Ordinance 80-006 ORDINANCE NO. 80- 6 AN~EMERGENCY ORDINANCE AMENDING COLLIER COUNTY ORDINANCE NO. 79-102 AS IT RELATES TO PROHIBI- TING THE DISCHARGE OF RIM FIRE OR CENTER TYPE OF~FIREA~S WITHIN THE URBANIZING PORTION OF GOLDEN.GATE ESTATES TO INCLUDE UNITS 16, 17 .ANDi?0~bF GOLDEN GATE ESTATES; DECLARING AN EMERGENCY; SEVERABILITY; PROVIDING AN EFFEC- TIVE DATE. WHEREAS, concern has been expressed by residents of Units 16, 17 and 70 of Golden Gate Estates located within Collier County as to the discharging of firearms in the aforesaid portions of Collier County and in the vicinity of residences and dwellings within such unit, and WHEREAS, the discharge of firearms within the aforesaid units poses a danger and threat to the lives, safety, well- being and welfare of the residents of Collier County, and WHEREAS, this conduct and activity constitutes a public emergency threatening the health, welfare and safety of the aforesaid citizens and residents of Collier County, and NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: Section 1. Section 2. of Collier County Ordinance No. 79-102 is hereby amended to read as follows; by adding the underlined words: "A. The discharge of any rim fire or center fire type of firearm, or of any shot greater in size than standard ~5 shot from a shotgun is. hereby prohibited within the urbanizing portion of Golden Gate Estates as heretofore defined and within Units 16, 17 and 70 of Golden Gate Estates." ~~ ~ ~ Section 2. Egergency, Be it declared that an emergen~ exi~ -~ and the immediate enactment of this Ordinance is neces~ry, ~ ~ therefore, notice requirements are waived and this Ord~nanc~~ ~: ~ shall take effect immediately upon its placement in t~ Un~d States mail to the Secretary of State. Section 3. Severabtlity.. It is declared to be the intent of the Board of County Commissioners that if any section, subsection, sentence, clause, phrase or provision of this Ordinance is held invalid or unconstitutional, such invalidation or unconstitutionality shall not be so construed as to render invalid or unconstitutional the remaining provisions of this Ordinance. Section 4. Effective Date. This Ordinance shall take effect immediately upon adoption and filing as provided by law. PASSED AND DULY ADOPTED this 15th day of January, 1980.
