Ordinance 78-07ORDINANCE 78 - ~ 7 AN ORDINANCE A~ENDING ORDINAI~CE 76-30 TIIE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF THE COASTAL AREA PLANNING DISTRICT BY A~.~ENDING THE ZONING ATLAS [.L%P NU~BER 48-25-4 BY CIIANGING THE ZONING DISTRICT CLASSIFICATION FROM GRC- GENERAL RETAIL COMPLERCIAL TO P44-2 RESIDENTIAL MULTI-FA~4ILY ON THE FOLLOWING DESCRIBED PROPERTY WHICH IS LOCATED JUST EAST OF THE ENTRA/~CE TO VANDERBILT TOWERS NEAR THE YACHT BASIN: A PORTION OF TRACT A, BAKER CARROLL POINT, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Vanderbilt West Corporation pet~ioned t;~ Board of County Commissioners to change the zoning clas~i~ationm=of~the real property herein described; c. o, ~ NOW, THEREFORE BE IT ORDAINED by the Board o~.Cp'.~ty C~mm~- sioners of Collier County, Florida; ~ .- SECTION ONE .' The Zoning Classification of the hereinafter described real property in Collier County, Florida is changed from GRC general Retail Commercial to 924-2 Residential Multi-family and the Official Zoning Atlas Map Number 48-25-4 as described in Ordinance 76-30 hereby amended accordingly: . Beginning at the SE corner of Tract A, Baker Carrol~ Point as recorded in Plat Book 8, Page 42 of the Public' Records of Collier County, Florida, run N89°52'20"%~on~ the South line of Tract A, being also the North Ri~ of~ Way line of State Road 846 for 302.57 feet;, thence~n N00°07'40"E for 273.10 feet to a point on the pro~y waterway line~ thence run 64.85 feet along the arc of curve, concave to the NW,having a radius of 100 feet and subtended by a chord having a bearing of N71°33'00"E and a length of 63.72 feet to' a point of tangency; thence N52°58'20"E for 100.44 feet to. a point of curvature; thence run 64.22 feet along the arc of a curve, concave to the SE, having a radius of 100.00 feet and subtended by a chord having a bearing of N71°22'10"E and a length of 63.12 feet to a point of tangency; thence N89°46'00"E for 100.00 feet, the last 4 courses being along the watez%~ay line; thence S00°14'00"E along the property line for 375 feet to the Point of Beginning; containing 2.36 acres more or less. AND From the SE corner of Tract A, Baker Carroll Point as recorded in Plat BookS,Page 42 of the Public Records of Collier County, Florida, run along the property line N00°14'00"W for 475.00 feet for a Point of Beginning; thence run S89°46'00"%; for 125.00 feet to a point of curvature; thence run 110.02 feet along the arc of a curve, concave to the NE, having a radius of 100.00 feet and subtended by a chord having a bearing of N58°42'56~'W and a length of 104.55 feet to a point of tangency; thence run N27°ll'52"W for 69.81 feet, the last 3 courses being along the %~ate~ay line; thence run N89°46'00"E for 245.78 feet to a point on the property line; thence S00°14'00"E for 116.88 feet along the property line to the Point of Beginning, containing 0.56. acres, more or less. 008 '08 SECTION TWO: This Ordinance shall become effective upon receipt of notice that it has been f.{led with the Secretary of State.
