Ordinance 76-09 COUNTY R£C 3 ORDINANCE NO. 76-9 AN ORDINANCE AMENDING ORDINANCE NOS. 74-42 & 75-24 ~/ ~ COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPOi D~_ ~ AREA OF THE COASTAL AREA PLANNING DISTRICT OF COUNTY: AMENDING SECTION 18 OFFSTREET PARKING AND OFFSTREET LOADING PARAGRAPH 4 OFFSTREET PARKING ~ LOCATION BY ADDING PARAGPAP~! 4C AS ~EREINBELOW DESC~ AND PROVIDING AN EFFECTIVE DATE: ~{EREAS, the Coastal Area Planning Commission of Collier County, Florida, petitioned the Board of County Commissioners of Collier County, Florida, to amend the Comprehensive Zoning Regulations for the unincor- porated area of the Coastal Area Planning District of Collier County, Florida, as hereinafter described: NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: Section 18, Paragraph 4 of The Comprehensive Zoning Regulations for the unincorporated area of the Coastal Area Planning District of Collier County, Florida, Ordinance No..~4-42 and Ordinance 75-24 are amended by adding subparagraph 4C aS follows: 4C. Offstre~t. parkinq: Location: The required off-street parking facilities shall normally be located on the same lot or parcel of land as the building or use it is intended.to serve. However, the Board of County Commissioners, after public hearing and recommendation by the Coastal Area PIan~ng Commission, may allow the establishments of t~req~red off-street parking facilities within six hundz~(6~O} 'T1 feet of the building or use it it intended pratical difficulties on the same lot as the ~ldi~ use it is intended to serve providing, (1) The Board of County Commissioners may impc~_ su~ regulations or conditions upon approval as~.~ ma_~' deam appropriate for the protection of thc~al~ safety, and well-being of the citizens of the county which may include but shall not be limited to pedestrian ground level and overhead walkways, traffic signals, traffic control devices, and directional signs, controlled ingress and egress, and fences, walls, and vegetatives screens as determined app .ropriate. (2) The owner of the land upon which such reguired off- street parking facilities are located shall enter into a written agreement wit5 the County with enforcement running to the county providing that the land comprising the required off-street parking facilities shall never be encroached upon, used, sold, leased or co:~veyed for any purpose except -' in conjunction with the building or use which the required off-street parking facilities serves'so long a~ tho off-street parking facilities arm required. (3) The owner of the land upon which such required off-street parking facilities are located agrees to bear the expense of recording the agreement, which shall bind his heirs, successors, and assigns. (4) The written agreement shall be voided by the County if other required off-street parking facilities are provided in accordance with the requirements of this. Ordinance.
