Ordinance 79-015 ORDINANCE 79h 15 AN ORDINANCE AMENDING ORDINANCE 76-49 TO PROVIDE FOR TEMPORARY SUSPENSION OF ORDINANCE AND FOR RENUMBERING EN- SUING SECTIONS OF ORDINANCE. NOW, THEREFORE, BE IT OHDAINED by thc Boa~ o~Coun~y - missioners of Collier County, Florida, au: Ordinance 76-49 which places certain restrle:~i~fi~ on parking of motor vehicles in Collier County is hereb~Smende~o_by adding the following: SECTION ONE: "SECTION 4 - Provision for Temporary Suspension of Ordinance. Upon written application of a public official or an officer of any organization legally constituted under the Cons~itutlon and laws of the State of Florida for suspension or temporary alteration of the terms of this Ordinance, the County Manager shall transmit such request to the Board of County Commissioners. All such appli- cations shall be made to the County Manager no less than 30 days prior to the date upon which such suspension or temporary altera- tion is requested to take effect. ~The Board shall determine in open meeting whether the requested action will be in the public interest of Collier County. If the Board finds that public interest of Collier County, the Board of Count~.~ Comm~s~rs shall by resolution grant the request for a time certain a~ such terms and conditions as it deems necessary to p~tectC~he~ safety and welfare of the citizens of Collier County." SECTION TWO: Present Sections ~ to 15 of Ordinance 76-49 shall be renumbered Sections 5 to 16, respectively. SECTION THREE: Effective Date. The Board of County Commissioners hereby waives notice require- ments by a four-fifths vote declaring that an emergency exists neces- sita~ing the immediate enactment of this Ordinance. The Clerk of the Board shall file a certified copy of this Ordinance with the Department of State as soon after its enactment 1 of 2 as is pi'acticable by registered, special dellvei, y mail. This Ordinance shall become effective upon being accepted by the postal authority for delivery by registered mail to the Department of State.
