Ordinance 79-091ORDINANCE NO. 79- 91 AN ORDINANCE AMENDING ORDINANCE 76-30, THE COMPREHENSIVE ZONING REG%;LATIONS FOR THE UNINCORPORATED AREA OF THE COASTAL AREA i'LANNING DISTRICT BY AMENDING SEC- TION 24 - PLANNED UNIT DEVELOPMENT DIS- TRICT TO ALLOW FOR ENTRY LEVEL MULTI- FAMILY RENTAL DWELLINGS AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, the County Planning Departmont and Hoderate Income Housing Committee petitioned the Board of County Com- missioners to amend the Zoning Ordinance to allow for entry level multi-family rental dwellings; NOW, THEREFORE BE IT ORDAINED by the Board of County Commissioners of Collier County, Florida: SECTION ONE: The Zoning Ordinance 76-30 i3 hereby amended accord- ingly: ~-hME~D SEC~ON 24, PLANNED UNIT DEVELOPMENT DISTRICT BY ADD- .~NO~ F~LLOWING TO PARAGRAPH 6D AND RENUMBERING SUBSEQUENT --- (2)~Entry level multi-family rental dwellings in ac- ~ -~ cordance with Paragraph 6F of this section, exclud- =ing Paragraph 5B (4-7) and Paragraph 6G, H & J. AMEND S~CTION 24, PLANNED UNIT DEVELOPMENT DISTRICT BY ADD- lNG A NEW PARAGRAPH 6F AND RENUMBERING SUBSEQUENT PARAGRAPHS AC CORD I NGLY: Fe Multi-Family Entry Level Rental Housing Areas (~) Intent: This area is intended to apply to an area of entry or near entry level multi-family residen- tial rental units having a mid-rise profile sil- houette and generally surrounded by low profile structures and open space and so situated that it is well-served by public and commercial services and has direct or convenient access to thorough- fares and collector streets. This area is intended to implement the Comprehen- sive Plan and provide mid-rise multi-family dwell- ing accommodations in accordance with the goals, objectives and policies of the Comprehensive Plan. T~is =~ ,-area is based on the following findings of f,~,c~..~y the Board of County Commissioners= (~) "That Collier County is among the highest ten- - ?~:'tal and purchase housing markets in the State ~":~of Florida~ ~.~There is a real need for additional housing ' ~facilities both rental and purchase in the ~low to moderate income ranges; (c) Due to the shortage.of affordable housing in the low to moderate income range, local bus- inesses have ex~erienced difficulty in recruit- ing and retaining gualified employees within many necessary employment classifications; (2) (d) That'the creation of this district would dis- courage young families, presently unable to find affordable housing, from moving else- where; (e) That the creation of this district would at- tract business to the community by c2abiliz- ing the work force and providing affordable housing for semi-skilled, skilled, trade and young professional workers; (f) That providing incentives to the private sec- tor to provide low and Iow-to-moderate income housing would strengthen the County's tax base by keeping such projects on the tax rolls; Permitted Uses and Structures: No building or str- ucture, or part thereof, shall be erected, altered or used, or land or water used, in whole or in part, for other than the following: (a) Permitted Principal Uses and structures (i) Multi-f~mily rental dwellings units. (3) Maximum Density: acre. 16 residential units per gross (4) Minimum Lot Area Requirement: Five (5) acres. (5) Minimum Lot Width: One hundred and fifty (150) feet as measured at the front yard building line set- back. (6) MinimumYard Requirements: (a) Depth of front yard - Thirty (30) feet plus one (1) foot for each two (2) feet of build- ing height over thirty (30) feet. (b) Depth of side yard - Fifteen (15) feet plus one (1) foot for each two (2) feet of build- ing height over thirty (30) feet. (c) Depth of rear .yard - Thirty (30) feet plus one foot for each two (2) feet of building height over thirty (30) feet. (7) Distance Between Structures: (a) If there is a separation between any two (2) principal structures on the same parcel, said separation shall be.a minimum of fifteen (15) feet or a distance equal to one-half (%) the sum of their heights, whichever is the grea- ter. (8) Minimum, and Maximum Floor Area of Principal Struc- (a) Efficiency Apartments (i) Minimum Floor Area - 450 square feet. (ii) Maximum Floor Area - 525 square feet. One bedroom apartment (i) Minimum Floor Area - 450 square feet. (ii) Maximum Floor Area - 650 square feet. (c) Two bedroom apartment (~) Minimum Floor Area - 650 square feet. (ii) Maximum Floor Area - 900 square feet. (d) Three bedroom apartment (i) Minimum Floor Area - 900 sauare feet. (ii) Maximum Floor Area - 1050 square feet. (9) Maximum Height of Structures: (a) Three (3) Living floors. (10) Minimum Landscaping Requirements: As required in Sect/on 19 of this Ordinance. (11) Minimum Off-Street Parking: (a) Efficiency Apartments - i parking space per unit. (b) One Bedroom and above - 1.5 parking spaces per unit. SECTION TWO: This Ordinance shall become effective upon notice that it has been received by the office of the Secretary of State.
