AN ORDINANCE AMENDIN~ COLLIER COUNTY
ORDINANCE NO 75-19 AS IT RELATES TO PRO-
}IIDITED ACTIVITIES SEAWARD OF T}~E COASTAL
CONSTRUCTION SETBACK LINE, PROVIDING FOR
EXEMPTION OF DESIGNATED EXOTIC PLANT SPECIES;
PROVIDING AN EFFECTIVE DATE
W~EREAS, Collier County Ordinance No. 75-12 establis~es
a coastal construction setback line prohibiting ~X.~in
activities seaward of such line, and;
~{EREAS, certain exotic plant species have'been shown
to be undesirable and are required to be removJ~.~.~ mos~-~a~d
improvements pursuant to Collier County Ordinan~e No. 79~3,
and;
~E~AS, Australian pine trees, Casuarina equisetifolia,
punk treus, Melaleuca leucodendra and Brazilian pepper, Schinus
terebtnth~fol~us have not proven to be of any value to the
maintenance ~f beach lands,
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF CO~_TY
COMMISSIONERS OF COLLIER COUNTY, fLORIDA that, %
Section 1. SECTION THREE of Collier County Ordl.n~ce
75-10 ts hereby amended to read as follows~
SECTION TIIREE~ Prohibited activities seaward of th~
.etback line. I~ shall be unlawful for any person, ft~ or
corporation to construct any ~bru~ture, make any excavation,
remove any ~ach material or otherwls~ alter ground elevations,
or cause to be damagd~ such sand dune or vegetation growing
thereon, seaward of the coastal construction setback line,
except as to the removal of Australian pine trees, Casuar~na
equtsetlfolta, punk trees, Melaleuca leucodendra and Brazilian
pepper, Schtnus terebtnthifol~us or as othe~tse hereinafter
provided.
Section 2. ~ffecttv~ Date. This Ordtnan~ ~hall he,me
