Ordinance 73-26OnDI. CE NO. AN EMERGENCY ORDINANCE PROIIIBITING DRUNKENNESS FROM TIlE VOLUNTARY USE OF INTOXICATING LIQUORS OR DRUGS; PROVIDING PENALTIES; AN EFFECTIVE DATE AND A TERMINATION DATE, DE IT ORDAINED BY ~tE BOARD OF COUNTY COMMISSIONERS COLLIER COUNt%', FLORIDA: SECTION ONE: Whoever shall be or become drunk from the voluntary use of intoxicating liquors or drugs shall be guilty of a misdemeanor of the second degree, punishable as provided in Florida Statutes 775.082 or 775.083; but no prosecution shall be instituted after six months after the commission of the offense. SECTION ~0: This Ordinance shall become effective upon adoption by the Board of County Commissioners of Collier County, Florida. SECTION ~{REE: This Ordinance shall stand repealed and without force and effective on October 1, 1974, the effective date of Florida Statute 396.161. SECTION FOUR: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason held invalid or uncons'titutional by any court of competent Jurisdiction, such portion shall be deemed a separate, d~stinct and independent provision and such holdinj shall not affect the validity of the remaining portion hereof. SECTION FIVE: In tho event this Ordinance conflicts with other applicable law, the more restrictive shall apply. If any part of this Ordinance conflicts with any part, it shall bo severed and the remainder shall have the full force in effect and be liberally construed. SECTION SIX: · Be it declared that an emergency exists and tho immediate enactment of this Ordinance is necessary, therefore, notice requiremen%s are waived and this Ordinance shall take effect immediately upon its placement in the United States mail to the Secretary of State.
