance No. 2017-13 for the adoption of the Collier County Library Facilities and Items/Equipment Impact Fee Update thereby updating the current Collier County Library Impact Fee rates; and WHEREAS, on April 25, 2017, the Board of County Commissioners adopted Ordinance No. 2017-13 for the adoption of the Collier County General Government Buildings Impact Fee Update Study thereby updating the current Collier County General Government Buildings Impact Fee rates; and Underlined text is added;Strat-R-throughtext is deleted Page 2 of 100 WHEREAS, on April 25, 2017, the Board of County Commissioners adopted Ordinance No. 2017-13 for the adoption of the Collier County Law Enforcement Impact Fee Update Study thereby updating the current Collier County Law Enforcement Impact Fee rates; and WHEREAS, on April 25, 2017, the Board of County Commissioners adopted Ordinance No. 2017-14 for the adoption of the annual indexing calculation, amending the rate schedules thereby updating the County's Correctional Facilities, Parks and Recreation and School Impact Fee rates; and WHEREAS, Collier County retained Alfred Benesch & Company to complete the Road Impact Fee Update Study; Parks and Recreation Impact Fee Update Study; Correctional Facilities Impact Fee Update Study; School Impact Fee Update Study; Emergency Medical Services (EMS) Impact Fee Update Study; Libraries Impact Fee Update Study; Government Buildings Impact Fee Update Study; and Law Enforcement Impact Fee Update Study; and WHEREAS, Alfred Benesch & Company has prepared the "Collier County Road Impact Fee Update Study," dated October 8, 2025; "Collier County Parks and Recreation Impact Fee Update Study," dated October 8, 2025; "Collier County Correctional Facilities Impact Fee Update Study," dated October 8, 2025; "Collier County School Impact Fee Update Study," dated January 31, 2025; "Collier County Emergency Medical Services (EMS) Impact Fee Update Study," dated October 8, 2025; "Collier County Libraries Impact Fee Update Study," dated October 8, 2025; "Collier County Government Buildings Impact Fee Update Study," dated October 8, 2025; and "Collier County Law Enforcement Impact Fee Update Study," dated October 8, 2025; and WHEREAS, the "Collier County Road Impact Fee Update Study"; "Collier County Parks and Recreation Impact Fee Update Study"; "Collier County Correctional Facilities Impact Fee Update Study"; "Collier County School Impact Fee Update Study"; "Collier County Emergency Medical Services (EMS) Impact Fee Update Study"; "Collier County Libraries Impact Fee Update Study"; "Collier County Government Buildings Impact Fee Update Study"; and "Collier County Law Enforcement Impact Fee Update Study" recommend changes to the rate schedules that provide for both rate reductions and rate increases; and Underlined text is added;Struck through text is deleted Page 3 of 100 WHEREAS, the proposed changes to the Road, Parks and Recreation, Correctional Facilities, School,Emergency Medical Services(EMS),Libraries, Government Buildings,and Law Enforcement impact fee rate schedules equitably distribute the costs of acquiring public facilities based upon a rational nexus relating costs incurred by fee payers to the infrastructure impacts created by residential and non-residential land uses; and WHEREAS, staff has thoroughly reviewed the calculations and findings and concurs with the results of the calculations and the studies; and WHEREAS, the calculations and studies have also been reviewed by Collier County's outside legal counsel of Nabors, Giblin &Nickerson, P.A.; and WHEREAS, staff recommends that the Board of County Commissioners adopt this Ordinance to implement the recommended changes; and WHEREAS, Section 163.31801, Florida Statutes, which is the Florida Impact Fee Act, requires that the most recent and localized data be used in impact fee calculations and these studies comply with that requirement; and WHEREAS, in accordance with Section 163.31801, Florida Statutes, all rate categories that are increasing have a 90-day delayed effective date in accordance with the notice requirements set forth in Section 163.31801(4)(d), Florida Statutes. Additionally, the minimum 90-day notice is not required for rate reductions; and WHEREAS, the new and/or replacement land use category rates and definitions will also become effective in accordance with the 90-day notice requirements. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Underlined text is added;Struck through text is deleted Page 4 of 100 SECTION ONE. Article I, General, Section 74-106,Adoption of impact fee studies, of the Collier County Code of Laws and Ordinances is hereby amended to read as follows: Section 74-106. Adoption of impact fee studies. The board hereby adopts and incorporates by reference the following studies with regard to the respective public facilities: (1) Transportation facilities: "Collier County Road Impact Fee Update Study," prepared by Tindale Oliver and Associates,Incorporated Alfred Benesch&Company(October 11,2019 October 8, 2025); *** (3) Parks and recreational facilities: "Collier County Parks and Recreation Impact Fee Update Study,"prepared by Tindale Oliver and Associates Alfred Benesch&Company(September 25, 2015 October 8, 2025); (4) Library facilities: "Collier County Library Facilities and Items/Equipment Impact Fee Update," prepared by Tindale Oliver and Associates, Inc. Alfred Benesch & Company (September 6, 2016 October 8, 2025); (5) Emergency medical services: "Collier County Emergency Medical Services Impact Fee Update," prepared by Tindale Oliver and Associates, Inc. Article I, General, Section 74-108, General definitions, of the Collier County Code of Laws and Ordinances is hereby amended to read as follows: Section 74-108. General definitions. When used in this chapter, the following teens shall have the following meanings, unless the context clearly indicates otherwise.Terms contained in article III or the rate schedules supercede these general definitions to the extent of any conflict(s). *** Car dealerships/new and used auto sales shall mean a land use providing for new or used automobile sales/leasing automobile mechanical services, automobile body repair, parts and sales. Used car Car sales, leasing options and truck sales and servicing may also be available. *** Convenience store with gas pumps shall mean convenience store which sells gasoline,convenience foods, newspapers, magazines, and often beer and wine. This land use includes convenience Underlined text is added;Struck through text is deleted Page 6 of 100 markets with gasoline pumps wherethe-primary-b-u-sthess--i-s-the-sel-thig-e-f-eertvethenc-e-itemsrpet the fueling of motor vehicles. This includes a service station with a convenience store that sells gasoline and convenience store