Ordinance 79-025ORDINANCE NO. 79-25 AN ORDINANCE RESTRICTING ENTRY TO THE COUNTY WATER/SEWER DISTRICT WASTEWATER TREATMENT FACILITIES; DESIGNATING AUTHORIZED PERSONNEL; PROVIDING FOR A PENALTY AND PROVIDING AN EFFECTIVE DATE. the County Water/Sewer Distr~=g~ Waste~fa~ter WHEREAS, Treatment Plant serving Sewer Area "A" is toea~d readily accessible through roadway easement~_, a~aila~...~ ~o the public at large, and W}~EREAS, the Wastewater Treatment Plant~ontains~machinery and equipment, which if improperly operated or mishandled could result in harm to persons, property, machinery, equipment and the proper operation of the treatment process, and ~IEREAS, the Wastewater Treatment Plant, although enclosed by a fence, is accessible to the public at large, and WHEREAS, free public access to the plant site and the treatment equipment is a threat to the security of the equipment and control of the treatment process. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: Designated Authorized Personnel Entry to the County Water/Sewer District's Wastewater Treatment Plant site located on C-846 (Immokalee Road) and immediately East of Seaboard Coast Line Railroad Tracks, shall be restricted to the Board of Governors of the County Water/ Sewer District, designated County Utility Division employees, authorized personnel of the Florida Department of En~ronm~Ptal Regulation, specified independent testing laborator~pers~nne~ septic tank contractors having authorized business~t t~ wastewater treatment plant authorized County Roa~Depa~ personnel and such others specifically authorized by t~ County Utility Director. SECTION TWO: Entry to the Wastewater Treatment Plant site by all other persons shall be authorized by the County Utility Director or his duly appointed representative. SECTION ~IREE: It shall be unlawful for any person to enter the Wastewater Treatment Plant site without authorization from the County Utility Director or his duly appointed representative, except those persons designated in Section One of thfa Ordinance. SECTION FOUR: Penalty Violation of this Ordinance is punishable as provided by law for the violations of county ordinances. Each day an offense exists shall be considered a separate offense. Prosecution as a misdemeanor shall not preclude other remedies available in law and equity. SECTION FIVE: Effective Date The Ordinance shall take effect as provided by law.
