WHEREAS, Collier County Ordinance #74-31 and Section 30-1 id)(2)
of the Collier County Code requires that the Board of County Commis-
sioners of Collier County review any application for an Exemption Certi-
ficate for the operation of vehicles on, In, over or across any gulf
beach, sand dune, or gulf shore vegetated area of Collier County, and;
WHEREAS, under Collier County Ordinance #74-31 and Section 30-1
id)(2) or the Collier County Code only, the Boar'd of County Commls-
sloners has the authority to issue said Exemption Certlt'icates, and;
WHEREAS, the procedures stated in Collier County Ordinance
#74-31 and Sectlon 30-1 id)(2) of the Collier County Code have beer
shown to be cumbersome and it would be more expeditious If the County
Manager would be designated the responsibility for the review and the
Issuance of an Exemption Certificate.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY that;
Section 1: Collier County Ordinance #74-31 and Section 30-1 id)(2) of
the Collier County Code are hereby amended and revised to read as
follows:
Vehicles which must travel on the beaches In connection with maintenance,
conservation and/or environmental work, shall be exempt if an Exemptlon
Certificate has been obtalnad from the County Manager of Collier County~
Florlda/ or hls designee, and said Exemption Certificate Is prominently
displayed on the wlndshleld of such vehicle. The procedure for obtaining
such an Exemption Cartiflcate shall be by application to the County ,
Manager in writlng, stating the reason or reasons why it Is necessary~
for such vehicle or vehicles to be operated on the beaches In connecti~
with a maintenance, conservation and/or environmental purpose~a_n ~
Exemption Certlficate for such vehicle or vehicles shall be Issueq~tby the_.
County Manager If the County Manager is satisfied that a lawful'~n__ d ~'~'['11 '
proper maintenance, conservation and/or environmental purpose ~il be

Section 2: Construction: The provisions of this Ordinance shall ~
deeme~J an exercise of the police power' of Collier County for the r)i~-
tactlon of the public health, safety and welfare, and therefore, shall be
liberally construed to accomplish that purpose and implement the legisla-
tive Intent and declaration.
Section 3: Effective Date: This Ordinance shall become effective
upon recelp{ of notice that It is filed with the Secretary of State.
