AN ORDINANCE ESTABLISHING A SYSTEM DEVELOPMENT CHARGE FOR CONNECTION TO SEWER SYSTEMS OPERATED BY COLLIER COUNTY, FLORIDA; PROVIDING FOR ANNUAL REVIEW AND PROVIDING EFFECTIVE DATE. BE IT ORDAINED by the' Board of County Commissioners of Collier County, Florida: SECTION ONE: o co A. There shall be paid a system developme~oc~_arge_ _ :~o=. defray the cost of collection transmission and~tmenTM =~ facilities for sewerage provided by Collier Coun~%'._~Flor~ -~ as follows: ~ :- 1. Residential ~ -~ Single family residences, multi-family residences, apartment residences, mobile homa residences: Each one bath living unit 225/gal/day/unit 412.00 Each one bath per living unit 50/gal/day/unit 2. Non-Residential Hotel, motel, and trailer rental units 110/gal/day/unit Commercial, office, and industrial toilet units (not to include indus- trial waste) 400 gal~day~toilet 733.00 Commercial and coin laundry washer units 200/gal/day/washer 367.00 Restaurant and Lounge seating unit's 35 gal/day/seat 64.00 B. The chargcs set forth herein shall be payable upon issuance of the building permit for said unit or units in the case of new construction, or in the case of a presently existing structure, such charge shall be payable when the permit for sewer connection is issued. C. Those family residences which were in existen~ and can be verified from the Property Appraiser's 1977 tax records, may elect to enter into an agreement with the County for payment of lof3 008 the system development charge, as follows: The charge shall be payable in equal monthly payments over a three(3) year period, with annual interest at the rate of seven (7) percent on the annual unpaid balance. Said payments shall be added to and become a part of the monthly sewer bill and shall be subject to the same provisions for payment and collec- tion thereof. D. A separate accounting shall be kept by the County's Finance Department for all monies collected under the system development charge set forth herein. Said monies shall be used solely for capital improvements for transmission mains, ground storage facilities, new pumping facilities and new treatment facilities required to provide service to new connections to the sewer system by new users. SECTION TWO: The County Commission shall review the system development charge annually to determine that said charge is equitable and proportionate to the current cost for providing new connections to the system for new users. SECTION THREE: Backup systems mandated by state regulations and installed to provide emergency water supplies for hospitals and nursing homes shall be exempt from the charges set forth herein; if it can be shown that the installation of said emergency facility will not increase the demand on the County's water system. SECTION FOUR: This Ordinance ,hall become effective upon receipt of 2 of 3 notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
