Ip TO TwO MTT,I..R; PROVIDING FOR CONSTRUCTION= AND AN EFFECTIVE DATE oo BE IT ORDAINED BY THE BOARD OF COUNTY CO~ISSION~S OF=CO COUNTY, FLORIDA; :' ' .- SECTION ONE: Pursuant to Chapter 125 of the Plori~ S~atutc~ tho Forest Lake ]{omcs Unit No. 1 Street Lighting Hun~c~pal Servicing Taxing District is hereby created for the purpose of providing street lighting to the residents of the area hereinafter described: A tract of land in Section 14, Township 49 South, Range 25 East, Collier County, Florida, described as follows: From the Northwest corner of said Section 14, run S 00° 19' 00" W, along the ]Vest line of said Section 14 for 50.00 feet to the POINT OF BEGINNING on the Southerly Right-of-Way line of State Road S-896 (Pine Ridge Road); thence run East, along said Right-of-Way line, for I275.27 feet; thence South, for 164.44 feet to a point on curve; thence 233.53 feet along the arc of a curve, concave to the Northwest, having a radius of 1527.85 feet and subtended by a chord having a length 233.30 feet and bearing S 68°42'15.5'' W; thence S 16o55'01 along a radial line, for 60.00 feet to a point on curve; thence 463.28 feet along the arc of a curve, concave to the Northwest, having a radius of 1587.85 feet and subtended bg a chord having a length of 461.64 feet and bearing S 81 26'29.5" thence S 00012'00`' E, along a radial line, for 150600 feet; thence S 75023'50'' IV, for 143.65 feet; thence S 24 56'00" IV, for ~30.68 feet; thence S 08031'50'' E, for 202.24 feet; thence S 03 ~8'50" W, for 300.66 feet; thence So~th, for 97.56 feet; thence West, for 100.00 feet; thence S 82 56'16" lq, for 60.~6 feet; thence South, for 115.00 feet; thence West, for 283.02 feet to a point on the West line of said Section 14, thence N 00°19'00'' E, along said IVest line, for 1400.00 fc~ct to-~he POINT OF BEGINNING. SECTION TWO: The governing body of the District shall ~ ex-officio the Board of County Commissioners of Collier County, Fl~rida.~ SECTION THREE: The District is formed for the purpos~ of ~v~I~ng street lighting in the above described subdivision and ~o tha~end shall possess all the powers to do all things reasonably necessary to provide such services, including ownership or rental of property, poles, wires, conduits, lights, meters, and the power to maintain the same and to enter into contracts for providing the same and the electric current to operate any lighting system therein installed. SECTT~N FOIIR: Par thn purpose of carrying into effect this Ordinance, the Board of County Commissioners shall nnnually, at the time required by general budgetary law, make an itemized estimate of the amount of money required to carry out the business of thc District for thc ncxt fiscal year, which shall be from October 1 to and including September 30 following. The estimate shall have for what purpose thc monies are required and the amount necessary to be raised by taxation within the District. At the time and place for fixing thc annual rate of taxation for county purposes, the' Board shall fix and cause to be levied on all property within the District subjcct to taxation a millage sufficient to meet the requirements o~ the estimate; provided, however, the total millage shall not exceed two {2) mills. SECTION FIVE: Taxes herein provided for sh~ll be assessed and collected in thc same manner and form as provided for the assessmcnt and collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes. SECTION SIX: This Ordinance shall ~e liberally construed to cffcctuate its public purpose. If any portion, phrase or word of this Ordinance is held invalid or unconstitutional, the remaining parts shall not be affected.
