Ordinance 77-28I:L_J I-:,-] ORDINANCE 77 -28 AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE 76-68; PROVIDING THAT BUILDING PERMIT FEES APE NON-REFUNDABLE; MAKING A LEGISLATIVE DETERMINA- TION AS TO THE COST OF CONSTRUCTION UPON WHICH THE BUILDING PERMIT FEE IS BASED; PROVIDING FOR CONFLICTS, SEVERANCE, PENALTIES, AND AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: ORDINANCE 76-68, which enacted the Collier County Building Code, is hereby amended to read as follows: SECTION ONE: A. Section 107.1 - General. The Standard Building Code, 1976 edition is amended to read as follows: A permit shall not be issued until the fees prescribed in this Section shall have been paid. Nor shall any amendment to the permit be approved until the additional fee, if any, due to an in- crease in the estimated cost of the build n o structure, shall have been paid. No perm~fe~ paid pursuant to this Section, nor any po~o~ thereof, shall be refundable for any rea.o~, B. Section 107.4. (1) Schedule of Fees~ Permit,~ appears in Ordinance 76-68, is hereby amendQd to read as follows: The amount of fee for a building permit, the accompany- ing building inspections and administrative costs, shall be based upon the cost of construction, erection, alteration or repair. Specific costs of construction are legislatively found to be as follows: (a) Living Areas - $18.00 per square foot (b) Garages, carports, porches (c) (d) utility rooms, washrooms, and workshops - Screened areas - Riprap seawalls - Vertical seawalls - (e) For all other constructions, erections, alterati or repairs, the cost of construction will be determi by reference to the contract price. 12.00 per square foot 1.50 per square foot 20.00 per lineal foot 35.00 per lineal foot SECTION TWO: Conflict and Severance. 'In the event this Ordinance conflicts with any other appli- cable law, the more restrictive shall apply. If any portion of this Ordinance is in conflict with any ordinance of any munici- pality within Collier County, it shall not be effective within that municipality to the extent of such conflict. If any section, subsection,' sentence, clause, phrase or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction such portion shall be deemed a separate, distinct and independent provision of such holding and shall not affect the validity of the remaining portion hereof. SECTION THREE: Penalties. A violation of any provision of this Ordinance is a mis- demeanor and the violator shall be punished according to law. Each violation shall constitute a separate offense. In addi- tion to the civil remedies provided herein, the Board of County Commissioners shall have the power to collaterally enforce the provisions of this Ordinance by appropriate Judi- cial writ or proceeding notwithstanding any prosecution as a misdeameanor. SECTION FOUR: Effective Date. This Ordinance shall take effect upon receipt of notice from the Secretary of State that this Ordinance has been filed.
