Ordinance 75-42 OI1DINANC~ NO. 75- AN ORDINANCE AMENDING COLLII':R COUNTY ORDINANCE NO. 74-42 and 75-24 'I'IIE COMP~HENSIVE ZONING REGULATIONS FOR TIlE UNINCORPO~TED AREA OF TIIE COASTAL AREA PLANNING DISTRICT AMENDING SECTION 23 "~-2" RESIDENTIAL MULTI-FAMILY DISTRICT BY ADDING PA~GRAPH 13 EXCEPTIONS; MODIFYING MINIMUM LOT AREA; MINIMUM LOT WIDTI[; AND MINIMUM YARD ]~QUIREMENT FOR NON-CONFO~ING "RM-2" LOTS P~TTED AND RECORDED PRIOR TO OCTOBER 14, 1974, AND PROVIDING AN EFFECTIVE DATE: WIIEREAS, The Coastal Area Planning Commission petitioned the Board of County Commissioners of Collier County, Florida, to amend the Comprehensive Zoning Regulations for the Unincorporated Areas of the Coastal Area Planning District as hereinafter described. NOW, THEREFORE BE IT ORDAINED BY TIlE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: 1. The Comprehensive Zoning Regulation for the Unincorporated Area of the Coastal Area Planning District, is amended as hereinbelow described and Ordinance No. 74-42 ~nd 75-24 is hereby amended accordingly: Section 23.P~M-2 Re. sldeDtial Multi-F. amil. y District By adding Paragraph: 13. Exceptions: Non-conforming ~I-2 lots within platted ~'Bbdivisi0ns approved by the Board of County Commission and recorded with the Clerk of the Circuit Court prior to October 14, 1974, shall be subject to the following standards: A. Minimum Lot Area: In according with the ~or~d ~lat. B. Mi~'imum Lot W'id~h: In according with the°_~co~ed-~at. C. Mih'imum Yard Requirements: (i) Front - 30 feet plus one foot for oa~2 ~__~t! - of building height over 45 feet. of building height over 45 feet. (3) Rear - 25 feet plus one foot for ea~ of building height over 45 feet. (4) Gulf Front - See Coastal Constructi~Se~c~ Line. (5) All other requirement~ - a~ set for~tn section. ' SECT/ON TWO: 1. Penalty. A violation of any provision of this Ord~ce~ a misdemeanor and shall bo prosecuted in the name of tho State in the County Court by the Prosecuting Attorney, and upon conviction shall be punSshed by a fine not to exceed $500.00 or by imprisonment in the Cour. ty Jail not to exceed sixty (60) days, or by both such 'fine and imprisonment. Each vi61ation and each day a violation continues shall constitute a separate offense. The Board of County Commissioners shall have the power to collaterally enforce the provisions of this Ordinance by appropriate Judicial Writ or proceeding notwithstanding any prosecution as a misdemeanor. .' 2. Conflict. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. This Ordinance shall not apply in any municipality within Collier County unless the'municipality adopts a resolution or takes other official adrien requesting that 'the County enforce this Ordinance within the limits of its municipal jurisdiction. ~. Severance. If any phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. 4. Liberal Construction. The provisions of this Ordinance shall be liberally construed to effectively carry out its purposes in the interest of the public health, safety, welfare and convenience. 5.
