Ordinance 75-47 WBEREAS, the Immokalee Area Planning Commission petitioned the Board of County Commissioners of Collier County, Florida, to change the Zoning Classification of the real property hereinafter described. NOW,THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA~ SECTION ONE: 1, The Zoning Classification of the hereinbelow described real property in Collier County, Florida, is changed from "I-C-2" Commercial to "I-MF-i" Single & Multi-Family District, and the Official Zoning Atlas within the Immokalee Area Planning District described in Ordinance No. 74-14 designated as Exhibit "A" is hereby amended accordingly: The N% of the NEb of the NEb, excepting the East 200 feet, but including all of Pine Grove Subdivision in Section 9, Township 47 South, Range 29 East. SECTION TWO: 1. Penalty: A violation of any provision of this Ordinance is a misdemeanor and shall be prosecuted in the name of the State in the County Court by the Prosecuting Attorney, and upon conviction shall be punished by a fine not to exceed $500.00 or by imprisonment in the County Jail not to exceed sixty (60) days, or both such fine and imprisonment. Each violation and each day a violation continues shall constitute a separate offense. The Board of County Commissioners' shall have the power to collaterally enforce the provisions of this Ordinance by appropriate Judicial Writ or proceeding notwithstanding any prosecution as a misdemeanor. 2. Conflict: In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. This Ordinance shall not apply in any municipality within Collier County unless the municipality adopts a resolution or takes other official action requesting that the County enforce this Ordinance within the limits of its municipal urisdiction. 4 OF OF NEb E×CEPTZNG EAST 200% FEET BUT INCLUDING ALL OF PINE GROVR SU~DZVISZON~ FROM I-C-2 COS~ERCIAL TO "I-MF-i" SINGLE AND MULTI-FAMILY DISTRICT AND PROVIDING AN EFFECTIVE DATE: 3. Severance: If any phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competentm= jurisdiction, such portion shall be deemed a separate, distincb, and independent provision and such holding shall not affect the validity of the remaining portion. 4. Liberal Construction: The provisions of this Ordinance shall be liberally consttued to effectively carry out its purposes in the interest of the public health, safety, welfare and convenience. 5.
