FLORlnA CA~ BE IT RESOLVED BY Tm: DISTRICT llOAHD OF Tim COUNTY WATER-SEWER DISTRICT, COLLIER COUNTY, FLORIDA, that: SECTION I. This resolution is adopted pursul:nt to the provisions of Chapter 153. Part II, Florida Statutes, and other applicable provisions of law. SECTION 2. It is hereby found and determined as follows: A. On November 18, 1980, the District Board of the County Water-Sewer District (the "District") adopted its Resolution No. CWS-80-12 confirming Resolution No. CWS-80-10 and ordering the construction of the water improvements described therein (the "Project") to be located along the routes and in the areas described therein. de8ignating the area to be assessed for the payment of the cost of such improvements as "Regional Water System, Assessment District No. I" (the "Assessment District"). B. The construction of these assessable water improvements has now been completed and the water facilities have been placed into service. SECTION 3. The District Board. having heard property owners and other interested persons appearing before the Board LIS to the propriety and advisability of confirming such preliminary assessment roll. as to the amounts shown thereon to be assessed against the lots and parcels of land to be benefited and as to the equalization of the assessments on a basis of justice and right. does hereby confirm such preliminary assessment roll. SECTION 4. Such assessments are hereby found and determined to be levied in direct proportion to the special and positive benefits to be received by the properties listed in the assessment roll as a result of the acquisition and construction of the Project ordered and authorized by the Board's Resolution No. CWS-80-10 adopted November 18. 1980. SECTION 5. The assessments confirmed hereby may be paid no later than August 19. 1985 at the office of the district clerk without interest. Thereafter, such assessments shall be payable annually in 20 equal installments with interest not to exceed nine and eight hundred and seventy five thousandths (9.875%) percent per annum, payable on or before November 1st of each year. Any assessment may be paid before due, together with interest accrued thereon to the last day of the calendar quarter in which paid. SECTION 6. This Resolution shall take effect immediately upon its passage. \ - L -. .
