County, Florida, petitioned the Board of County Commissioners
of Collier County, Florida, to change the Zoning Classification
of the real property hereinafter described.
NOW, TIIEREFORE BE IT ORDAINED BY TIlE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
1. The Zoning Classification of the hereinbelow described
real'property in Collier County, Florida, is changed from "RM-2"
Residential Multi-Family District to "GC" Golf Course District
and the Official Zoning Atlas as referred to in Section 4 of
Ordinance No. 74-42 and No. 75-24 is hereby amended accordingly:

to the left, a distance of 251.49 feet to a point of inter-
se,trion with another curve, the aforementioned cux'v~' having a

feet bearing N 0o 31' 10" W; thence run eamterly along the arc
of another curve to the left, a di---tanco of 161.84 feet to
the Point of Beginning, ~aid curve having a radius of 1587.85
feet, a delta of 5° 50' 26", a chord of 161.77 feet bearing
N 67° 59' 53" E, and paid tract of land containing 2.9967
acres moro or leas.
1. Penalty. A violation of any. provision of this Ordinance
.is a misdemeanor and shall be prosecuted in the name of the State
in the County Court by the Prosecuting Attorney, and upon conviction
shall be punished by a fine not to exceed $500.00 or by imprisonment
in the County Jail not to exceed sixty (60) days, or by both such
fine and imprisonment. Each violation and each day a violation
continues shall consSitute a separat~ offense. The Board of
County Commissioners shall have the power to collaterally enforce
the provisions of this Ordinance by appropriate Judicial Writ
or proceeding notwithstanding any prosecution as a misdemeanor.
2. Conflict. In the event this Ordinance conflicts with any
other ordinance of Collier County or o~her applicable law, the
more restrictive shall apply. This Ordinance shall not apply
in any municipality within Collier County unless the municipality
adopts a resolution or takes other Official action requesting
that the County enforce this Ordinance within the limits of its
municipal jurisdiction.
3. Severance. If any phrase or portion of this Ordinance is
for any reason held invalid or unconstitutional by any court
of competent Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
4. Liberal Construction. The provisions of this Ordinance
shall be liberally construed to effectively carry on its purposes
:n the interest of the public health, safety, welfare and convenience.
5. Effective Date: This Ordinance s'hall take effect upon
receipt of notice that it has been filed with the Secretary of
State.
