Ordinance 79-017 ORDINA/~CE NO. 79- 17 AN ORDINANCE TO CREATE THE GOODLAND MUNICIPAL FIRE DISTRICT WITH POWER TO PROVIDE FIRE PROTECTION SERVICES THEREIN AND THE POWER TO LEVY ONE (1) MIL OF AD VALOREM TAXES UNDER SECTION 125.01 (q) OF THE FLORIDA STATUTES; ESTABLISHING THE BOARD OF COUNTY COMMISSIONERS AS THE GOVERN- ING BOARD; PROVIDING AN EFFECTIVE DATE. WHEREAS, the public safety requires fire control ser- vices within Collier County, Florida and Section 125.01 (q) of the Florida Statutes grants authority for the Board of County Commissioners to establish municipal service taxing districts for the purpose of providing municipal services within said districts, including fire protection; NOW, THEREFORE BE IT ORDAINED BY THE'BOARDOF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: Section 1. A. The Goodland Municipal Fire District is hereby created. ~ B. The boundaries of said district shall be as follows: All lands lying eastward of the range line between Ranges 26 East and 27 East, and lying within Sections 18 and 19 of Township 52 South. Section 2. GOVERNANCE OF FIRE DISTRICT~ POWERS AND DUTIES. The governing body of the Fire District shall be the Board of County Commissioners of Collier County, which Boar~ she -~ have the following powers and duties: ~ ~ ~ ~ ..~ (a) To buy and own fire-fighting equipment and ~o o maintain a fire department or departments; ~ .~ (b) To buy and own real property, 'improvements and facilities for the purpose of fire protection and preven- tion; (c) To employ and pay any and all necessary firemen, supervisors and employees of whatsoever nature shall be needed, for the prevention and extinguishing of fires within the unit; (d) To enter into and make all contracts necessary to the fulfillment of the purposes and intents of this ordinance, which powur s~]all include the power to contract with ]nunlcl- palities, volunteer fire districts, and other territories of the County, to provide, or be provided with, fire protection, prevention and extinguishment sexwices; (e) To lease or rent any and all equipment, improve- ments, facilities and real property which may be necessary; (f) To appoint and/or employ such fire chiefs or fire administrators as shall be necessary; (g) To annually levy upon all the taxable property' within the Fire District an ad valorem tax in accordance with the provisions of Section 3 of this ordinance; (h) To erect fire stations and facilities; (i) To enter into insurance contracts; (j) To accept gifts and donations of equipment or money for use of the Fire District; (k} To prepare and adopt budgets; (1) To establish, by proper resolution, rules and regulations for the governance of the Fire District or any departments thereof.: and (m) To do all things which the Board of County Commis- sioners may by general and special law be otherwise empowered to do. Section 3. TAX LEVY AUTHORIZED. In order to pay the costs and expenses necessary for the establishment, main- tenance and operations of the Fire District, and for the payment of the necessary and needful equipment, facilities and realty therefor, there is hereby authorized to be levied annually upon all the non-exempt, taxable property within said Fire District an ad valorem tax not to exceed one mil. Section 4. CONSTRUCTION. This Ordinance shall be liberally construed to effectuate its public purpose. Section 5. SEVERANCE. If any portion, phrase or word of this Ordinance is held invalid or unconstitutional, the remaining parts shall not be affected. Section 6. EFFECTIVE DATE. This Ordinance shall not become effective until after adoption, filing with the Secretary of State, and upon receipt of official acknow- ledgment from the Secretary of State of the certification by oog 33 f the Board of County Commissioners of Collier County and its Clerk that this Ordinance was approved.
