Ordinance 77-46ORDINANCE NO. 77-46 AN ORDINANCE ~ENDING CHAPTER 61-2039, SPECIAL ACTS, LAWS OF FLORIDA 1961; PROVIDING FOR A FEE OF $5.00 ON ALL ACTIONS, SUITS OR PROCEEDINGS FILED TIlE CIVIL JURISDICTION OF THE COUNTYm~_~ COURT Ill ~D FOR COLLIER COUNTY, AND A FILING FEE OF $10.00 ON ALL SUITS OR PROCEEDINGS FILED IN THE CIV~ JURISDICTION OF THE CIRCUIT COURT IN FOR COLLIER COUNTY, FLORIDA TO BE USE~ EXCLUSIVELY FOR THE OPERATION AND TENANCE OF A LAW LIBRARY; PROVIDING EFFECTIVE DATE. W~EREAS, Chapter 61-2039, Laws of Florida, provides for the collection by the Clerk of the Circuit Court of Cq~l_ier~_,~ ~ County, Florida of an additional filing fee of $5.00 ~_ ~ each and every case filed within the civil Jurisdicti~_o~f ~_~ the Civil Court of Collier County, Florida, and ~ -' W~ERFJkS, additional ftunds are required to meet t~%~ ~- current cost of operating and ~intaining the Collier~unt~ Law Library, and ~ ~ WI{EREAS ~28.241(1) Florida Statutes authorizes t~ -~ imposition of service charges by ordinance for the purpose of providing and maintaining law libraries, NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that SECTION ONE: Effective October 1, 1977, Section II, Chapter 61-2039, Special Acts, Laws of Florida is 'hereby amended to read as follows: "The Clerk of the Circuit Court of Collier County, Florida is hereby authorized and directed to collect an additional fee of $5.00 for each and every action, suit or proceeding filed within the civil Jurisdiction of the County Court in and for Collier County, Florida, and an additional fee of $10.00 for each and every action, suit or proceeding filed within the civil Jurisdiction of the Circuit Court in and for Collier County, Florida. The Clerk shall deposit all such additional filing fees so collected in a special account to be kno~rn as the Collier County Law Library Account. The Clerk is further authorized and directed to'draw warrants on such account upon the submission to the Clerk of a requisition for same signed by either the President, Vice President or Treasurer of the Collier County Bar Association and countersigned by the County Attorney of Collier County." SECTION TWO: Emergency and Effective Date. 1. The Board of County Commissioners hereby waives' notice requirements by a four-fifths (4/5) vote declaring that an emergency exists necessitating the immediate enact- melt of this Ordinance. The Clerk to the Board shall file a certified copy of this Ordinance with the Dcpartm=nt of State as soon after its enactment as is practicable by registered, special delivery mail. 2. This Ordinance shall become effective upon being accepted by the postal authority for delivery by registered mail to the Department of State.
