Resolution 1979-165 October 30, 1979 RESOLUTION NO.79-165 A RESOLUTION REQUESTING THE. DIVI- SION OF MARINE RESOURCES OF THE DEPARTMENT OF NATURAL RESOURCES, STATE OF FLORIDA, TO ESTABLISH CER- • TAIN AREAS WITHIN THE NAVIGABLE WATERWAYS OF COLLIER COUNTY, FLORIDA, AS RESTRICTED ZONES FOR THE PURPOSE OF REGULATING BOAT SPEEDS AND WAKES IN SUCH AREAS. WHEREAS, the Board of County Commissioners of Collier County, Florida, has passed Ordinance 79-8, the Collier County Vessel Control •.� Ordinance, for the u p cpose of promoting safety in the operation of Ivessels on waterways within Collier County, and to prevent injuries or property damages caused by the negligent operation of such vessels; and WHEREAS, said Ordinance provides that the Board of County Com- missioners may, by Resolution, adopt at a public hearing upon at least fifteen (15) days notice of such hearing published in r newspaper of general circulation in Collier County, Florida, designated areas as "No • Wake-Idle Speed Only" areas, and WHEREAS, in an effort to reduce boat and property damage resulting from excessive boat wakes, it is deemed advisable that certain navigable waterways and heavily traveled channels be designated as restricted areas for the purpose of placing such regulatory markers therein; and WHEREAS, the required advertisement has been accomplished; And WHEREAS, FS 371.522 requires that after designation of said arras by the governing body of the County, application be made to the Depart- ment of Natural Resources for the establishment of said restricted areas; and WHEREAS, upon the establishment of the restricted areas by the Division of Marine Resources of the Department of Natural Resources, the • • Board of County Commissioners of Collier County will accept responsibil- ity for placement and maintenance of regulatory markers, NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Collier County, Florida that; 1. The areas described as the following, and as shown on maps (reproduction of sections of U. S. Department of Commerce. (Exhibit "A") b.. Goodland; from red marker "6" proceeding in a northerly direction curving into a westerly direction to red marker "10" as shown on U.S. Department of Commerce Nautical Chart 11430. (Exhibit "A") c. Smoke House Bay Canal; from red marker "8" proceeding • - southerly to the entrance of Smoke House Bay, as shown on U.S. Department of Commerce Nautical Chart 11430. (Ex- hibit "B") , d. Isles of Capri; the passage between Isles of Capri sub- division and the south side of Stingaree Island as shown on U. S. Department of Commerce Nautical Chart 11430. (Exhibit "B") e. Villa De Marco to Snook In❑ in Isles of Capri Pass; from red marker "10" and proceeding easterly and southerly to green marker "11" as shown on U.S. Department of Commerce Nautical Chart 11430. (Exhibit "B") 4 f. Rock Creek; from entrance of Brookside subdivision to Airport Road, (SR 858) as shown on U.S. Department of Commerce Nautical Chart 11430. (Exhibit "C") g. Vanderbilt Waterway; from bridge to La Playa Inn from concrete bridge at SR 846 southerly to the mouth of Vanderbilt Bay, as shown on U.S. Department of Commerce � I Nautical Chart 11430. (Exhibit "C") h. Gulf Harbor; all waterways within the subdivision of Gulf Gabor as shown on U.S. Deparment of Commerce Nautical Chart 11430. (Exhibit "C") 2. That the Division 6f Marine Resources of the Department of Natural Resources be and hereby is requested to establish those described areas as restricted to zones; for the purpose of placing "No Wake-Idle Speed Only" markers in such areas. 3.
