U 628 60i AN ORDINANCE A/4ENDING COLLIER COUNTY ORDINANCE NOS. 74-42 AND 75-24 THE COMPRE~ENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF THE COASTAL AREA PLANNING DISTRICT OF COLLIER COUNTY AMENDING SECTION 14 PROVISIONAL USES BY ADDING PARAGRAPH 5; PROVISIONAL USES %~HICH }L%S BEEN APPROVED BY THE BOARD OF COUNTY COMMISSIONERS FOR SCHOOL, RELIGIOUS OR ELEEMOSI~NARY PURPOSES SHALL BE EXEMPT PROM THE PROVISIONS OF SECTION 14 AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Coastal Area Planning Commission, of Collier County Florida, petitioned the Board of County Commissioners of Collier County, Florida, to amend Collier County Ordinance Nos. 74-42 and 75-24 as hereinafter described. NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: The Comprehensive Zoning Regulations for the unincorporated area of the Coastal Area Planning District of Collier County, Florida, and Ordinance Nos. 74-42 a~d 75-24 are amended as hereinafter described. SECTION 14 PROVISIONAL USES - Add Paragraph 5 as follows: 5. .PROVISION. AL.USES FOR. SCHO.O.L, RE.L..IGI.OUS. OR ELEEMOSYNARY PURPOSES: A' use WhiCh has be'6h approved bY the Board of County Commissioners for school, religious or eleemosynary purposes ~hall be exempt from the provisions of Section 14; if ~nd by the Board to comply with Suction 39~ and all other zoning requirements of 1~ SECTION TWO: penalty - A violation of any provisions of this Or~an~ is a misdemeanor and shall be prosecuted in the name of the State in the County Court by the Prosecuting ~ttorney, and upon conviction shall be punished by a fine not to exceed $500.00 or by imprisonment in the County Jail not to exceed sixty (60) days, or both such fine add imprisonment. Each violation and each day a violation continues shall constitute a separate offense. The Board of County Commissioners shall have the power'to collaterally enforce the provisions of this Ordinance by appropriate Judicial Writ or proceeding notwithatandin¢ any prosecution as a misdemeanor. Conflict - In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the moro restrictive shall apply. This Ordinance shall not apply in any municipality within Collier County ~nless the municipality adopts a resolution or takes other official action requesting that the County enforce this Ordinance within the limits of its municipal jurisdiction. Severance - If any phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remainipg portion. Liberal Construction - The provisions of this Ordinance shall be liberally construed to effectively carry out its purposes in the interest of the public health, safety, welfare and convenience. Emergency - BE IT DECLARED that the immediate enactment of this Ordinance is necessary, therefore, notice requirements are waived and this Ordinance shall.take effect immediately upon its placement, by registered mail, in the United States Mail to the Secretary of State.
