Amending Resolution 2011-190 RESOLUTION NO. 2011- 190 A RESOLUTION SUPPLEMENTING AND AMENDING RESOLUTION NO. 2008-353 AUTHORIZING THE CONDEMNATION OF LAND AND EASEMENTS NECESSARY FOR THE CONSTRUCTION OF ROADWAY, DRAINAGE AND UTILITY IMPROVEMENTS REQUIRED FOR THE EXPANSION OF COLLIER BOULEVARD FROM GREEN BOULEVARD TO GOLDEN GATE BOULEVARD, INCLUDING PORTIONS EAST ON WHITE BOULEVARD AND WEST ON PINE RIDGE ROAD (PROJECT NO. 68056). WHEREAS, the acquisition of right-of-way for the expansion of Collier Boulevard from four to six lanes from Green Boulevard to Golden Gate Boulevard, including portions east on White Boulevard and west on Pine Ridge Road, (Project No. 68056) (hereinafter referred to as "the Project"), is included in Collier County's Five Year Transportation Work Program; and WHEREAS, plans and specifications have been prepared for construction of the Project; and WHEREAS, on December 2nd, 2008 the Board adopted Resolution No. 2008-353 authorizing the condemnation of land and easements necessary for the construction of the Project; and WHEREAS, since adoption of foresaid resolution, certain right-of-way parcels have been acquired and Project design changes have resulted in revisions to other parcels and the addition of three new parcels required for construction of the Project; and WHEREAS, the location for the construction of the proposed improvements has been fixed by survey and is collectively represented by the legal descriptions comprising Exhibit "A" attached hereto and incorporated herein, being all right-of-way parcels yet to be acquired; and WHEREAS, after consideration of the availability of alternate routes and locations, the comparative costs of the project alternatives, various impacts upon the environment, long range planning options, and public safety considerations, the Board desires to exercise its right to condemn property for public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the Board that it is necessary and in the public's best interest to acquire the property described in Exhibit "A" (the "Property") for the purpose of constructing the improvements proposed for the expansion of Collier Boulevard from Green Boulevard to Golden Gate Boulevard, including portions east on White Boulevard and west on Pine Ridge Road, in order to protect the health, safety and welfare of the citizens of Collier County. AND IT IS FURTHER RESOLVED that the acquisition of the Property and construction of the Project upon the Property is an integral part of the County's long range planning effort, and is included in the Capital Improvement Element of the Collier County Growth Management Plan. AND IT IS FURTHER RESOLVED that the Board has reviewed the staff reports and heard the presentation concerning alternative locations for the Project, various impacts to the environment, public safety and welfare considerations associated with the design and construction of the Project, and the costs associated with the design, property rights acquisition, and construction of the Project; and the Board finds that after consideration of these issues, the most feasible location for construction of the proposed improvements is collectively represented by the legal descriptions comprising Exhibit "A" attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that the taking ofthe perpetual, non-exclusive Slope Easements will provide County with the right construct, operate and maintain earthen fill slopes and to place and/or excavate materials for such purpose. AND IT IS FURTHER RESOLVED that the taking of the Temporary Driveway Restoration Easement will provide County with the right to reconstruct a driveway apron so that the existing driveway will transition from its current elevation to the elevation of the new pavement, and to place and/or excavate materials for such purpose. AND IT IS FURTHER RESOLVED that the taking of the Temporary Construction Easements will provide County with the right to construct roadway, bikepath, sidewalk, drainage and utility facilities within the public right-of-way immediately adjacent thereto. AND IT IS FURTHER RESOLVED that the real estate interests described in Exhibit "A" attached hereto are necessary for the construction of the Project improvements affected by design changes. AND IT IS FURTHER RESOLVED that all of the property shall be put to public purposes. AND IT IS FURTHER RESOLVED that the County staff and Office of the County Attorney are hereby authorized and directed to immediately acquire by gift, purchase or condemnation in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, -Page 2- the real property interests more particularly described in Exhibit "A", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that no mobile homes are located on the property sought to be acquired and therefore it will not be necessary to remove any mobile homes from the property to be acquired.
