AN ORDINANCE AMENDING ORDINANCE 76-41
LELY PUD DOCUMENT BY ADDING THE ~0LLOWING
LANGUAGE CONCERNING OVE~IEAD DISTRIBUTION
LINES TO SECTION 3.4.8 AND PROVIDING AN
EFFECTIVE DATE.
WItEREAS, Florida Power & Light Co., representing Christiaan
Duvekot, Owner, petitioned the Board of County Commissioners of
Collier County, Florida to amend Ordinance 76-41, the Lely PUD
Document;
NOW, THEREFORE BE IT ORDAINED by the Board of County
Commissioners of Collier County, Florida:
SECTION ONE:
Ordinance 76-41, the Planned Unit Development (PUD~ocu~
ment for Lely Country Club, is hereby amended as follows~ ~
AMEND SECTION 3.4.8 BY ADDING THE
FOLLOWING:
Except that an overhead power dis-
tribution line with underground
laterals will be all~ed to be
constructed and maintained by
Florida Power & Light Co., within
a twenty (20) foot easement strip
in the above described restricted
100 feet as shown on the plans.
The installation and maintenance
of the above mentioned power line
shall be carried out in a manner
which will not disrupt normal
surface water sheet flows across
the buffer zone, and that the res-
ponsibility for maintaining a sat-
isfactory sheet flow condition ,~ill~
rest with the Utility or the PUD
Developer.
and said sketch is made part of the PUD Document.
SECTION TWO:
This Ordinance shall become effective upon receipt of notice
that it has been filed with the Secretary of State.
