Resolution 2026-16 RESOLUTION NO. 2026 -1 6 A RESOLUTION OF THE BOARD OF ZONING APPEALS OF COLLIER COUNTY, FLORIDA PROVIDING FOR THE ESTABLISHMENT OF A CONDITIONAL USE TO ALLOW FOR EXPANSION OF THE COUNTY'S FLEET MAINTENANCE OPERATIONS ON 5.18± ACRES OF PROPERTY WITHIN THE PUBLIC USE (P) ZONING DISTRICT PURSUANT TO SECTION 2.03.05.A.4.c.8 OF THE COLLIER COUNTY LAND DEVELOPMENT CODE, ON PROPERTY LOCATED ON THE EAST SIDE OF COUNTY BARN ROAD, EAST OF THE EXISTING ISLAMIC CENTER, IN SECTION 8, TOWNSHIP 50 SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA. (PL20250001789) WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of Florida, and Chapter 125, Florida Statutes, has conferred on Collier County the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (Ordinance No. 2004-41, as amended) which includes a Comprehensive Zoning Ordinance establishing regulations for the zoning of particular geographic divisions of the County, among which is the granting of Conditional Uses; and WHEREAS, the Board of Zoning Appeals (BZA), being the duly appointed and constituted planning board for the area hereby affected, has held a public hearing after notice as in said regulations made and provided, and has considered the advisability of a Conditional Use for expansion of the County's Fleet Maintenance Operations on lands zoned Public Use (P) pursuant to Section 2.03.05.A.4.c.8 of the Collier County Land Development Code on the property hereinafter described, and the Collier County Planning Commission has made findings that the granting of the Conditional Use will not adversely affect the public interest and the specific requirements governing the Conditional Use have been met and that satisfactory provision and arrangement have been made concerning all applicable matters required by said regulations and in accordance with Subsection 10.08.00.D. of the Land Development Code; and WHEREAS, all interested parties have been given opportunity to be heard by this BZA in a public meeting assembled and the BZA having considered all matters presented. NOW, THEREFORE, BE TT RESOLVED BY THE BOARD OF ZONING APPEALS OF COLLIER COUNTY,FLORIDA that: Petition Number PL20250001789 filed by D. Wayne Arnold, AICP of Q. Grady Minor and Associates, LLC, with respect to the property hereinafter described in Exhibit A, be [25-CPS-02641/198779111]47 County Barn Rd Maintenance Facility Expansion 1 of 2 PL20250001789 11/25/25 and the same is hereby approved for a Conditional Use to allow for expansion of the County's Fleet Maintenance Operations on lands zoned Public Use (P)pursuant to Section 2,03,05.A.4.c.8 of the Collier County Land Development Code, in accordance with the Conceptual Site Plan described in Exhibit B and subject to the Conditions of Approval in Exhibit C. Exhibits A, B and C are attached hereto and incorporated herein by reference. The effective date of this Resolution is the effective date of Ordinance No. 2026- 0 3 for the companion rezone PL20250001788. BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of the Board of Zoning Appeals. Lighting shall be dark sky compliant (flat panel, full cut off fixtures— backlight, uptight and glare(BUG)rating where U=0)to avoid light spill onto adjacent properties. The site light poles shall not exceed a 25-ft mounting height. 2. Vehicle maintenance activities shall be conducted primarily within covered building areas; however,it is understood that outdoor testing for vehicles and equipment may occur outdoors. 3. Vehicle and equipment maintenance activities shall only be permitted between the hours of 6:00 a.m.to 8:00 p.m.daily,except during emergency events. 4. County Barn Road Fleet Maintenance Facility Expansion Rezone shall be limited to what is depicted on the Rezone and Conditional Use Site Plan,revised September 12, 2025, prepared by Q.Grady Minor and Associates,LLC. 5. The maximum total daily trip generation for the CU shall not exceed 64 two-way PM peak hour net trips based on the use codes in the ITE Manual on trip generation rates in effect at the time of application for SDP/SDPA or subdivision plat approval.This trip cap will only be applied to the northern 5+/-acre addition and applied only to those land uses that will be constructed on the subject parcel.The existing southern and contiguous 10+/-acre parcel that was previously developed by Collier County Government and may be redeveloped or have additional uses constructed on the property are not subject to a trip cap.
