Ordinance 75-04COLLIER COUNTY ORDINANCE NO. 75 - 4 m4 ORDINANCE TO CREATE THE GOLDEN GATE MUNICIPAL SERVICES SPECIAL TAXING DISTRICT WITH POWER TO LEVY NINE TENTI{S, (9/10} OF ONE (1) MIL OF AD VALOREM TAXES UNDER SECTION 125.01 (q) OF THE FLORIDA ~TATUTES;'ESTABLISHING THE BOARD OF COUNTY COMMISSIONERS AS TI~ GOVERNING BOARD WITH AN ADVISORY COUNCIL; PROVIDING POWER TO FINANCE, CONSTRUCT, OPERATE AND }~INTAIN A COMMUNITY CENTER AND PERFORM THOSE F~CTIONS ENUMERATED BY SECTION 125.01 (q) OF THE FLORIDA STATUTES; RECEIVE, PURCHASE, OPERATE, MAINTAIN AND DISPOSE OF PROPERTY, E~LOY PERSONNEL; PROVIDING.AN EFFECTIVE DATE. WHEREAS, the public welfare requires certain municipal facilities and services within the Golden Gate Area of Collier County, Florida and Section 125.01 (q) of the Florida Statutes grants authority for the Board of County Commissioners to establish such a district. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSI( OF COLLIER COUNTY, FLORIDA; ." SECTION ONE: 1. Creation of the Golden ~ate Municipal ~ervi~es ~istrict. The "Golden Gate Municipal Services Dietrio~'ie hereby created, with the boundaries described as follows: (ATTACHED EXHIBIT "A") 2. Governin~ Boa. gd~ ..Powgr$ and Duties. a. The' governing board of the district shall be the Board of County Commissioners of Collier County, Florida with the po~er and duty to conduct the affairs of the ~istrict with the powers prescribed by Florida Statutes Section 125.01 (q) including, .bgt not limited to the power to equip, operate an~ maintain facilities and equipment within ~he district; tO buy, lease, sell, exchange, or otherwise acquire, hold and dispose of 'equipment and other personal or 'real proper.ty and to employ and discharge employees; to promulgate rules and regulations to administer the district and to' protect persons and property within th~ district. b. The Board shall appoint & committee of th=el (3) to five (5)'clec~.or~ residing within:,, tho ~l~trict to ~erve s~aggere~ ~ermn o£ two (2) years each to hold meetings at such times and places as it shall determine for the purposes of advising the Board regarding the affairs of the district. : c. The Adviso.ry Committee shall annually prepare a district budget and estimate the funds, their purpose and the.ad valorem taxes necessary to carry the provisions of this Ordinance for the following fiscal year as prescribed by Chapter 129 of the Florida Statutes. d. Upon. adoption of the district budget by the Board it shall cause the'budget to be' recorded in the Board minutes and shall cause to be levied on all property within the distract a millage sufficient to fund the budget not exceeding nine tenths (9/10) of one (1) mill in any one year to be assessed and collected as though County taxes. o. The Treasurcr of the Board ehall~ 1) Issue all warrants for services, equipment materials and other expenses incurred by the district and. approved for payment by the governing board. called to he held on March 25, 1975 in the area of the proposed d~strict described in Attachment "A" hereof to submit to qualified electors residing therein the question if the d~etrict shall be created to compr~s? the area described. 4. The ballots to be used for this election shal~ be in .substantially the followi~g form: OFFICIAL BALLOT · GOLDEN GATE MUNICIPAL SERVICES SPECIAL TAXING DISTRICT CREATION · Shall there be created' a Special Tax MuniciPal S'ervices District to be known as the "Golden Gate Municipal Services Special Taxing District~ with 'power to levy nine tenths (9/10) of one mill of Ad Valorem taxes and issue General O~li- gation'Bonds and otherwise as described in the 2) On or before the end of each fiscal year prepare an annual report to the receipts and expenditures of ~he district to the governing board as required by Section 218.20 et seq of the Florida Statutes. 3. A special referendum election il hereb~ ord~re~ and ordinance enacted by the Collier County Board of County Commissioners on February 18, 19757 SECTION TWO: FOR /--7 AGAINST /--7 1.. This ordinance shall be liberally construed to effectuate its public purpose. 2. If any portion, phrase or w6rd of this ordinance is held invalid or unconstitutional, the rema/ning parts shall not be affected. 3. Waiver of Notice. The Board of County Commissioners hereby waives notice requirement by a four fifths (4/5) vote declaring that an emergency exists necessitating the immediate enactment of this Ordinance. Th~ Clerk to the Board shall file a certified copy of this Ordinance in the Department of State as soon after its enactment as is practicable by registered, special delivery mail. 4. Effective Date. Thie Ordinance shall not become effective ~ntil after adoption, filing with the Secretary of State, and upon reogip~ of official acknowledgment from the Secretary of State of the certification by the Board of County Commissioners of Collier County and it'S Clerk that this Ordinance was approved bY referendum election.
