Ordinance 79-044ORDINANCE NO. 79-44 AN ORDINANCE CREATING THE LAKEWOOD, UNIT {6 STREET LIGHTING MUNICIPAL SERVICE TAXING DISTRICT; DESIGNATING THE GOVERNING BODY OF THE DISTRICT; AUTHORIZING A TAX LEVY AS PROVIDED BY LAW; PROVIDING FOR CONSTRUCTION AND AN EFFECTIVE DATE; AND PROVIDING THE BOUNDARIES OF TNB DISTRICT. BE IT ORDAINED BY THE BOARD OF COUNTY COmmISSIONERS OF COLLIER COUNTY, FLORIDA; SECTION ONE: Pursuant to Chapter 125 of the Florida Statutes; the Lakewood, Unit No. 6 Street Lighting )lunicipal Servicing Taxing District is hereby created for the purpose of providing street lighting to the residents of the area hereinafter described: Commencing at the northeast corner of Section 12, Tovnship 50 South, Range 25 East, Collier County, Florida; thence along the east line of said_Section 12, South 0 34'S9" East 47S.00 feet; thence South 89042'46'' IVest 1621.28 feet for the Point of Beginning of the description of land; Thence South 0°17~14'' East $80.1~ feet; thence South 29°57'$2'' East 327.99 feet; thence South $v17'14" East 579.92 feet; thence westerly 127.81 feet along the arc of a circular curve concave to the south, having a ladius of 1450.00 feet, subtended by a c~ord which bears South 89v35'21'' IVest 127.77 feet; thence South 2v58' 17" East 80.00 feet; thence easterly 107.53 feet along the arc of a circular curve concave to the south, having ~ radius of 1550.00 ,. feet subtended by a ihord which bears North 89 18'$5" East 10~.51 feet; thence South 2v50'23'' West 327.64 feet; thence South 89v42'S5,' . ' SECTION TWO: The governing body of the DistriCt shall be ex-officio tho Board of County Commissioners of Collier County, Florida. SECTION THREE: The District is formed for the purpose of providing street lighting in the above described subdivision~nd to th.~ end shall possess all the powers to do all things reas~rn~_t~y nec~.~sary , -~ ,~ ~ · ?~. ~ ~ ~ 009 = poles, wires, conduits, lights, meters, and tho power to maintain the same and to enter into contracts for providing the same and the electric current to operate any lighting system therein installed. SECTION FOUR: For the purpose of carrying into effect this Ordinance, tho Board of County Commissioners shall annually, at the time required by general budgetary law, make an itemized estimate of the amount of money required to carry out the business of the District for the next fiscal year, which shall be from October I to and including September $0 following. The estimate shall have for what purpose the monies are required and the amount necessary to be raised by taxation within the District. At the time and place for fixing t.he annual rate of taxation for county purposes, the Board shall fix and cause to be levied on all property within the district sublect to taxation a millage sufficient to meet the requirements of the estimate; provided, however, the total millage shall not exceed the millage authorized by law for municipal service taxing or benefit units. SECTION FIVE: Taxes herein provided for shall be assessed and collected in the same manner and form as provided for the assessment and collection of general county taxes and sub}ect to the same fees for assessing and collecting as general county taxes. SECTION SIX: Street lighting service shall not commence prior to October 1, 1980. SECTION SEVEN: This Ordinance shall be liberally construed to e££ectuate its public purpose. If any portion, phrase or word of this Ordinance is held invalid or unconstitutional, the remaining parts shall not be affected. SECTION EIGHT: Effective date of this Ordinance shall become e£fective as provided by law.
