Ordinance 79-001ORDINANCE NO. 79- AN ORDINANCE CREATING THE WILLOUGHBY ACRES WATER AND SEWER UNIT; PROVIDING THAT SAID UNIT SHALL HAVE THE POWERS OF A MUNICIPAL SERVICE TAXING UNIT PUR- SUANT TO CHAPTER 125, FLORIDA STATUTES; DECLARING AN EMERGENCY TO EXIST NECESSITATING ~IE IMMEDIATE ENACTMENT OF THIS ORDINANCE; PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA THAT: SECTION ONE: There is hereby created a Municipal Service Benefit Unit to be known as the Willoughby Acres Water and Sewer Unit, (hereinafter referred to as "Unit"). SECTION TWO: The boundaries of said Unit shall be as follows: Ail lands located in the Southwest 1/4 of the Northeast 1/4, and, the Northwest 1/4 of the Southeast 1/4, and, the ~orth 1/2 of the North- we_st ~/4 of the Northeast 1/4 of the Southeast l~/~,~nd0 the ScUthWCSt 1/4 of the Southeast 1/4, eno; the Southeast 1/4 of the Southwest 1/4, and, t~ Northeast 1/4 of the Southwest 1/4, and, th~[Sduth 1/2 of the Southeast 1/4 of the North- we~_t<l/4, and the South 1/2 of the Southwest 1/4 of~t/~e~Southwest 1/4, all lying within Section 24, ~ C To_~p 48 South, Range 25 East, Collier ,ounty, FlOrida., including all of Willoughby Acres Sub- dtvisi~Yn ss recorded in Plat Book 8 at Pages 24, 25, and 26 of the Public Records of Collier County, Florida. SECTION THREE: This Unit is created pursuant to the powers granted to counties by Chapter 125, ~lorida Statutes and said U~it shall have the power to do all things necessary for the provision of water and sewer facilities within the boundaries of said Unit as may be. authorized by law. SECTION FOUR: The Board of Count~ Commissioners at its Regular~eetiYY~ has waived all notice requirements of the Florida Statutes by at least 4/Sths vote of its membership. It has found that an emergency exists and that immediate enactment of this Ordinance is necessary. SECTION FIVE: This Ordinance shall take effect when a copy has been 008 accepted by the po:::aI authorities of the government of the United States for special delivery by registered mail to the Departme~tL of State ~ i= provided by law.
