NO. 74-42 BY AMENDING T~E ZONING REGULATIONS
APPL'ICABLE TO TII~ COASTAL AREA PLANNING DISTRICT
OF COLLIER COUNTY BY REVISING SECTION 21, PARAGRAPI{
C, SUBPARAGRAPH (3) PROVIDING AN EFFECTIVm-DATE~
WHEREAS, tho Coastal Area Planning Commission has determined
that the following revisions shall be made to the RST.3~Zoning
District applicable to the Coastal Are'a Planning District of
Collier County, Florida.
NOW THEREFORE BE IT ORDAINED' BY THE COUNTY COMMISSIONERS OF
COLLIER COUNTY,' FLORIDA~
SECTION ONE~ ·
1. TO amend tho Zoning Regulations applicable to ~he Coastal
Area Planning District of Coilier County, Florida, amending Section
21, Parograph C, Subparagraph (3) (b) to read as follows~
Depth of Side Yard~
One-Story - Seven and one-half feet
Two-Story - Ten feet (10)
SECTION TWO~
Conffict; Severances. Construction and Penalt~
In the event this Ordinance conflict8 with other applicable law,
.the more restrictive shall apply. If any part of this O~di~nco con-
flicts with any part, it shal~ be severed and the remain~er~hal~ have
full force and effect and be liberally construed. ~;; ~ i~
If any section, subsection, sentence, ~lause, phras~r.~ -- on
of this Ordinance is, for any reason held invalid or unc~t~tional
by any Court of competent Jurisdiction, such'~ortion shall be deemed
a separate, distinct and independent provision and such holding shall
not affect the validity of the reamin~ng portion thereof.
The provisions of this Ordinance shall be deemed an exercise
of' the police power of. Collier.County for the protection of' the publio
health, safety an~ welfare and there'fo~e shali be liberally construed
to accomplish ~hat purpose and implement the legislative intent and
declaration.
If such a violation is continuing', each day's violation
s~parate ac'~ ~h~ll be a separate

Effe~tivo Date:
This ordinance shall b~come effective upon receipt of notice
that it is filed with the Secretary of State.
