Ordinance 75-07ORDINANCE NO. 75 - AN ORDINANCE CREATING THE "BONITA AND LITTLE HICKORY SHORES LIGHTING DISTRICT WIT~ POWER TO LEVY ONE MILL OF AD VALOREM TAXES; CALLING A REFERENDUM. ELECTION WITHIN THE DISTRICT; PROVIDING FOR NOTICE AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMissIONERS OF COLLIER COUNTY, FLORIDA~ SECTION ON~ CREATION, MILLAGE LIMITATION, CALL OF ELECTION AND 'BALLOT. 1] Under the authority of Section 125.01 (q) there is hereby created the Bonita And Little Hickory Shores Lighting District within the Area of Collier County described as follows~ "All lands iying in the Subdivision known as Little Hickory Shores more specifically designated as Units 1, 2 and 3 as recorded in Plat Book 3, Pages 6, 79 and 97 respectively and Little Hickory Shores Unit 3 Replat, as recorded in Plat Book 6, Page 2; also all lands lying in Bonita Shores Subdivision, Units 1, 2, 3 and 4 as'recorded i'n Plat Book 3, Pages 1, 43 and 80, and Plat, Book 10, Page 33 respectively. All being as recorded in the Public Records of .~ Co'llier County, Florida," 2. Ad Valorem Taxes within the proposed District sha'11%e l~vied, assessed and collected at a uniform rate not In excess of one (1) mill. 3. A Special Referendum Electipn is hereby ordered and called to be held on March 25, 1975 in the area of the proposed District described in Paragraph 1. Hereinabove to submit to t~s qualified . electors' residing therein the question if the District shall be created to comprise the area described.. 4. The Clerk.to the Board shall publish Notice of this Election. once a week for four (4) consecutive weeks prior to the Election, the First Publicatibn to be at least thirty (3~) Days prior to the ElectioW. The notice shall be in substantially the following form followed by the ares description in Paragraph 1.'above~ "Notice of Special Election Bonita and Little Nickory Shores Ligh'ting District Creation· Notice is hereby given that e Special election shall be held among the qualified electors residing with/n the area described below~ On March 25, 1975 to determine if the proposed Bonita and Little Nlckory Shores Lighting District shall be created to acquire and ~urnish street lighting with an ad valorem tax levy not to exceed eno (1) mill, all within the area described as follows~" SECTION TWO~ CONSTRUCT'iON, SEVERANCE WAIVER OF NOTICE AND EFFECTIVE 1. This Ordinance shall be liberally construed to effectuate its ppbliu purpose., 2. If any portion, phrase or word of this ord~nance'ie held invalid or unconstitutional, the remaining parts shell not be affected, 3. Waiver of Notice. The Board of County Commissioners hereby waives notice requirements by a four fifths (4/5) vote declaring that an emergency exists necessitating the immediate enactment of this Ordinance. The Clerk to the Board shall file a certified.copy of this C"dinance in the Department of state as soon after its enactment as is practicable by registered, special delivery mall. 4. Effective Date. This Ord~.nance shall not become effective until after adoption, filing with the Secretary of State, and upon receipt of official acknowledgment from the Secretary of State of the certification by the Board of County Commissioners of Collier County and it's Clerk that this Ordinance was approved by referendum election.
