COMMISSIONERS OF COLLIER COUNTY, FLORIDA TO
DECLARE A PUBLIC HEARING FOR CONSIDERATION OF
PETITION VAC-PL20120002603 TO DISCLAIM, RENOUNCE
AND VACATE THE COUNTY AND PUBLIC INTEREST IN
VACATING ALL OF PRESERVE P-6 AND A PORTION OF
PRESERVE P-8, AS RECORDED IN OFFICIAL RECORD BOOK
2406, PAGES 0549 THROUGH 0589 OF THE PUBLIC RECORDS
OF COLLIER COUNTY, FLORIDA; ALL OF
PRESERVE/REPLANT AREAS PA94, PA95 AND A PORTION OF
PRESERVE/REPLANT AREAS PA96 AND PA102, BEING A PART
OF TRACT 8 OF VANDERBILT COUNTRY CLUB - 2, PLAT
BOOK 32, PAGES 42 THROUGH 55 OF THE PUBLIC RECORDS
OF COLLIER COUNTY, FLORIDA; AND A PORTION OF
PRESERVE/REPLANT AREAS PA96 AND PA102, BEING A PART
OF TRACT FD10 OF VANDERBILT COUNTRY CLUB - 2, PLAT
BOOK 32, PAGES 42 THROUGH 55 OF THE PUBLIC RECORDS
OF COLLIER COUNTY, FLORIDA, MORE SPECIFICALLY
SHOWN IN EXHIBIT"A."
WHEREAS, Petitioner, Mark McCleary, has requested that a public hearing be held
pursuant to Sections 125.01, 125.37 and 177.101, Florida Statutes, and Resolution No. 2006-160,
to consider disclaiming, renouncing and vacating the County and Public interest in all of
Preserve P-6 and a portion of Preserve P-8 as recorded in Official Record Book 2406, Pages
0549 through 0589 of the Public Records of Collier County, Florida, all of Preserve/Replant
areas PA94, PA95, a portion of Preserve/Replant areas PA96 and PA102, being a part of Tract 8
in Vanderbilt Country Club - 2, Plat Book 32, Pages 42 through 55 of the Public Records of
Collier County, Florida, and a portion of Preserve/Replant areas PA96 and PA102, being a part
of Tract FD 10 in Vanderbilt Country Club - 2, Plat Book 32, Pages 42 through 55 of the Public
Records of Collier County, Florida, more specifically described in Exhibit "A," attached hereto;
and
WHEREAS, Petitioner does hereby request that the Board of County Commissioners
take appropriate action including the adoption of a resolution setting the date and time of a public
hearing to consider disclaiming, renouncing and vacating the County's interest in the above
described Easements.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that pursuant to Sections 125.01,
125.37, and 177.101, Florida Statutes, and Resolution No. 2006-160 in a regular session of the
Board of County Commissioners, a public hearing to consider disclaiming, renouncing and
vacating the County's interest in the above described easements will be held on the 12th day of
March, 2013 at 9:00 a.m., or as soon thereafter as practical, in the Boardroom, 3`d Floor,
Administration Building, Collier County Government Center, 3299 Tamiami Trail East, Naples,
Florida.

THIS RESOLUTION ADOPTED after motion, second and majority vote favoring same,
this 12th day of February, 2013.
