Ordinance 72-01 No. 72 - 1 AN ORDINANCE CREATING THE COLLIER COUNTY LIGHTING DISTRICT IN COLLIER COUNTY, FLORIDA, PROVIDING FOR T~E GOVERN- ING BODY OF SAID DISTRICT: PROVIDING FOR ~UDOETARY PROCEDURE: PROVIDING THE POWERS AND DUTIES OF THE GOVERNING BODY OF SAID DISTRICT: PROVIDING THE GEOGRAPHICAL BOUNDARIES OF THE DISTRICT: AND PRO- %rIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION 1. All that land located in Collier County, Florida, and specifically described as: A. Unit 2, Plat Book 10, Page 80, Public Records of Collier County, Florida; WESTIAKE,_Unit 1, as recorded in Plat Book 10, Page 87, Public Records of Collier County, Florida; RIVIERA COLONY, as recorded in Plat Book 8, Pages 17 - 18 inclusive, Public Records of Collier County, Florida; GOLDE~ GATE, Unit 1, Part 1, aa recorded in Plat BOoM 9, Pages 100 - 101 inclusive, Public Records of Collier County, Florida; GOLDE~ GA_TS, Unit 1, as recorded in Plat Book 5, Pages 60 - 6~ inclusive, Public Records of Collier County, Florida; GOLDE~ GATE, Unit 2. COLLIER COUNTY LIGHTING DISTRICT, hereinafter called the "District". SECTION 2. The governing body of the District shall be ex officio the Board of County Commissioners of Collier County, Florida. SECTION 3. The District is formed for the purpose of provid- in~ street lighting in the above described subdivisions and to that. end shall possess all the powers to do all things reasonably necessary to provide such services, including ownership of property, poles, wires, conduits, lights, meters, and the power to maintain the same .--~ ' current., to operate 2ECTION ~. For the purpose of carrying into effect this Ordin~nce, the Boardoff County Commissioners shall annually, at the time required by gener~l'bud~gt&ry,l&w~ make ~n itemized estimate of the amount of money required to harry out the business of the District for the next fiscal year, which'shall be from October 1 to ~nd including September"30 following. The estimate shall have for what purpose the monies are required and the amount necessary to be raised by taxation within the District. At the time and place for fixing'~ a~nual rat~ of taxation..~or county purposes, the Board shall ~L~and cause to' be levied o~ all property within the District sub~e~t to taxation a millage suffflcient to meet the requirements of th~ ~stimate; provided, however, the total millage shall not exceed one (1) mill. SECTION ~. Taxes herein provided for shall be assessed and collected in the same manner and form as provided for the assessment and collection of general county taxes and subject to the same flees for assessing and collecting as general county taxes. SECTION ~. This Ordinance supersedes Ordinance creating the Poinciana Village Lighting District in Collier County, Florida, and by passage of this Ordinance the Poinciana Village Lighting District is merged into the COL~IER COU~fLI~HTINO DISTRICT. Therefore, t~e passage of this Ordinance will automatically repeal Ordinance 71-~ creating the Poincian~ Village Lighting District, without any further action of the Board of County Commissioners of Collier County, Florida.
