Ordinance 77-44ORDINANC~ NO. 77- 44 AN ORDINANCE RELATING TO WATER CONNECTIONS FOR PROPERTIES WITHIN THE GOODLAND WATER DISTRICT; REQUIRING CONNECTION TO THE WATER SYSTEM PROVIDED BY THE DISTRICT; PROVIDING FOR EXCEPTIONS; PERMITTING CONNECTIONS BY THE DISTRICT; DEFINING UNLAWFUL CONNECTIONS; PROMULGATING THE RATES TO BE Ct~RGED FOR USE OF THE DISTRICT'S WATER SYSTEM; PROVIDING }~ANS OF ENFORCING PAYMENT FOR SUCH SERVICES; ESTABLISHING MAINTENANCE REQUIREmeNTS; PRO- HIBITING FREE WATER SERVICE; AND PROVIDING FOR PENALTIES FOR VIOLATION. BE IT ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: ~ ~ SECTION 1. CONNECTIONS WITH WATERWORKS SYSTEM. ~ '~ Where the same shall be available, the owner of every ~ or-- ~" parcel of land within the Goodland Water District shall",~ ~ ['~ connect, or cause the plumbing of any building or build~m~gs .~ thereon to be connected, with the waterworks system of the district, and use the facilities of such water system. All such connections shall be made in accordance with rules and regulations which shall be adopted from time to time by the Board of County Commissioners of Collier County, which rules and regulations shall provide for a charge for making any such connections in such reasonable amoun~ as such Board may fix and determine. Provided, however, that this Ordinance shall not be construed to entitle any person to cross the private property of another to make such water connections; and provided further that there shall be no connection charge for connections during the initial construction of any distribution line of the waterworks system. SECTION 2. CHARGE FOR WATER SERVICE A. Meter Installation - $50.00 B. Connection Fee, After Construction, at least $100.00 but not less than cost. Monthly Charge or Rate - Any user of the service of the waterworks system shall pay th~efor follows: 007 Rakes Monthly Basis $2.35/1,000 gals. $17.60/mo. (based on usage of 7,500 gallons) SECTION 3. UNL^WFUL CONNECTION. No person shall be allowed to connect into the waterworks system without the written consent of the District, and then the connection with such system shall only be made under the direction and supervision of the District. Any property owner or plumber who shall make any connection without such consent of the District 8hall, upon conviction, be subject to the penalties hereinafter provided. SECTION 4. CONNECTING OLD PLUMBING. Whenever it is desirable to connect existing plumbing with the waterworks system, the owner or plumber contemplating doing such work shall notify the Plumbing Inspector who will inspect said plumbing and notify the owner or plumber what alterationa will be necessary to place said plumbing in an acceptable condition for connection with the waterworks system. Any owner or plumber who shall make any connection without the approval of the Plumbing Inspector shall, upon conviction be subject to the penalties hereinafter provided. SECTION 5. MAINTENANCE OF PLUMBING. The owner of the property shall be responsible for maintaining all plumbing on such property and the pipe leading and connecting from the waterworks system distribution lines. SECTION 6. PAYMENT OF FEES AND BILLS REQUIRED. Bills for the monthly charges and fees hereinbefore men- tioned shall be submitted by the District and shall be paid by the users monthly. If any monthly bill for water aervice shall be and remain unpaid on and after 10 days from the date of submission of said bill for such service, a penalty of ten percent of said bill shali be imposed andbe added to said bill; and, if said bill shall continue and remain due and unpaid for a period of 30,.days from the date of sub- mission of such bill, the water service to the consumer shall be discontinued and shall no~ be reconnected until all past due charges have been fully paid, together with a re- connection charge of $35.00. SECTION 7. IlO SERVICE FREE. No water shall be fur- nished free of charge to any person, firm or corporation whatsoever, and the District, and each and every political subdivision, municipality, agency, department or instru- mentality which uses the waterworks system shall pay' there- fore at the rates fixed by this Ordinance· SECTION 8. SYSTEM TO BE FULLY M~TERED WITH SEPARATE CONNECTIONS FOR EACH SEPARATE UNIT. Each lot or building site shall be considered a separate unit for the payment of the water fees herein established, and separate connections will be required for each of such units. Every connection shall be separately metered. SECTION 9. PENALTIES. Any person, firm or corporation violating the provisions of Section 3, or Section 4 of this Ordinance shall, upon conviction thereof, for each such offense, be subject to a fine of not to exceed three hundred dollars ($300) or by imprisonment for not to exceed ninety (90) days, or by both such fine and imprisoru~'nC in the discretion of the Court. SECTION 10. EFFECTIVE DATE. This Ordinance shall take effect as provided by law.
