Executive Summary
Request that the Board set the balloting date for the recommendation of members to the Pelican Bay Services Division
Board by record title owners of property within Pelican Bay.
OBJECTIVE: To set the balloting date for mail ballots for applicants seeking membership on the Pelican Bay Services
Division Board.
CONSIDERATIONS: This eleven-member Board was established by Ordinance 2002-27 as amended. The Division
provides landscaping services, including all public road maintenance and park areas, street lighting services, aquatic
management services, beach cleaning, and the Clam Bay Restoration Project. It is the Division’s responsibility to
provide the framework of long-term community planning so that residents can enjoy the benefits of Pelican Bay while
ensuring both the social and financial well-being of the Pelican Bay Community. A list of the current membership is
included in the backup.
The terms for Jacob Damouni (commercial/business), Peter Griffith (resident), Richard Swider (resident) and Bradford
Hildebrandt (non-voting), will expire on March 31, 2026. A press release was issued on December 9, 2025, and
applications were received from the following:

Code of Laws Section 122-1662(c) states that the Board of County Commissioners shall publish the list of nominees and
the positions on the Committee for which they have been nominated and deliver a conformed copy to the Clerk of
Courts. The Clerk shall cause the name of each nominee as reported and published by the Board of County
Commissioners to be included on the mail ballot, which ballot shall be mailed to all the non-governmental property
owners of the class (i.e. “Residential or Commercial/Business/Other”) corresponding with the class for which the
balloting is occurring (“Residential or Commercial/Business/Other”) within the Unit no less than thirty (30) days prior
to the balloting date. The Board of County Commissioners will set the balloting date.
The Pelican Bay MSTBU Ordinance provides that “if the number of nominees for the position which they have been
nominated (i.e., for the "residential interests" or for the "commercial/business/other interests") does not exceed the
number of open members for that position, then there shall be no balloting for such position. Instead, the list of
nominees for the position shall simply be forwarded to the Board of County Commissioners, who, following public
hearing on the matter, will make the necessary appointments to fill said positions.” Since the number of
candidates/applicants for the Commercial/Business position does not exceed the number of vacancies, the election for
this category will not be included.
THE BALLOTING DATE RECOMMENDED BY THE CLERK IS: Friday, March 6, 2026
FISCAL IMPACT: Funding of approximately $14,145 is available within the Pelican Bay MSTBU Fund (1007) and
Pelican Bay Street Lighting Fund (1008) for ballot preparation, printing, postage, and tabulation.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.

Pelican Bay Services Division Board
This 11 member Board was established by Ordinance 2002-27, as amended, to provide input to
the Board of County Commissioners in carrying out the purposes of the Pelican Bay Municipal
Service Taxing and Benefit Unit as set forth in the Ordinance; to recommend to the BCC an
itemized budget, work programs, and priorities in accordance with the adopted budget or budget
amendments. The Board will exercise decision and control of the day to day operational affairs
of the Unit to the maximum extent allowed by law, unless and except when there is some
overriding governmental reason to do otherwise. Membership shall include 9 representatives of
the residential interests within the Unit and 2 representatives of the commercial & business
interests within the Unit, and shall also include one non-voting member recommended for
appointment by the Pelican Bay Foundation. Terms are 4 years.

RESOLUTION NO. 2026 - ___
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, DESIGNATING NOMINEES FOR
APPOINTMENT TO FILL THREE (3) EXPIRING TERMS ON THE
PELICAN BAY SERVICES DIVISION BOARD AND CONFIRMING A
BALLOTING DATE OF MARCH 6, 2026.
WHEREAS, Collier County Ordinance No. 2002-27, created the Pelican Bay Municipal
Service Taxing and Benefit Unit, superseding and repealing prior Pelican Bay Municipal Service
Taxing and Benefit Unit Ordinances; and
WHEREAS, Ordinance No. 2002-27, as subsequently amended, provides for the creation
of the Pelican Bay Services Division Board, specifies the composition of said Advisory Board,
and sets forth the process for nomination and appointment of its members; and
WHEREAS, all members of this Advisory Board are appointed by and all vacancies are
filled by the Board of County Commissioners; and
WHEREAS, on March 31, 2026, there will be two vacancies on this Advisory Board
representing “residential interests,” and one vacancy representing “commercial/business
interests;” and
WHEREAS, Ordinance No. 2002-27, as amended, provides for public announcement and
advertisement of all current vacancies on this Advisory Board and that timely applications for
appointment shall be considered nominees for appointment to fill said vacancies; and
WHEREAS, pursuant thereto, six residents and one representative of businesses in Pelican
Bay have applied for the pending vacancies; and
WHEREAS, at its January 27, 2026 regularly scheduled meeting, the Board of County
Commissioners acted to set the balloting date for the recommendation of members to the Pelican
Bay Services Division Board by the record title owners of property within the Pelican Bay
Municipal Service Taxing and Benefit Unit.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that
1. Dave Cook, Roanna Handy, Bradford Hildebrandt, Henry Lesher, Danielle Sherwood
and Trenton Waterhouse have applied for nomination for appointment to the vacancies
referenced herein representing “residential interests.”
2. The balloting date for the nominees referenced herein for the expiring terms described in
this Resolution is and shall be March 6, 2026.

3. As Jacob Damouni was the only applicant for the commercial/business interests, his
application will be forwarded to the Board of County Commissioners for appointment.
4. Of the six applicants for the “residential interests” vacancies, the two candidates with the
highest number of votes shall be appointed to the residential seats to terms expiring on
March 31, 2030.
THIS RESOLUTION ADOPTED after motion, second and majority vote favoring same,
this 27th day of January 2026.
