' SECTION ONE.' UNLAWFUL TO FAIL TO RETURN LIBRARY MATERIALS "117 shall be unlawful for any'pa.~son to fall to return any library book, 'aUdio or video recording, fllm~ magazlne~ or any other a'rtlcle of per- sonal property borro~ved from't~e Cellla~ County F~ee Pub, JJj: any or. its. branch~s after ten (10) days have elapsed from t~b date~r written request for return by said librar-y o~' an authorlze~ agen.l_~_of said library. SECTION TWO: UNLAWFUL TO FAIL TO REPORT LOST LIBRARY MATERIALS AND REIMBURSE FOR SAME It sham be unl~wl'ul for any person to fall to r~eport any lost lib. rary book, audio or video recording, film, magazlne~ or any othe~' article of personal property borrowed from the Collier 'County Free Public Llbrary or any of its branches end it shall also be unlawful for any person to fall to reimburse sald library for sald materials a~er ten (10) days have elapsed from the date of recelpt_0fe written request for ralmburs.ment by said library or an authorized agent of laid library. The notice requesting reimbursement for 'such materials shall be sent by registered or certified mail addressed to said person at the last known address furnished to the Collier County Free Public Library as.evldenced by the` records retained by said library. SECTION THREE: UNLAWFUL TO DESTROY OR DAMAGE LIBRARY MATERIALS OR TO FAIL TO REIMBURSE FOR SUCH JVlATERIALS OR DAMAGES THERETO It shall be Unlawful for any person to wlllfuliy destroy, deface~ mar, or otherwise damage any library book~ audio or video recording, film, ... magazine, or.a.ny .other.a.rtlc. l.e;of personal p.ropert¥ borrowed from the Collier County Free Public Library or any of its branches, ' or to fall to reimburse 'said library for destr~Jctlon of or damage to such materials after ten (10) d~ys have elapsed from the date 'of receipt of · writte~ · request for reimbursement by said library or an authorized agent of 'sald library, whether or not aa'Id destruction or damage iS willful or accidental. The notice requesting reimbursement for such destruction or damage shall be sent by registered or certlfled mall addressed to said person at the last known address furnlshed to the Collier County Free Public Library as evidenced by the records retalned by said library. SECTION FOUR; UNLAWFUL TO FURNISH FALSE NAME OR ADDRESS OR TO USE A FALSE LIBRARY CARD I,t shall bi urilawful for any person, ~vlth.lntent l~o secure the loan of any book, audio 'or video recording~ film~ megazlne~ or any other · article of personal property from the Collier 'County Free ?~.bllc Library or any of Its I~ranehas~ to furnish · false name or a'ddress or to present with such lntent~ a false~ forged or counterfeited library borrower's Identification card to any authorized agent or employee of the Collier' County Free Public Library. SECTION FIVE; SERVICE FEE In addition to any reimbursement herein required, any indlvldual to 4. ~vhom a notice has been sent under the provisions of this Ordinance shall pay to the Collier County Free Public Library a lervlce fee In the ~moun', of three dollars ($).00). SECTION SIX: PRIMA FACIE EVIDENCE OF IDENTITY In any prosecution or action under the provisions of this Ordinance In which a library borrower's Identification card Issued by the Collier county Free Public Library was'used at the time o~ the b r In said materials, the information retained and contained within the records of the Collier County ~=ree Public Library pertaining to that card, along with the name that appears on the library card used to borrow sald materials shall constitute prima facie evidence of the Identity of the person borrowing said library materials end that such person was th~ party authorized by the Collier County Free Publlc Library to use the aforesaid library card. " ' SECTION SEVEN: PENALTY FOR VIOLATION OF SECTIONS ONEt TWO' ~'HREE OR FOUR "Any person 'or"persons who shall ~vlolate the p~ovlslons'of this Ordlnance shall be guilty o1' a misdemeanor punishable by a fine ~not to exceed five hundred dollars ($500) or Imprisonment In the Collier County Jail not to exceed sixty (60) days, .or both. SECTION EIGI~IT: SEVERABILITY ir any section, subsection, sentence, clause,' phrase, or portion of this chapter shall for any reason be held invalid or unconstitutional by a court of competent Jurisdiction, 'such portTon shall be deemed a separate, distinct, and independent* provl?lon and such holdln, g sh~ll not affect the validity of the remaining portion' hereof. SECTION NINE: INCLUSION IN COD. E. It Is the intention of the Board or County Commissloners that the pro-' visions or this Ordinance shall become and be made a Part of the Collier County Code of Laws and Ordinances, and that the 'sections of thls Ordinance may be renumbered or re-lettered and the word "or:dlnance" · ' may be changed' t~ ~section", "article", or' such other appropriate word or- phrase in order to accomplish such Intentions.' ' SECTION TEN: EFFECTIVE DA~I'E The effective date of this Ordinance shall be upon acknowledgement from the Secretary of State that the Ordinance has been duly filed.
