AN ORDIMANCE PROHIBITING THE SALE OF CIGARETTES,
TOBACCO, CIGARETTE WRAPPERS AND PIPES TO MINORS;
PROVIDING FOR DEFINITIONS; PROVIDING FOR A PENALTY
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Surgeom General of the United States has
determined that cigarette smoking is dangerous to one's
heal th; and
~{EREAS, the effect of tobacco is even more pronounced
in minors than in adults; and
WHEREAS, the Board of County Commissioners of Collier.
County are desirous of protecting the health and&.~el~are ~

NOW THEREFORE BE IT ORDAINED BY ~HE BOARD OFf COLiNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:

SECTION ONE: Definitions.
(1)
The word "minors" shall~ mean and includ~ any natural
person who has not attained the age of 18 years.
(2) The word "person" shall mean and include individuals
firms, associations, joint ventures, partnerships,
estates, trusts, business trusts, syndicates, fiduciaries,
corporations, and all other groups or combinations.
SECTION TWO: Sale of Cigarettes, Tobacco, Cigarette W,~pper~
and Pipes to Minors Prohibited.
No person shall sell, barter, furnish, or give aw~7, to'~
any minor, any cigarette, cigar, tobacco, tobacco product, ..~
cigarette ~rapper, pipe or other smoking paraphenalia~,~or
an7 substitute for the foregoing.
SECTION THREE. Penalty.
Violation of this Ordinance is punishable as provid.ed by law
for the violations of county ordinances. Each day an offense
exl,~ts shall be considered a separate offense. Prosecution
as a misdemeanor shall not preclude other remedies available
in law and equity.
SECTION FOTIR: Effective datc.
?his Ordinance shall take effect as provided by law.
