Ordinance 77-65ORDINANCE 77- 65 AN ORDINANCE AMENDING ORDINANCE NO. 76-3~ TIlE COMPREHENSIVE ZONING REGULATIONS FOR~ THE UNINCORPORATED AREA OF TIlE COASTAL PLANNING DISTRICT OF COLLIER COUNTY, FLO~_~ BY AMENDING PARAGRAPH 5 OF,SECTION 20,SI~N~,~ AND ADDING PARAGRAPIt 15, PERMITTING A TE~P~r~RY SIGN AT STRATEGIC LOCATIONS ANNOUNCING LOCATION OF U-PIC FARMS AND PROVIDING AN~ EFFECTIVE DATE WHEREAS, The Collier County Agricultural Extension Service petitioned the Board of County Commissioners of Collier County, Florida, to amend Ordinance 76-30 by amending Paragraph 5 and adding Paragraph 15 to Section 20, and, WHEREAS, u-Pic Farms are extensively patronized by local residents and tourists and visitors, and, WHEREAS, it is often difficult for the tourist and visitor to find the U-Pic Farms due to their remote location throughout the farm areas of Collier County, and, WHEREAS, traffic and congestion on the road system can be reduced by providing directional signs to the U-Pic Farms, and, WHEREAS, the growers have a limited time to sell their highly perishable farm produce, and, WHEREAS, the sale of farm produce benefits the farm economy specifically and the economic viability of the community generally, and, WHEREAS, The Board of County Commissioners of Collier County, Flcrida, and its recommendatory agents have conformed to all applicable proc~dural requirements of Florida Law, and particularly those re- lating to public notice and hearing, NOW THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Collier County, Florida: SECTION TWO: ~ Amend Ordinance No. 76-30 Section 20, SIGNS by adding the following definitions to Paragraph 5: U-Pie Farm: A farm whore the customer picks or purchases the produce directly from the premises on which they are grown or produced. U-Pic Farm shall include any vegetable, fruit, nut or edible field crops grown on the subject ~remises where the customer is an invitee to pick or pur- chase such produce. Amend Section 20, SIGNS, by adding Paragraph 15 as follows: 15. Seasonal Off-Premise U-Pic Farm Signs: Seasonal off-premise U-Pic Farm sign(s) may be approved by the Zoning Director subject to the following conditions: Size of U-Pic Farm Sign: The face of the sign upon which the message is written shall not exceed two (2) feet in height nor four (4) feet in length for an individual off-premise U-Pic Farm sign, nor eight (8) feet in height by'twelve (12) feet in length for a combination off-premise U-Plo Farm sign providing however that such combination off-premise U-Pic Farm sign may not exceed a width or length equivalent t° four (4) square feet for each individual off-premise U-Pic Farm advertised on the sign. Message Content: The message content on a seasonal off-premise U-Pic Farm sign shall be limited to the name of the farm, the directions for locating the farm, and a directional arrow when deemed appropriate by the Zoning Director. Co Location of Seasonal Off-Premise U-Pic Farm Sign: A seasonal off-premise U-Pic Farm sign shall be located on private property and under no circumstance shall such sign be placed in any street right-of-way. Prior to the issuance of a seasonal off-premise U-Pic Farm sign on any private property an authorization for the placement of such sign is required by the property owner. Construction of Seasonal Off-Premise U-Pic Farm Sign: All seasonal off-premise U-Pic Farm signs shall be constructed in a manner which complies with all applicable County ordinances. In the case of a seasonal combination off-premise U-Pic Farm sign, individual messages shall either be painted directly on the combination sign board, or if con- structed of individual panels, such panels shall be attached to the combination sign board in a manner which is secure from winds and which may be removed and replaced as required by this section. Ze Duration of Valid Seasonal Off-Premise U-Pie Farm Permit: All seasonal off-premise U-Plo Farm sign permits shall be issued for and valid during the period between October 15 and May 15 of the following year. A seasonal off-premise U-Pic Farm sign permit shall be renewable 'annually. Removal of Seasonal Off-Premise U-Pie Farm Signs During Off-Season: All seasonal off-premise U-Pic Farm signs shall be removed by May 30 of each seasonal year. Ail signs which are not removed by the permittee by May 30 of each permit year will be removed by the County and all costs, including legal costs, for such removal will be assessed as a lien against the property owner on whose land the sign was located. SECTION TWO: This Ordinance shall take effect upon receipt of notice that it has been filed with the Secretary of State. DATE: December 6, 1977 ATTEST: WILLIAM J.