items, with or without a car wash. *** Gas station with convenience market shall mean a gas station where the primary business is the fueling of motor vehicles and a convenience store that are co-located. The smaller convenience stores sell groceries and other everyday items that a person may need or want as a matter of convenience. Larger convenience store product mix typically includes pre-packaged grocery items, beverages, dairy products, snack foods, confectionary, tobacco products, over-the-counter drugs, toiletries, and at times, alcohol, coffee, pre-made sandwiches, made-to-order foods. Some stores offer limited seating. *** Living area shall mean actual square footage of the housing unit under air. Excluded from the calculation of the square footage are carports, attached garages, and porches that are not protected from weather. Both finished and unfinished basements are to be included. *** Mid-Rise Residential with First Floor Commercial shall mean development with first-floor commercial that are mixed-use multifamily housing buildings that have between tree four and ten levels (floors) residential living space and include retail space on the first level. *** Multifamily Housing (Low-Rise) shall mean apartments, townhouses and condominiums located within the same building with at least three other dwelling units and that have between one or two and three levels (floors). For the purpose of this chapter and assessment of impact fees, duplexes will also be considered under this definition. For the purpose of calculating water and/or sewer impact fee, the following shall be considered multiple-family dwelling units: guesthouse, servants' quarters, in-law apartment, townhouse and adult congregate living facility. Underlined text is added;Stfiric-k-thfe4g14 text is deleted Page 7 of 100 Multifamily Housing (Mid-Rise) shall mean apartments, townhouses and condominiums located within the same building with at least three other dwelling units and have between three four and ten levels(floors). For the purpose of calculating water and/or sewer impact fee, the following shall be considered multiple-family dwelling units: guesthouse, servants' quarters, in-law apartment, townhouse and adult congregate living facility. *** Tire superstore shall mean a land use primarily involved in the business of sales and marketing of repair, as well as other automotive maintenance or repair services and customer assistance. Theo stores generally do not contain large storage or warehouse areas. warehouse-like facility with the primary function of selling and installing tires for automobiles and small trucks. Other services may include automotive maintenance functions such as wheel alignment or shock and brake service, and customer services. *** SECTION THREE. Article V, Miscellaneous Provisions, Section 74-502, Update requirement, of the Collier County Code of Laws and Ordinances is hereby amended to read as follows: *** Sec. 74-502. - Update requirement. (a) This chapter and the impact fee studies shall be reviewed by the board initially in connection with its approval of the capital improvements element of its comprehensive plan as then, and to the extent, required by F.S. § 163.3177. This chapter and the impact fee studies should be reviewed in accordance with F.S 163.31801. at least every three years. All reviews shall consider new estimates of population and other socioeconomic data; changes in construction, land acquisition and related costs and adjustments to the assumptions, conclusions or findings set forth in the studies adopted by section 74-106. The purpose of this review is to evaluate and revise, if assure that they do not exceed the reasonably anticipated costs associated with the improvements and additions necessary to offset the demand on the public facilities generated by development. In the event the review of this chapter alters or changes the assumptions, conclusions and findings of the studies adopted by Underlined text is added;Struck through text is deleted Page 8 of 100 reference in section 74-106, revises or changes the public facilities, or alters or changes the amount of impact fees, the studies adopted by reference in section 74-106 shall be amended and updated to reflect the assumptions, conclusions and findings of such reviews; also section 74-106 shall be amended to adopt by reference such updated studies. *** SECTION FOUR. Article.II, Impact Fee, Section 74-201 Imposition of impact fees,of the Collier County Code of Laws and Ordinances is hereby amended to read as follows: *** (h) Impact Fee Installment Payment Pilot Program. *** (9) For purposes of this subsection the following conditions shall apply: a. A feepayer must be the legal owner of the property,or designated agent of the owner, and shall provide written and notarized proof of authorization from the owner when requesting to pay impact fees under this subsection; and b. The feepayer and/or owner must be current on property taxes on the subject property and any other real property owned in Collier County by feepayer and/or owner; and c. The feepayer and/or owner cannot be in bankruptcy nor can the property be an asset in any bankruptcy proceeding; and d. The subject property cannot be in foreclosure and cannot have any federal income tax lien,judgment lien or similar liens encumbering the property. e. This program shall be available only to entities that exclusively provide services to citizens of the United States or to lawful permanent residents thereof. Eligibility under this provision shall be demonstrated to the satisfaction of the County, and sufficient proof thereof shall be provided as a condition of participation in the program. SECTION FIVE. Appendix A,of Chapter 74 of the Collier County Code of Laws and Ordinances is hereby amended as set forth in the attachment to this Ordinance. In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions. SECTION SEVEN. INCLUSION IN THE CODE OF LAWS AND ORDINANCES. The provisions of this Ordinance shall be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-lettered and internal cross-references amended throughout to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION EIGHT. EFFECTIVE DATE. This Ordinance shall be considered adopted upon the date written below and subject to filing with the Florida Department of State; however, for administrative purposes the effective date for all rate schedule decreases shall be February 1, 2026 and the effective date for all rate schedule increases, new and/or replacement land use category rates shall be delayed to May 1, 2026, for phase one; May 1, 2027, for phase two; May 1, 2028, for phase three; and May 1, 2029, for phase four in accordance with the notice requirements set forth in Section 163.31801(4)(d), Florida Statutes.
