BE IT ORDAINED BY THE BOARD OF COUNTY CO}~ISSIONERS OF
COLLIER COUNTY, FLORIDA, that:
SECTION ONE:
SECTION ONE (2) of Ordinance No. 80-40 is hereby amended
to read as follows:
"2. Coconut Palms. Means all coconut palms of the species
cocos nucifera except for those trees known as Malayan coconut
palms."
SECTION TWO:
SECTION TWO of Ordinance No. 80-40 is hereby repealed.
Those remaining Sections of Ordinance 80-40 shall be re-numbered,
with the existing Section Three becomfn$ Section Two and the
following Sections being re-numbered accordingly.
SECTION THREE: Conflict and Severance.
(a) In the event this Ordinance conflicts with other applicable
law, the more restrictive shall apply. If any portion of this
Ordinance is in conflict with an ordinance of any municipality
within Collier County, it shall not be effective within the
municipality to the extent of such conflict.
(b) If any section, subsection, sentence, clause, phrase,
or portion of this Ordinance is, for any reason, held invalid or
unconstitutional by any court of competent Jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision of such holding and shall not affect the vali~ty o~
the remaining portion thereof. ~ SECTION FOUR: Penalty. ~
A violation of any provision of this Ordinance is m.m:Lsd~e~
and a violator shall be punished accordins ~o~ law. Eac~viol~'ion
shall constitute a separate o££~nse. In add£cion Co the cLviL
remedies provided herein, the Board o£ County Commissioners shall
have the power to collaterally enforce the p~ov~sions of this
Ordinance by approp~iate ~udieialwriC o~ proceeding not~elthetanding
any prosecution as a misdemeanor.
SECTION FIVE:
This Ordinance shall become effective upon becoming law.
