Resolution 2011-058 RESOLUTION NO. 11- 'if! 8A A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA PROPOSING AN AMENDMENT TO THE COLLIER COUNTY GROWTH MANAGEMENT I'LAN, ORDINANCE 89-05, AS AMENDED, SPECIFICALLY AMENDING THE GOLDEN GATE AREA MASTER PLAN, INCLUDING THE GOLDEN GATE AREA MASTER PLAN FUTURE LAND USE MAP AND MAP SERIES, AND FURTHERMORE TRANSMITTING THIS AMENDMENT TO THE FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS. WHEREAS, Collier County, pursuant to Section 163.3161, et. sea., Florida Statutes, the Florida Local Government Comprehensive Planning and Land Development Regulation Act, was required to prepare and adopt a comprehensive plan; and WHEREAS, the Collier County Board of County Commissioners adopted the Collier County Growth Management Plan on January 10, 1989; and WHEREAS, the Local Government Comprehensive Planning and Land Development Regulation Act of 1985 provides authority for local governments to amend their respective comprehensive plans and outlines certain procedures to amend adopted comprehensive plans pursuant to Sections 163.3184 and 163.3187, Florida Statutes; and WHEREAS, Collier County has prepared plan amendments to the following element of its Growth Management Plan: Golden Gate Area Master Plan, including the Golden Gate Area Master Plan Future Land Use Map and Map Series, and WHEREAS, the Collier County Planning Commission on October 19, 2009 considered the proposed amendment to the Growth Management Plan pursuant to the authority granted to it by Section 163.3174, Florida Statutes, ending in a tie vote 4-4, forwarding no recommendation on the amendment to the Board of County Commissioners; and WHEREAS, the Board of County Commissioners on January 19, 2010 voted 4-0 (Commissioner Coyle absent) to indefinitely continue Petition CP-2008-1 and to place the proposed amendment to the Golden Gate Area Master Plan, to create the Estates Shopping Center Subdistrict at the intersection of Wilson Boulevard and Golden Gate Boulevard, on a straw-ballot referendum to be voted upon by the adjacent residents of Golden Gate Estates on the November 2,2010 general election; and Words underlined are added; Words strllek tl1reHgl1 are deleted Row of asterisks (*** *** ***) denotes break in text. 8A WHEREAS, the adjacent residents of Golden Gate Estates voted on November 2, 2010 in favor of the referendum and to return the proposed amendment to the Board of County Commissioners for final vote on March 22, 2011; and WHEREAS, upon receipt of Collier County's proposed Growth Management Plan amendments, various State agencies and the Department of Community Affairs (DCA) have sixty (60) days to review the proposed amendment and DCA must transmit, in writing, to Collier County, its comments along with any objections and any recommendations for modification, within said sixty (60) days pursuant to Section 1 63.3184, Florida Statutes; and WHEREAS, Collier County, upon receipt of the written comments from DCA must adopt, adopt with changes or not adopt the proposed Growth Management Plan amendment, within sixty (60) days of such receipt pursuant to Section 163.3184, Florida Statutes; and WHEREAS, the DCA, within forty-five (45) days of receipt of Collier County's adopted Growth Management Plan amendment, must review and determine if the Plan amendment is in compliance with the Local Government Comprehensive Planning and Land Development Act of 1985; the State Comprehensive Plan; the appropriate Regional Policy Plan and Rule 9J-5, Florida Administrative Code, pursuant to Section 163.3 l84, Florida Statutes. (3) Anv portion of the Proiect directlv abuttina residential property (propertv zoned E-Estates and without an approved conditional use) shall provide. at a minimum. a seventv-live (75) leet wide buffer. except the westernmost 330' 01 Tract 106. which shall provide a minimum 20' wide buffer in which no parkina uses are permitted. Twentv-five (25) feet of the width of the buffer alona the developed area shall be a landscape buffer. A minimum of liltv (50) feet of the buffer width shall consist of retained or re-planted native veaetation and must be consistent with subsection 3.05.07.H 01 the Collier County Land Development Code (LDC). The native veaelation retention area may consist of a perimeter berm and be used for water manaaement detention. Anv newlv constructed berm shall be reveaetated to meel subsection 3.05.07.H of the LDC (native veaetation replantina reauirements). Additionallv. in order to be considered for approval. use of the native veaetalion retention area for water manaaement purposes shall meet the followina criteria: a_ There shall be no adverse impacts 10 the nalive veaetation beina retained. The additional water directed to this area shall not increase the annual hydro-period unless it is proven that such would have no adverse impact to the existina veaetation. b. If the proiect reauires permittina bv the South Florida Water Manaaement District. the proiect shall provide a letter or official documenl from the District indicatina that the native veaetation within the retention area will not have to be removed to complv with water manaaement reauirements. If the District cannot or will not supply such a letter. then the native veaetation retention area shall not be used lor water manaaement. c. Estates Mixed Use District 2) NeiQhborhood Center Subdistrict - Recognizing the need to provide basic goods, services and amenities to Estates residents, Neighborhood Centers have been designated on Ihe Golden Gate Area Future Land Use Map. The Neighborhood Center designation does not guarantee that commercial zoning will be granted. The designation only provides the opportunily to request commercial zoning. a) The Collier County Land Development Code shall be amended to provide rural design criteria to regulate all new commercial development within Neighborhood Centers. b) Locations Neighborhood Centers are located along major roadways and are distributed within Golden Gate Estates according to commercial demand eslimates, (See Map 9). The centers are designed to concentrate all new commercial zoning, and conditional uses, as allowed in the Estates Zoning Districl, in locations where trallic impacts can be readily accommodated and to avoid strip and disorganized patterns 01 commercial and conditional use developmenI. Four Neighborhood Centers are established as lollows: . Wilson Boulevard and Golden Gate Boulevard Center. This center consists 01 all four three quadrants at the intersection of Wilson and Golden Gate Boulevards (See Map 10). The NE and SE quadrants of the Cenler consist 01 Tract 1 and 2, Unit 14, Tract 17, Unit 13 and Ihe western half of Tract 18, Unit 13 Golden Gate Estates. The NE quadrant of Wilson and Golden Gate Boulevards is approximately 8.45 acres. The parcels within the NE quadrant shall be interconnected and share access to Golden Gate Boulevard and Wilson Boulevard to minimize connections to these two major roadways. The SE quadrant of Wilson and Golden Gate Boulevards is 7.15 acres, allows 5.00 acres of commercial development, and allocates 2.15 acres to project buflering and right-ol-way for Golden Gale Boulevard and Wilson Boulevard. The NW quadrant of the Center is approximately 4.98 acres in size and consists of Tract 144, Unit 11 of Goldon Gate Estatos.
