Ordinance 81-86AN ORDINANCE CREATING TIlE IMPERIAL GOLF ESTATES PIIASE I! STREET LIGtlTING MUNICIPAL SERVICE TAXING UNIT; PROVIDING THE BOUNDARIES OF THE UNIT: DESIGNATING TItE GOVERNING BODY OF THE UNIT; AUTHORIZING A TAX LEVY AS PROVIDED BY LAW; PROVIDING FOR CONSTRUCTION AND AN EFFECTIVE DATE BE IT ORDAINED BY THE BOARD OF COUNTY CO~IISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: Pursuant to Chapter 125 of the Florida Statutes, the Imperial Golf Estates Phase II Street Lighting Municipal Service Taxing Unit is hereby created for the purpose of providing lighting to the residents of the unit. This unit shall be deemed a municipal service taxing or benefit unit as the same are delineated by Section 125.01 iq), Florida Statutes. SECTION TWO: 'The unit is described as follows: A parcel of land situated tn Section 14, Township 48 South, Range 25 East, Collier County, Florida. SECTION THREE: ~he governing body of the Unit shall be ex-officio the Board of County Commissioners of Collier County, Florida. SECTION FOUR: The Unit is formed for the purpose of provtdfng street lighting in the above described subdivision and to that end shall possess all the powers to do all things reasonably necessary to provide such services, including ownership or rental of property, poles, wires, conduits, lights, meters, and the power to maintain the same and to enter into contracts for providing the same and the electric current to operate any lighting system therein installed. SECTION FIVE: For the purpose of c~rying into effect this ordinance, Boa~ o County Con~tssioners shall annually, at the time required by general budgetary~aw~_~Ake an ttemized estimate of the amount of money requtred to carry out the bditness.~T Unit for the next fiscal year, which shall be fro~ October 1 ta and tnc~ding ~eptember 30 following. The estlmate shall have for what purpose the monies are required end the amount necessary to be raised by taxation within the unit. At the time end place for fixing the annual rate of taxation for county purposes, the Board shall fix and cause to be levied on all property within the unit subject to taxatton& millage sufficient to meet the requirements of the estimate; provided, ho~ver, the total millage shall not exceed the millage authorized by law for municipal servtce taxing or benefit units. SECTION SIX: Taxes herein provided for shall be assessed and collected, tn the same manner and form as provided for the assessment and'collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes. SECTION SEVEN: This ordinance shall be liberally construed to effectuate ttg public purpose. If any portion, phrase or ~rd of this Ordinance is held invalid or unconstitutional, the renatntng parts shall not be affected.
