AN ORDINANCE TO CREATE THE WESTLAKE MUNICIPAL
SERVICE TAXING UNIT WITH POWER TO LEVY AD VALOREM
TAXES UNDEk CHAPTER 125 OF THE FLORIDA STATUTES:
ESTABLISHING THE BOARD OF COUNTY COMMISSIONERS AS
THE GOVERNING BOARD; PROVIDING FOR MAINTENANCE AND
BEAUTIFICATION OF SAID DISTRICT.
BE IT ORDAINED BY THE BOARD OF COUNTY COMiMISSIONERS OF
COLLIER COUNTY. FLORIDA:
SECTION ONE: Creatiqnf. Purpose,....Taxing Authority.
1. The Westlake Municipal Services Taxing Unit is
hereby created, with boundaries described as follows~
Westlake Subdivielon~Units I and II as recorded
Plat Book 10, Pages 87 and 94.
t2'he The Taxing Unit hereby created and established is
for
purpose of beautifying and maintaining the stree~
right-of-way along the perimeter wall and certain other
maintenance and repairs related thereto. Said Taxing Unit
shall have the authority to levy ad valorem taxes as pre-
scribed by law not to exceed one-third mill or a total of
$1,000, whichever is smaller, in any one fiscal year.
SECTION TWO: GovergSD~ Boa. rd, Powers...an4 Duties.
The governing board of the Taxing Unit shall be~ ~ '~'
Board of County Commissioners of Collier County, Flora
with the power and duty to conduct the affairs of th~axi~
Unit as prescribed by Florida Statutes.
SECTION THREE: Advisory Committee, Duties, Respons _._it__
The officers of the Westlake Civic Association, or s~ ,
other groups that may be designated, shall constitute an
Advisory Committee to the Distric~ with advisory authority
in the business affairs of the District and such other
duties and record keeping as may be assigned from time to
time by the Board of Governors to the District.
SECTION FOUR:
1. This Ordinance shall be liberally construed to
effectuate its public purpose.
2. If any portion, phrase or word of this Ordinance
is held invalid or unconstitutional, the remaining parta
shall not be affected.
SECTION FIVE: Effective Date.
This Ordinance shall no~ become effective until after
adoption, filing with the Secretary of State, and upon receipt
of official acknowledgment from the Secretary of State of the
certification by the Board of County Commissioners of Collier
County and its Clerk that this Ordinance was approved,
