Ordinance 78-66 ORDINANCE NO. 78- 66 AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE NO. 78-02 BY PROVIDING FOR MOBILE HOME INSTALLATION CONTRACTORS; PROVIDING FOR GRANDFATHER PROVISION; PROVIDING FOR FLICT, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, Collier County Ordinance No. 78-02 licenses Specialty Contractors for the first time, and WHEREAS, Collier County Ordinance No. 78-02 provides for no Specialty Contractor for mobile home instalL~tion whi~ includes air conditioning, plumbing, and electm~eal=hook~ps i'and ,E As, e erienc, has ,ho thet th.re . cae ry% of parsons who were permi~ed =o ins~ll in~ludi~ ~i~ condi=ioni~, ~l~bi~, and elec~ hook-ups, prior ~o ~he enactment of ~ollier County O=dt.a~e ~o. 7~02 and ~ha= Chey have been excluded by sa~d Ordinance; NOW Tt{E~FO~E BE IT ORDAINED BY ~ BOA~ OF CO~ CO~ISSIO~S OF COLLIE~ CO~ F~IDA= SECTION ONE: Collier County Ordinance 78-02, Section 1.7 is hereby amended by creating a new classification of Specialty Contractor to be designated as Mobile Home Installation Contractor. A Mobile Home Installation Contractor shall be defined as any person whose services are l~mited to: installing the pad upon which the mobile home will sit; blocking mobile.~omes~ tiein~ down mobile homes; furnishing repairs and pal%lng,._ up to the sale to a consumer through warranty period,~of Mobile Homes; providing the mechanical services for installation of the mobile home; providing the ~nitia~conn~ion · of the air conditionin~ system coincidental with the setup of the mobile home; making the sewer connections necessary to the installation of the mobile home; making the water connections necessary to the installation of the mobile home; and making the electrical connections to the meter box for the mobile home necessary for the installation of the mobile home. This Mobile Home installation specialty license is available only to those persons ownin~ or operating a Mobile Home park, for installation of Mobile Homes within sa~d Mobile Home park owner's or operator's park. 008 SECTION T~O: Grandfather Provision. Any applicant for the above created specialty license shall not be required to take a qualifying examination if on the effective date of Ordinance No. 78-02. the applicant, or its qualifying agent possessed an occupational license for Collier County in the specialty trade for which application is made. An occupation license in the specialty trade created above shall be deemed to be any occupational license under which the County has previously issued building permits which allowed the applicant to install mobile homes in the manner set out in the above created category. In order to qualify for this exemption, the applicant must make application for a Certificate of Competency between the dates of December 1, 1978 and April 1, 1979. SECTION THREE: Conflict. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. SECTION FOUR: Scverability. It is declared to be the intent of the Board of County Commissioners that if any section, subsection, sentence, clause phrase or provision of this Ordinance is held invalid or unconstitutional, such invalidity or unconstitutionality shall not be so construed as to render invalid or unconstitutional the remaining provisions of this Ordinance.' SECTION FIVE: Effective Date. This Ordinance shall become effective upon acknowledgement from the Secretary of State that the Ordinance has been duly filed.
